    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;OBJETO&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El artículo 25 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, establece que el municipio, para la gestión de sus intereses y en el ámbito de sus competencias, puede promover toda clase de actividades y prestar todos aquellos servicios públicos que contribuyan a satisfacer las necesidades y aspiraciones de la comunidad vecinal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el municipio de Calvià existe demanda por parte de diferentes colectivos de compartir espacios municipales para desarrollar en ellos la actividad de cultivo de la tierra, con el fin de cubrir la necesidad de invertir su tiempo de ocio de forma eco-sostenible. Además de producir alimentos para el consumo propio tienen una finalidad social, integradora, educativa, de ocio, ambiental y participativa. con el fin de crear espacios de participación ciudadana que contribuyan a la mejora de la calidad de vida de las personas, la integración social y el fomento de la colaboración de los ciudadanos en las actividades de mejora ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Con el fin de satisfacer esta demanda este Reglamento establece el procedimiento para ofrecer a los ciudadanos del municipio el uso de bienes de dominio público municipal, y en concreto de pequeñas parcelas de cultivo y de espacios con mesas de cultivo situadas dentro de un entorno urbano, gestionadas según los principios de la agricultura ecológica, así como las normas que deben regir el uso de estos espacios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Igualmente, se establece la posibilidad de entablar colaboraciones con entidades sin ánimo de lucro para la implantación de huertos urbanos, su mantenimiento y la dinamización de los espacios. Las normas contenidas en el presente reglamento, no serán de aplicación a las entidades sin ánimo de lucro, las cuales se regirán por lo establecido en el convenio de cesión de uso suscrito entre estas y el Ayuntamiento de Calvià .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;DETERMINACIÓN DE LOS HUERTOS URBANOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Ayuntamiento de Calvià determinará el número, ubicación y características de los huertos urbanos ubicados en parcelas municipales que se destinen a este uso, mediante acuerdo plenario, pudiendo delegar en otro órgano el resto de trámites para su adjudicación y gestión, según el procedimiento previsto en este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Así, se propone destinar el 30% de los huertos a personas jubiladas, un 30% a personas paradas de larga duración, un 20% a entidades sin ánimo de lucro, un 18% en la población en general y un 2% reservado a la ayuntamiento de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Para las entidades sin ánimo de lucro, se establece una prioridad en el siguiente orden según el objeto: social, cultural y deportivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las parcelas reservadas al Ayuntamiento no serán objeto de adjudicación, sin perjuicio de que el Ayuntamiento, pueda decidir en cualquier momento que parte de dichas parcelas de cultivo inicialmente reservadas al Ayuntamiento incrementen el número de parcelas las de cultivo a adjudicar a las personas físicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;BENEFICIARIOS Y REQUISITOS DE ESTOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cuanto a los requisitos de los beneficiarios se debe distinguir entre los de las personas físicas y los de las asociaciones o entidades sin ánimo de lucro antes mencionados:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A) Requisitos de las personas físicas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Para las personas jubiladas y parados de larga duración, deberán acreditar esta condición antes de la fecha de finalización del plazo de presentación de la solicitud de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Estar empadronado o empadronada en el municipio de Calvià con un mínimo de 1 año de antigüedad antes de la fecha de finalización del plazo de presentación de la solicitud de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. No estar empadronado con alguien a quien ya se haya adjudicado el uso de parte de un huerto aunque pertenezca a una unidad familiar independiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. No haber sido privado con carácter firme, por causa que se le pueda imputar, del uso privativo de parte de un huerto de la Red de Huertos Urbanos de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. No disponer, como mínimo desde la fecha de finalización del plazo de presentación de la solicitud de adjudicación, del uso de ningún otro huerto, municipal en el municipio de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Formular declaración expresa, en el escrito de formalización de la licencia, que uno se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias y de la Seguridad Social; todo ello a nivel estatal, autonómico y local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;B) Requisitos de las asociaciones o entidades sin ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Estar inscrito en el Registro del Ayuntamiento de Calvià como mínimo con un año de antigüedad antes de la fecha de finalización del plazo de presentación de la solicitud de adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. No haber sido privada con carácter firme, por causa imputable a la entidad, del uso privativo de parte de un huerto de la Red de Huertos Urbanos del Ayuntamiento de Calvià&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. No disponer, como mínimo desde la finalización del plazo de presentación de la solicitud de adjudicación, del uso de ningún otro huerto municipal en el municipio de Calvià&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Formular declaración expresa, en el escrito de formalización de la licencia, que se encuentran al corriente en cuanto al cumplimiento de las obligaciones tributarias y de la Seguridad Social; todo ello a nivel estatal, autonómico y local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dichos requisitos deberán mantenerse durante la vigencia de la licencia que, en su caso, se otorgue.