font-size:12px"><span style="color:#000000">Por Acuerdo del Pleno de fecha 28 de marzo de 2018, se aprobó definitivamente el Estudio de Detalle </span><span style="color:#000000">de un solar urbano resultante de la agrupación de las parcelas 29A, 31 y 31A y de 9.692,62 m² de superficie, situado en la carretera a cala Gració, siendo el objeto del estudio de detalle la reordenación de volúmenes, </span><span style="color:#000000">lo que se publica a los efectos a los efectos de lo establecido en el artículo 64.1 de la Ley 2/2014, de 25 de marzo, de ordenación y uso del suelo.</span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>« </em><span style="color:#000000">En relación con el expediente relativo a la aprobación de un estudio de detalle de un solar urbano resultante de la agrupación de las parcelas 29A, 31 y 31A y de 9.692,62 m² de superficie, situado en la carretera a cala Gració, siendo el objeto del estudio de detalle la reordenación de volúmenes, emito el siguiente informe-propuesta, de conformidad con lo establecido en el artículo 175 del Real Decreto 2568/1986, de 28 de noviembre, por el que se aprueba el Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales, en base a los siguientes</span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>ANTECEDENTES DE HECHO</strong></span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000"><strong>PRIMERO.-</strong></span><span style="color:#000000"> Con fecha 27 de diciembre de 2017, por acuerdo de la Junta de Gobierno Local, se aprobó inicialmente el estudio de detalle de un solar urbano resultante de la agrupación de las parcelas 29A, 31 y 31A y de 9.692,62 m² de superficie, situado en la carretera a cala Gració, siendo el objeto del estudio de detalle la reordenación de volúmenes.</span></span></span></span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>SEGUNDO.-</strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> El expediente se sometió a información pública por un período de 45 días hábiles mediante anuncio publicado en el Boletín Oficial de las Illes Balears n.º 9 de fecha 18 de enero de 2018, así como en la sede electrónica del Ayuntamiento y publicado en el diario de Ibiza de fecha 23 de enero de 2018.</span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>TERCERO.-</strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> Con fecha 29 de diciembre de 2017, se notificó el inicio del período de información pública a las personas propietarias de los terrenos comprendidos en el ámbito al que afecta el estudio de detalle.</span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>CUARTO.- </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">En fecha 26 de febrero de 2018, con registro de entrada 1624, se recibe informe de la Demarcación de Costas en Illes Balears, por el que se informa favorablemente el proyecto.</span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"><strong>QUINTO.- </strong></span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">En fecha 26 de marzo de 2018 se emite certificado conforme al cual durante el período de información pública no se han incorporado alegaciones al expediente administrativo.</span></p> <p style="margin-bottom:0cm"><strong>LEGISLACIÓN APLICABLE</strong></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">— Los artículos 34.2, 46 y 49 y siguientes de la Ley 2/2014, de 25 de marzo, de ordenación y uso del suelo.</span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">— Los artículos 65, 66 y 140 del Real Decreto 2159/1978, de 23 de junio, por el que se aprueba el Reglamento de planeamiento para el desarrollo y aplicación de la Ley sobre régimen de suelo y ordenación urbana. </span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">— </span><span style="color:#000000">Los artículos 21.1.j) y 22.2.c) de la Ley 7/1985, de 2 de abril, Reguladora de las bases del régimen local.</span></span></span></span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Visto cuanto antecede, se considera que el expediente ha seguido la tramitación establecida en la legislación aplicable, procediendo su aprobación definitiva por el Pleno de este Ayuntamiento, de conformidad con lo previsto en el artículo 22.2.c) de la Ley 7/1985, de 2 de abril, Reguladora de las bases del régimen local.</span></p> <p style="margin-bottom:0cm"><span style="color:#000000; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>ACUERDO</strong></span></span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Primero.</strong> Aprobar definitivamente el estudio de detalle de un solar urbano resultante de la agrupacion de las parcelas 29A, 31 y 31A y de 9.692,62 m² de superficie, situado en la carretera a cala Gració, siendo el objeto del estudio de detalle la reordenación de volúmenes.</span></span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Segundo.</strong> Publicar<span style="color:#000080"><u> </u></span>el presente Acuerdo junto con las ordenanzas o normas urbanísticas contenidas en el estudio de detalle, en el Boletín Oficial de las Islas Baleares, a los efectos de lo establecido en el artículo 64.1 de la Ley 2/2014, de 25 de marzo, de ordenación y uso del suelo.</span></span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Tercero.</strong> <span style="color:#000000">Notificar el presente Acuerdo a los propietarios y demás interesados directamente afectados por el estudio de detalle.</span></span></span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Cuarto.</strong> Remitir un ejemplar diligenciado del estudio de detalle al Archivo de Urbanismo de las Illes Balears y al Consejo Insular.”</span></span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-family:&quot;Times New Roman&quot;,Times,serif">La figura del estudio de detalle está prevista a la legislación general a el apartado 2 del artículo 40 del Real Decreto 1346/1976, del 9 de abril, por el cual se aprueba el Texto Refundido de la Ley sobre Régimen del suelo y Ordenación urbana y en el artículo 66 del Real Decreto 2159/1978, de 23 de junio, por el cual se aprueba el Reglamento de planeamiento para el desarrollo y aplicación de la Ley sobre régimen de suelo y Ordenación urbana.</span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Según el artículo 66 mencionado se aporta la documentación prevista y se incorpora la presente memoria justificando las soluciones adoptadas.</span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La presente reordenación de volúmenes para dar cumplimiento a los objetivos y para las motivaciones expuestas en este documento supone un incremento del volumen máximo por edificio.</span></span></p> <p style="margin-bottom:0.21cm"><span style="font-family:Times New Roman,Times,serif;
