    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Habiendo transcurrido treinta (30) días hábiles de exposición al público del expediente relativo a la aprobación de la Ordenanza fiscal reguladora del precio público por la prestación del servicio de aparcamiento subterráneo de la Plaza de Europa de Es Pujols de Formentera, cuya exposición fue publicada en el Boletín Oficial de las Illes Balears núm. 76 de 21 de junio de 2018, y no constando la presentación de reclamación en esta Entidad, una vez dado cuenta al Pleno del Consell de Formentera de fecha 31 de agosto de 2018 de la aprobación definitiva, se hace público que ha quedado definitivamente aprobada la Ordenanza fiscal reguladora del precio público por la prestación del servicio de aparcamiento subterráneo de la Plaza de Europa de Es Pujols de Formentera, cuyo texto es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA FISCAL REGULADORA DEL PRECIO PÚBLICO POR LA PRESTACIÓN DEL SERVICIO DE APARCAMIENTO SUBTERRÁNEO DE LA PLAZA DE EUROPA DE ES PUJOLS DE FORMENTERA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Capítulo I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&amp;nbsp;Objeto, competencia y cuestiones generales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 1&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Objeto de la ordenanza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El objeto de la presente Ordenanza es la regulación de los precios públicos y del uso y el régimen interno del aparcamiento subterráneo de la plaza de Europa de es Pujols, bajo titularidad y gestión del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos y naturaleza jurídica&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Consell Insular de Formentera, conforme a lo dispuesto en los artículos 2.1 e) y 127 del Texto refundido de la Ley Reguladora de las Haciendas Locales (RDL 2/2004, de 5 de marzo), que establece los precios públicos para la prestación del servicio de aparcamiento subterráneo, que se regulará conforme a lo establecido en los artículos 41 a 47 del citado Texto refundido, y por analogía, por la Ley 8/89, de 13 de abril, de tasas y precios públicos, modificada por la Ley 25/1998 de 13 de julio, y por lo preceptuado en esta ordenanza reguladora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Capítulo II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&amp;nbsp;Obligados al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- El precio público regulado en esta ordenanza se satisfará por todas aquellas personas usuarias que se beneficien del aparcamiento subterráneo de la plaza de Europa Pujols, aparcamiento de 136 plazas titularidad del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- A estos efectos será considerado persona beneficiaria y obligada al pago del precio público por la reserva de plaza fija la persona titular de ésta y por las estancias eventuales y / o rotatorias, tanto las que sean por minutos como las que sean semanales o mensuales, el conductor/a del vehículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- La obligación del pago del importe de precio público nace en el momento en que se autorice el ingreso del vehículo dentro de las instalaciones del aparcamiento público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- En caso de abandono o no presencia del conductor/a del vehículo, será requerida la persona propietaria del mismo. Será requisito imprescindible para la salida de cualquier vehículo el previo pago del importe del precio público devengado según cada modalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Capítulo III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&amp;nbsp;Precios públicos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Importe de los precios públicos vigentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- El Consell Insular de Formentera hará público con carácter anual, dentro del mes de enero, un cuadro de precios que incluirá la actualización de los importes de los precios públicos para cada una de las modalidades de uso del aparcamiento y el número de plazas designadas por cada modalidad. La revisión de los precios se realizará previo informe de la persona responsable del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Las tarifas vigentes serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Régimen de plaza fija:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Abono anual: 720 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Abono de invierno (semestrales 1 de noviembre- 30 de abril): 150 euros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Régimen de rotación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Abonos mensual:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Tarifa de verano: 80 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Tarifa de invierno: 25 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Abono semanal:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Tarifa de verano: 35 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Tarifa de invierno: 12 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Rotación por minutos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Precio de la hora de estacionamiento: 1,70 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Importe mínimo: 0,50 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Importe por minuto: 0,028 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Pérdida del ticket: se aplicará el tiempo real consumido mediante la comprobación de la estancia del vehículo. Véase artículo 25 del Reglamento de Uso y Régimen Interno del aparcamiento subterráneo de la plaza de Europa Pujols de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Precios publicidad (paneles 2,00 x 1,25):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Muros laterales interiores: 400,00 euros / año&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.- Todos los precios indicados incluyen el IVA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.