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;NATURALEZA JURÍDICA DE LA ADJUDICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La adjudicación definitiva, mediante licencia, del uso privativo de dominio público sobre las parcelas de cultivo y de los espacios del huerto urbano no supone la transmisión del dominio de la parcela o espacio con mesas de cultivo cedidos, que seguirán siendo propiedad del Ayuntamiento de Calvià, respecto tanto del terreno como de todas las instalaciones existentes en el momento de la adjudicación y de las que los diferentes usuarios puedan realizar con la autorización previa y expresa del Ayuntamiento, las cuales quedarán unidas de forma permanente en la parcela.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El adjudicatario sólo tendrá la posesión precaria de la parcela de cultivo o espacio con bloque de mesas de cultivo que se le asigne, y de la caseta que se le pueda asignar, según libre decisión y a criterio municipal, para depositar ahí herramientas, semillas y otros elementos destinados al cultivo; todo ello en los términos previstos en el presente reglamento y raíz de la licencia de uso privado de dominio público que finalmente se otorgue de acuerdo con la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dicho uso privativo tendrá carácter personalísimo y en ningún caso los titulares podrán ceder, enajenar, gravar o disponer, a título oneroso o gratuito, los derechos que se deriven de la autorización de uso, ni transmitirla a terceros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En consecuencia, no podrá ser destinado a otros fines, quedando expresamente prohibido:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Instalar barracas, cubiertas, porches y edificaciones de cualquier tipo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Plantar árboles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Instalar invernaderos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Limitar el huerto con muros, carrizos, maderas, plásticos, uralitas, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Utilizar el huerto como depósito o almacén de materiales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Instalar gallineros y / o jaulas para la crianza de aves, conejos o de cualquier otro animal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Introducir animales en el recinto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;h) Construir pozos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;i) Sobrepasar los límites marcados de cada uno de los huertos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;j) Regar con aspersores o con cualquier otro utensilio que pueda invadir o regar&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;otros huertos vecinos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;k) Cultivar la tierra con criterios diferentes a los de la agricultura ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;l) Cualquier otro uso que, no habiendo sido previsto anteriormente, produzca&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;molestias, malos olores, limite el uso y satisfacción del resto de huertos o afecte al entorno del lugar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;m) Comerciar con los productos obtenidos o destinarlos a actividades con ánimo de lucro o que generen una contraprestación económica a la persona adjudicataria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;n) Cultivar especies no aptas para el consumo humano, plantas degradantes del suelo, o plantas psicotrópicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;o) Dejar el huerto sin trabajar. En caso de imposibilidad temporal, que no se podrá alargar más de tres meses, el usuario deberá comunicar de forma motivada esta circunstancia al Servicio de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Ayuntamiento de Calvià podrá prohibir el uso de productos que puedan ser entendidos como tóxicos y aconsejar a las personas adjudicatarias la mejor manera de cultivar siguiendo los criterios ecológicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;DERECHOS DE LOS ADJUDICATARIOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Constituyen derechos de los adjudicatarios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Cultivar en la parcela de cultivo o mesas de cultivo adjudicadas cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en el presente reglamento por el tiempo establecido en la licencia de uso, siempre que su cultivo o su lícito comercio no haya sido prohibido por alguna disposición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Utilizar la caseta que se pueda asignar para depositar herramientas, semillas y otros elementos que puedan aportar destinados al cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Disponer del asesoramiento del Servicio de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Los demás que se deriven del contenido de este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;OBLIGACIONES DE LOS ADJUDICATARIOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los adjudicatarios estarán obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Cultivar cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en el presente reglamente siempre que no sean especies prohibidas por alguna disposición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Aportar las semillas, los abonos y otros elementos que utilicen para el cultivo, y asumir los gastos de su adquisición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Asumir los gastos generados por la conservación y el mantenimiento ordinarios de la tierra.