614442 2018-10-11 34402 2018-10-09 2018-10-11 CAIB es 30 ![CDATA[Aprobación precio público actividades culturales y artísticas]] text/html CAIB CAIB 34400 10481 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Por acuerdo de la Junta de Gobierno de 05-10-2018, se aprueba por unanimidad, el precio público por la asistencia a proyecciones de sesiones cinematográficas, representaciones teatrales, conciertos musicales, Actividades culturales y artísticas y otros servicios complementarios, y que se hace público para el general conocimiento el siguiente texto:</span></span></p> <p></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>"PRECIO PÚBLICO POR LA ASISTENCIA A PROYECCIONES DE SESIONES CINEMATOGRÁFICAS, REPRESENTACIONES TEATRALES, CONCIERTOS MUSICALES, ACTIVIDADES CULTURALES Y ARTÍSTICAS Y OTROS SERVICIOS COMPLEMENTARIOS</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 1. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Fundamento y Objeto</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Esta Entidad Local, en uso de las facultades contenidas en los artículos 133.2 y 142 de la Constitución, por el artículo 106 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y de conformidad con los artículos 41 a 47 y 127 del texto refundido de la Ley Reguladora de las Haciendas Locales aprobado por Real decreto Legislativo 2/2004, de 5 de marzo, establece el presente precio público PARA LA ASISTENCIA A PROYECCIONES DE SESIONES CINEMATOGRÁFICAS, REPRESENTACIONES TEATRALES, CONCIERTOS MUSICALES, ACTIVIDADES CULTURALES Y ARTÍSTICAS Y OTROS SERVICIOS COMPLEMENTARIOS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 2. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Hecho Imponible</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">El hecho imponible está constituido para el acceso a recintos abiertos o cerrados, con motivo de la realización de actividades culturales y artísticas municipales. También se incluyen como servicios complementarios el servicio de bar asociado a una actividad cultural, principalmente conciertos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 3. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Obligados al Pago</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Están obligados al pago del precio público regulado en esta Ordenanza, quienes se beneficien de los servicios o actividades prestados o realizados por el Ayuntamiento de Lloseta a que se refiere el artículo segundo de esta Ordenanza, y en particular las personas que soliciten la correspondiente entrada a las instalaciones o recintos donde se preste la actividad.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 4. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Responsables</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Responderán de la deuda tributaria los deudores principales junto a otras personas o Entidades. A estos efectos se considerarán deudores principales los obligados tributarios del apartado 2 del artículo 35 de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Salvo precepto legal expreso en contrario, la responsabilidad será siempre subsidiaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a que se refieren los artículos 42 de la Ley 58/2003 de 17 de diciembre, General Tributaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">En relación con la responsabilidad solidaria y subsidiaria de la deuda tributaria, se estará a lo establecido en los artículos 42 y 43, respectivamente, de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Devengo</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">La obligación de pagar el precio público nace desde la solicitud de las correspondientes entradas a los recintos donde se realicen dichas actividades.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 7. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Normas de Gestión</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">El pago del precio público se exigirá en régimen de autoliquidación y se hará efectivo en metálico, al momento del acceso a los locales donde se efectúe la representación o la actividad, o bien previa adquisición de la entrada con anterioridad en las dependencias municipales o en las entidades colaboradoras.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">Cuando por causas no imputables al obligado el servicio no se preste, procederá la devolución del importe correspondiente, conforme a lo establecido en el artículo 26.3 del texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%"><strong>ARTÍCULO 8. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span>Legislación Aplicable</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:107%">En todo lo no previsto en la presente Ordenanza se estará a lo dispuesto en el texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto 2/2004, de 5 de marzo, la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, la Ley 58/2003, de 17 de diciembre, General Tributaria, la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos, así como en la Ordenanza fiscal General aprobada por este Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