- Según lo establecido en el artículo 47 de la Ley 2/2004, de 5 de marzo, del texto refundido de la Ley Reguladora de Haciendas Locales, y según lo establecido en el artículo 23.2 .b) de la Ley 7/1985, de 2 de abril, Reguladora de las bases de régimen local, el Pleno del Consell Insular de Formentera delega en la Comisión de Gobierno la modificación de los precios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Bonificaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Régimen de plaza fija o rotación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Las personas con discapacidad o con discapacitados a su cargo, con un grado reconocido del 33% o superior, podrán beneficiarse de una bonificación del 75% en el importe del precio público de los abonos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Los conductores/as de vehículos eléctricos podrán beneficiarse de una bonificación del 75% en el importe del precio público de los abonos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c.- Los conductores/as de vehículos híbridos podrán beneficiarse de una bonificación del 50% en el importe del precio público de los abonos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Rotación por minutos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Las personas con discapacidad o con discapacitados a su cargo, con un grado reconocido del 33% o superior, podrán beneficiarse de una bonificación del 100% en el importe del precio público por rotación por unidad de tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Los conductores/as de vehículos eléctricos podrán beneficiarse de una bonificación del 100% en el importe del precio público por rotación por unidad de tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c.- Los conductores/as de vehículos híbridos podrán beneficiarse de una bonificación del 50% en el importe del precio público por rotación por unidad de tiempo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Las bonificaciones serán de aplicación previa petición de la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Según lo establecido en el artículo 47 de la Ley 2/2004, de 5 de marzo, del texto refundido de la Ley Reguladora de Haciendas Locales, y según lo establecido en el artículo 23.2 .b) de la Ley 7/1985, de 2 de abril, Reguladora de las bases de régimen local, el Pleno del Consell Insular de Formentera delega en la Comisión de Gobierno la modificación de las bonificaciones en los importes de los precios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cobro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El pago del precio público se realizará:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Las estancias eventuales o rotatorias por minutos, en el momento de abandonar el aparcamiento y conforme a la liquidación que al acto se realice.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- En cuanto a las estancias prolongadas o fijas (anuales y semestrales de invierno), o abonos semanales y mensuales, el ingreso se hará por anticipado, bien directamente a la cuenta corriente habilitada por el Consell Insular de Formentera, entregando el comprobante de pago a la OAC, en la OVAC o bien en las oficinas del aparcamiento de la plaza de Europa; mediante domiciliación bancaria a cuentas indicadas por los usuarios; o en las oficinas del aparcamiento de la plaza de Europa de es Pujols mediante tarjeta de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Dentro de los primeros 10 días de cada mes se practicarán las liquidaciones periódicas correspondientes, expidiendo los oportunos recibos que se presentarán al cobro a las entidades bancarias señaladas o en las propias personas usuarias para proceder al pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- En el supuesto de devolución del recibo girado por la entidad bancaria se requerirá al beneficiario del servicio el ingreso del importe de la deuda que deberá hacerse efectivo en el plazo máximo de 5 días a la misma entidad bancaria o mediante tarjeta de crédito, en las oficinas del aparcamiento subterráneo de la plaza de Europa Pujols.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&amp;nbsp;&amp;nbsp;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Capítulo IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;Modalidades de uso del aparcamiento, distribución de plazas y área de Influencia&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tipologías de persones usuarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las modalidades de uso del aparcamiento serán las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Modalidad fija:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Abono anual&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La persona usuaria con un abono anual es aquel abonado que paga un precio anual (365 días desde que se adquiere el abono) para la utilización del aparcamiento. Contará con una plaza fija y numerada asignada durante la anualidad contratada. La renovación de este abono será anual mediante solicitud y en función de la disponibilidad de plazas que el aparcamiento tenga designadas para este tipo de abono.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Podrán solicitar un abono anual las personas residentes en el núcleo urbano de Es Pujols, trabajadores y trabajadoras de la zona o propietarios de un apartamento o negocio. Debiendo cumplir con los criterios de área de influencia del aparcamiento, criterios detallados en el artículo Anexo I de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Abono de invierno&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La persona usuaria con consideración de abonado de invierno es aquel abonado que paga un precio semestral (del 1 de noviembre al 30 de abril) por la utilización del aparcamiento exclusivamente en los meses comprendidos entre noviembre y abril inclusive. Contará con una plaza fija y numerada asignada durante la temporada considerada de invierno. Debiendo cesar en el uso de este tipo de abono y dejar la plaza libre como máximo el día 30 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Modalidad Rotatoria&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c.