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Avisar inmediatamente el Ayuntamiento de Calvià si detectan cualquier daño o desperfecto en la parcela, espacio, mesa, caseta o sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Las obras y las reparaciones de renovación o reposición en la parte exterior de la parcela (continente), espacio, mesa o caseta o en sus elementos, debidas al envejecimiento u otras causas en las que no se de daño o negligencia del adjudicatario serán a cargo del Ayuntamiento de Calvià. De lo contrario a cargo del adjudicatario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Mantener limpios y en perfecto estado de conservación las herramientas y los útiles necesarios para el cultivo que sean propiedad del Ayuntamiento y que éste pueda poner a su disposición si lo considera adecuado. El Ayuntamiento podrá requerir que compensen su desperfecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Permitir las visitas a su parcela o espacio de niños de las escuelas o de otros colectivos autorizados por el Servicio de Medio Ambiente con el fin de conocer así o mediante un taller, y de forma práctica, lo que han aprendido en sus planes de estudio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;h) Mantener el entorno de sus parcelas y espacios con mesas de cultivo en perfecto estado, limpio y libre de todo tipo de hierbas y plantas espontáneas. También deberán hacerse cargo de gestionar adecuadamente los residuos que se produzcan, separando las de origen orgánico del resto y depositando cada tipo de residuo en el contenedor específico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Cumplir las ordenanzas municipales y demás normativa local, autonómica o estatal que pueda afectar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;j) Responder de los daños de todo tipo, robos o actos vandálicos que puedan afectar el interior de las parcelas, los espacios o las casetas asignadas, y de cualquier responsabilidad en caso de accidente personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;k) Hacerse cargo de las indemnizaciones económicas y las reparaciones que se generen derivadas de los daños causados en el huerto municipal y en sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;m) Facilitar la entrada a los huertos a los escolares y otros colectivos autorizados por el Servicio de Medio Ambiente que bajo la dirección de monitores, quieran conocer los trabajos agrícolas o las producciones que se hacen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;n) Facilitar la entrada puntual a los huertos de los empleados municipales del Servicio de Medio Ambiente y de los autorizados al efecto, y colaborar en la resolución de todas las cuestiones que se planteen, para lo cual podrán recibir el asesoramiento de dicho Servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;o) Las demás que se deriven del presente reglamento de las instrucciones dadas por el Servicio de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;p) Las asociaciones que trabajan con personas con proceso de reinserción social tendrán la obligación de fichar un horario semanal para prestar su ayuda al resto de los usuarios en las operaciones que requieran un mayor esfuerzo físico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;HORARIO Y ACCESO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- El horario en que se podrá acceder a los huertos urbanos será el que autorice el Ayuntamiento de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- El acceso a los huertos queda restringido al personal municipal autorizado, a las personas adjudicatarias de estos y al que los suplan en caso de imposibilidad temporal, conforme a lo establecido en el apartado siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.- En caso de imposibilidad temporal y justificada de la persona adjudicataria para llevar a cabo las tareas de cuidado y mantenimiento del huerto, ésta podrá&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;autorizar a otra persona para llevar a cabo estas por el tiempo imprescindible hasta que se solvente la imposibilidad de realizarlas por sí misma. El Ayuntamiento emitirá una autorización provisional de acceso a la persona designada por el adjudicatario o adjudicataria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;DURACIÓN DE LAS LICENCIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El uso privativo del huerto se establece por un tiempo limitado e improrrogable de cuatro años, a contar desde la fecha de notificación de la adjudicación, siempre que no concurra causa de resolución o que los terrenos no sean necesarios para obras, servicios o instalaciones municipales. Se entregarán por un periodo de un año, prorrogable tres años más de manera automática.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;CADUCIDAD Y REVOCACIÓN DE LA LICENCIA. EFECTOS DE LA EXTINCIÓN DE LA AUTORIZACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;CADUCIDAD DE LA LICENCIA:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En concreto, la licencia de uso privado caducará por los siguientes motivos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Por vencimiento del plazo final.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Por renuncia del titular antes del vencimiento de dicho plazo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Por muerte o incapacidad sobrevenida del adjudicatario, antes del vencimiento del plazo final.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Por voluntad unilateral del Ayuntamiento de no prorrogar la licencia o licencias, debidamente motivada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;REVOCACIÓN DE LA LICENCIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La licencia de uso privativo podrá ser revocada por los siguientes motivos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Por pérdida de las condiciones de acceso para ser beneficiario de una licencia de uso privativo objeto del presente reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Por haber cesado en el cultivo de la parcela o mesa de cultivo adjudicada durante más de tres meses sin que haya una comunicación expresa y motivada en el Ayuntamiento de Calvià y éste lo acepte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Por la necesidad de disponer de las parcelas para obras, servicios o instalaciones de la Administración o para el desarrollo de las actuaciones previstas en el Plan General o de otros instrumentos urbanísticos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Por incumplimiento de las instrucciones dadas por el Servicio de Medio Ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Por razones de interés público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Para la constatación de que no se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias y de la Seguridad Social; todo ello a nivel estatal, autonómico y local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. Por incumplimiento manifiesto del resto de cláusulas contenidas en el presente reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Y, en general, para todos los supuestos previstos en el bloque normativo de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;EFECTOS DE LA EXTINCIÓN DE LA AUTORIZACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dentro de los 15 días hábiles siguientes a la fecha de recepción de la notificación de la extinción de la licencia municipal, el usuario deberá dejar el huerto municipal vacío y a plena disposición del Ayuntamiento de Calvià. En caso contrario, el Ayuntamiento podrá ejecutar los acuerdos mediante el lanzamiento administrativo una vez transcurrido este plazo. Las obras y las plantaciones que tengan el concepto de mejora efectuada por el usuario y que no puedan ser retirados sin daño al terreno municipal quedarán de propiedad del Ayuntamiento sin que ello genere un derecho a indemnización. Respecto de las cosechas, al extinguirse la licencia de uso privado quedarán a disposición del Servicio de Bienestar Social si el adjudicatario o familiares autorizados por éste no las han recolectado en el plazo de los 15 días hábiles antes mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los usuarios no tendrán derecho a ningún tipo de indemnización por pérdida de cosechas, por mejoras de la parcela o por otras incidencias que se deriven de la extinción o resolución de la licencia de uso privativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;OTRAS PRERROGATIVAS MUNICIPALES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Ayuntamiento podrá, sin generar ningún derecho de indemnización a favor del interesado o adjudicatario, concretar y modificar las condiciones generales de uso de las parcelas o espacios, mesas y otros elementos que se puedan asignar, y modificar sus límites, los trazados de los caminos, las instalaciones de riego y otros servicios de la zona. El adjudicatario podrá solicitar a raíz de las mencionadas actuaciones, que se le deberán comunicar, que se revoque la licencia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Corresponderá también al Ayuntamiento interpretar el contenido del presente reglamento y resolver las dudas o lagunas, sin perjuicio del resto de prerrogativas amparadas por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;SEGUIMIENTO Y CONTROL DE LAS LICENCIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Ayuntamiento de Calvià hará el seguimiento y el control de las licencias de uso privativo que otorguen mediante el Servicio de Medio Ambiente, que asesorará y dará, en su caso, instrucciones de obligado cumplimiento a los adjudicatarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;SISTEMA DE ADJUDICACIÓN DE LOS HUERTOS URBANOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- El Ayuntamiento de Calvià pondrá a disposición los huertos urbanos que se ofrezcan mediante convocatoria pública para formar parte de la lista de personas y entidades interesadas en su adjudicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- La convocatoria pública detallará la identificación de los huertos urbanos que ofrezcan, los requisitos de los solicitantes, el plazo en que deberán presentar las solicitudes y la documentación que se deberá aportar junto con la solicitud para acreditar el cumplimiento de los requisitos contenidos en el presente Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.- Una vez publicada la convocatoria se abrirá un periodo de presentación de solicitudes de adjudicación de huertos urbanos no inferior a 20 días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.- Una vez comprobadas las solicitudes, y en caso de detectar deficiencias subsanables en estas, se abrirá un plazo de 10 días hábiles para su enmienda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.- Finalizado el proceso de presentación de solicitudes y de subsanación de deficiencias el Ayuntamiento elaborará la lista provisional de solicitantes admitidos y excluidos que publicará, abriéndose un periodo de 15 días para la presentación de alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.- Transcurrido el plazo de alegaciones y resueltas éstas, el Ayuntamiento&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;publicará la lista definitiva de solicitantes admitidos y excluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.- La elección de huertos urbanos para las personas y entidades admitidas se realizará por orden alfabético del primer apellido, comenzando por la letra que aleatoriamente resulte en sorteo realizado por el Ayuntamiento de Calvià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8.- Finalizado el proceso de adjudicación de huertos urbanos, si quedara alguno de ellos sin adjudicar, se abrirá un plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.- Si el número de solicitudes admitidas es superior al número de huertos ofertados, las personas y entidades admitidas que no alcancen la adjudicación de un huerto pasarán a formar parte de la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11.- Cuando por cualquier causa se produzca una baja adjudicará el huerto para orden de la lista de espera. En primer lugar, las personas y entidades interesadas de la primera adjudicación que habían quedado afuera y por orden del sorteo. Después, los interesados que con posterioridad hayan solicitado un huerto, y por orden cronológico de presentación de la instancia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12.- Antes de la adjudicación, la persona y la entidad interesada deberá manifestar que acepta y se obliga a cumplir las determinaciones del presente reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.- Cuando el Ayuntamiento acuerde destinar nuevas parcelas a este fin, ya sea por ampliación del espacio existente o por un nuevo emplazamiento, deberá hacer uso de la lista de espera vigente. No obstante, en caso de que la lista de espera agote, el Ayuntamiento iniciará un nuevo procedimiento de adjudicación mediante nueva convocatoria pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