- Abono mensual&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tendrán consideración de abonados mensuales aquellas personas usuarias que soliciten utilizar el aparcamiento de forma mensual y abonen la cantidad indicada en la tarifa vigente. La renovación de este tipo de abono será mensual, debiendo el usuario abonar la tarifa en vigor en cuenta el mes en el que hará uso del aparcamiento. Este tipo de abono no tendrá en ningún momento reserva de plaza fija asignada y estará sujeto a la disponibilidad de plazas del aparcamiento para su utilización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Podrán solicitar un abono mensual las personas residentes en el núcleo urbano de Es Pujols, trabajadores y trabajadoras de la zona o personas propietarias de un apartamento o negocio. Debiendo cumplir con los criterios de área de influencia del aparcamiento, criterios detallados en el artículo Anexo I de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A efectos de modalidades de uso y aplicación de precios se distinguirán dos temporadas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Temporada de verano: del 1 de mayo al 31 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Temporada de invierno: del 1 de noviembre al 30 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d.- Abono semanal&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tendrán consideración de abonados semanales aquellas personas usuarias que soliciten utilizar el aparcamiento de forma semanal y abonen la cantidad indicada en la tarifa vigente. La renovación de este tipo de abono será semanal, debiendo el usuario abonar la tarifa en vigor en cuenta a la semana en el que hará uso del aparcamiento. Este tipo de abono no tendrá en ningún momento reserva de plaza fija asignada y estará sujeto a la disponibilidad de plazas del aparcamiento para su utilización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A efectos de modalidades de uso y aplicación de precios se distinguirán dos temporadas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Temporada de verano: del 1 de mayo al 31 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Temporada de invierno: del 1 de noviembre al 30 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e.- Rotación por unidad de tiempo (minutos)&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Son los usuarios que utilizan el aparcamiento por un tiempo corto y limitado, acceden mediante ticket, no tendrán reserva de plaza y su utilización del aparcamiento estará sujeta a disponibilidad de plazas libres. Al finalizar su estancia deberán abonar el coste del aparcamiento que variará en función del tiempo de estancia, en minutos. Las tarifas para rotación serán públicas y estarán recogidas en el cuadro de precios públicos del aparcamiento. En todos los casos, los precios serán los autorizados e implantados en cada momento por el Consell Insular de Formentera, de aplicación en el Aparcamiento Subterráneo de la Plaza de Europa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Distribución de las plazas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- El Pleno del Consell Insular de Formentera delegará en la Comisión de Gobierno la atribución del número de plazas destinadas a cada modalidad. La revisión del número de plazas destinadas a cada modalidad se revisará anualmente junto con el cuadro de precios públicos. La designación de plazas se realizará previo informe de la persona responsable del aparcamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Quedará cancelada en cualquier caso la reserva de plaza cuando la persona titular de la misma se demore por más de 10 días en el pago del precio mensual o correspondiente, desde la presentación de la factura, sin perjuicio de su obligación del abono de los precios públicos liquidados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- El interesado podrá renunciar a la reserva de plaza notificándolo por escrito al Consell Insular de Formentera y la baja causará efecto desde el último día del mes en curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 9&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Porcentajes máximos y mínimos de plazas disponibles según las diferentes modalidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Distribución en temporada de verano (1 de mayo - 31 de octubre):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- El Pleno del Consell Insular de Formentera delegará en la Comisión de Gobierno la atribución del número de plazas destinadas a cada modalidad. La revisión del número de plazas destinadas a cada modalidad se revisará anualmente junto con el cuadro de precios públicos. La designación de plazas se realizará previo informe de la persona responsable del aparcamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Se reservarán 5 plazas de aparcamiento para personas con discapacidad o con discapacitados a su cargo, en cumplimiento del decreto 110/2010, de 15 de octubre, por el que se aprueba el Reglamento para la mejora de la accesibilidad y supresión de barreras arquitectónicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.- Se reservarán 6 plazas de aparcamiento para vehículos eléctricos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 10&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fijación del área de influencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. El área de influencia del aparcamiento subterráneo de la Plaza de Europa es la que se aprueba como Anexo I a la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. La Comisión de Gobierno del CIF aprobará el ámbito del área de influencia correspondiente al aparcamiento subterráneo de la plaza de Europa de es Pujols.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Aparte de la competencia de la Comisión de Gobierno del CIF para la modificar el área de Influencia, cuando la demanda de plazas fuera insuficiente, ésta podrá ampliar el área de Influencia del aparcamiento cuando se dé esta situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. La aprobación del área de Influencia deberá someterse a información pública por un plazo de 15 días naturales a la página web del Consell Insular de Formentera y en los tablones de anuncios del Consell Insular y del Aparcamiento subterráneo de la plaza de Europa Pujols.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Capítulo V&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&amp;nbsp;Requisitos para acceder al uso de una plaza y documentación a aportar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 11&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Orden de preferencia y requisitos para la solicitud de los abonos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Dado que el número de plazas es limitado la adjudicación de estas se realizará por riguroso orden de petición, según Registro de Entrada del Consell Insular de Formentera. Las peticiones deberán realizarse en la OAC, al OVAC o en la misma oficina del aparcamiento de la plaza de Europa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Podrán solicitar abonos anuales en régimen de plaza fija y/o abonos mensuales en régimen de rotación las personas residentes en el núcleo urbano de Es Pujols, trabajadores y trabajadoras de la zona o personas propietarias de un apartamento o negocio. Debiendo cumplir con los criterios de área de influencia del aparcamiento, criterios detallados en el artículo Anexo I de esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El resto de abonos y el aparcamiento en rotación está disponible para todas las personas usuarias que cumplan los requisitos del presente capítulo V.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Para poder disfrutar de una plaza de aparcamiento en las modalidades a, b, c o d las personas usuarias deberán acreditar el cumplimiento de los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Ser titular de un vehículo-turismo en régimen de propiedad, renting o leasing o que la persona titular de éste sea una empresa y la persona usuaria fija y permanente lo tenga asignado para el desempeño de su trabajo. A efectos de esta Ordenanza, se entiende por turismos, con carácter general, los vehículos a los que se refiere el artículo 9.2.a) de la Ordenanza municipal reguladora del impuesto sobre vehículos de tracción mecánica, que recoge la Orden de 16 de julio de 1984 por la que se aprueba la clasificación de vehículos y sus definiciones a efectos estadísticos, así como las normas sobre la fijación de las claves numéricas; así como, las furgonetas o vehículos turismos adaptados a transporte mixto de personas y cosas que no superen los 525 kilogramos de carga útil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Estar al día en el pago del Impuesto sobre Vehículos de Tracción Mecánica abonado en el ejercicio correspondiente al Consell Insular de Formentera, o a cualquier otro Ayuntamiento cuando se trate del año correspondiente a la transmisión del vehículo, y así lo acredite debidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. El Consell Insular de Formentera podrá comprobar de oficio el cumplimiento de cualquiera de las circunstancias y requisitos establecidos para poder disfrutar de las plazas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6. Queda absolutamente prohibida la cesión de plazas fijas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 12&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Solicitudes y documentación a aportar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- El Consell Insular de Formentera dará publicidad de las condiciones para acceder al uso de las plazas según las diversas tipologías y de la fecha a partir de la cual se pueden presentar las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Documentación a aportar por las personas físicas que quieran solicitar un abono:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Volante de empadronamiento que acredite que el solicitante tenga su domicilio habitual dentro del área de influencia, si es necesario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Copia del recibo del Impuesto sobre Vehículos de Tracción Mecánica abonado en Formentera en el correspondiente ejercicio o cualquier otro Ayuntamiento cuando se trate del año correspondiente a la transmisión del vehículo, y así lo acredite debidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c.- Copia del permiso de circulación del vehículo-turismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Documentación a aportar por las personas jurídicas que quieran solicitar un abono:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- Licencia municipal de apertura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b.- Alta de IAE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c.- Copia del recibo del Impuesto sobre vehículos de tracción mecánica abonado en Formentera en el correspondiente ejercicio o cualquier otro Ayuntamiento cuando se trate del año correspondiente a la transmisión del vehículo, y así lo acredite debidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Documentación a aportar en los casos de solicitud de plazas para personas con discapacidad o movilidad reducida y la bonificación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a.- En el supuesto en que se opte a una plaza para personas con discapacidad o movilidad reducida, o para personas con discapacidades o personas con movilidad reducida a su cargo, además de la documentación que corresponda, según lo indicado en los apartados anteriores, deberán aportar un certificado acreditativo del grado de discapacidad reconocido y movilidad reducida, de conformidad con lo establecido en el Anexo 3 del Real decreto 1971/1999, de 23 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En estos supuestos no será necesario cumplir el requisito de estar en posesión del permiso de conducción en vigor, cuando precisen la ayuda de otra persona para conducir el vehículo, y así lo acrediten debidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 13&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Procedimiento para la adjudicación de las plazas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Con la entrada en vigor de la presente Ordenanza comenzará el periodo de solicitud para los diferentes tipos de abonos. Las personas usuarias podrán solicitar ser abonados del aparcamiento en las diferentes modalidades en función de la disponibilidad de plazas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Dado que el número de plazas fijas es limitado la adjudicación de las mismas se realizará por riguroso orden de petición, según registro de entrada del Consell Insular de Formentera. Las peticiones deberán realizarse en la OAC, al OVAC o en la oficina del aparcamiento de la plaza de Europa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. En cuanto a las plazas en modalidad fija para empresas, cada empresa (persona física o jurídica) podrá solicitar un máximo de 10 plazas de aparcamiento. En caso de haber plazas vacantes estas se distribuirán equitativamente entre las empresas que hayan solicitado plazas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. En cuanto a las plazas en modalidad fija para residentes, cada persona (personas físicas) podrá solicitar un máximo de 2 plazas de aparcamiento por vivienda. En caso de haber plazas vacantes éstas se podrán distribuir de forma equitativa entre las personas que hayan solicitado plazas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. En cuanto a las plazas destinadas en modalidad rotatoria por abono semanal, cada residente o turista del núcleo urbano de Es Pujols, tanto persona física como jurídica, según área de influencia, podrá solicitar un máximo de 1 plaza de aparcamiento por vivienda o empresa en régimen mensual y no tendrán plaza fija reservada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Capítulo VI&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;Requisitos para acceder a las bonificaciones y documentación a aportar&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 14&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Solicitudes y documentación a aportar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Las solicitudes para acceder a las bonificaciones se realizarán en el Registro de Entrada del Consell Insular de Formentera. Las peticiones deberán realizarse en la OAC, al OVAC o en la misma oficina del aparcamiento de la plaza de Europa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. La documentación a aportar para acceder a las bonificaciones será:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a. Para personas con discapacidad o movilidad reducida, o para personas con discapacidades o personas con movilidad reducida a su cargo deberán aportar copia del permiso de circulación del vehículo-turismo y un certificado acreditativo del grado de discapacidad reconocido y movilidad reducida, de conformidad con lo establecido en el Anexo 3 del Real decreto 1971/1999, de 23 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b. En el caso de vehículos eléctricos deberán aportar copia del permiso de circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c. En el caso de vehículos híbridos deberán aportar copia del permiso de circulación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición adicional primera&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Delegación del Pleno del Consell Insular en la Comisión de Gobierno&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Según lo establecido en el artículo 47 de la Ley 2/2004, de 5 de marzo, del Texto refundido de la Ley Reguladora de Haciendas Locales, y según lo establecido en el artículo 23.2.b) de la Ley 7/1985, de 2 de abril, Reguladora de las bases de régimen local, el Pleno del Consell Insular de Formentera delega en la Comisión de Gobierno la modificación de los precios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición adicional segunda&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Derecho supletorio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo lo que no esté previsto en esta Ordenanza, se estará a lo que dispongan las demás normas y ordenanzas de Consell Insular de Formentera, así como, si la hubiera, la correspondiente documentación administrativa y de régimen local, la Ley sobre tráfico y seguridad vial, Código de Circulación y demás normas que resulten de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición transitòria&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Abonos en vigor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los abonos en vigor cuando esta ordenanza sea aprobada tendrán validez hasta su fecha de extinción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición derogatòria&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Quedan derogadas todas las normas que contradigan esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición Final&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Entrada en vigor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presente Ordenanza, una vez aprobada definitivamente, entrará en vigor al día siguiente de su publicación en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra este acuerdo se puede interponer recurso contencioso administrativo ante la Sala de este orden del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses desde el día siguiente de la publicación de este anuncio, todo de conformidad con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, de la jurisdicción contencioso administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;También se puede ejercer cualquier otra acción que se considere pertinente en Derecho.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
