CAIB 9660 ![CDATA[<p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos y fundamentos de derecho </strong></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 8 de marzo de 2018 (BOIB n.º 34/2018, de 17 de marzo) se convocó un concurso de traslados voluntarios para proveer plazas básicas vacantes de diversas categorías de personal estatutario del Servicio de Salud de las Islas Baleares.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con la base 5.1 de la convocatoria, el 1 de mayo de 2018 se publicó en el BOIB n.º 53/2018 la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se aprueban las listas provisionales de aspirantes admitidos y excluidos en el concurso de traslado voluntario en cuestión.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con la base 6.3 de la convocatoria, el 26 de junio de 2018 se publicó en el BOIB n.º 78/2018 la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se resuelve con carácter provisional dicho concurso de traslados.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durante el plazo de 15 días establecido en el punto 2 de la Resolución mencionada en el apartado anterior, la señora Ana Ramallo Alcover presentó alegaciones sobre el cómputo de sus servicios prestados.&nbsp;</span></li> </ol> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello y una vez vencido el plazo para presentar alegaciones de acuerdo con la base 6.5 de la convocatoria, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución </strong></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprobar la resolución definitiva del concurso de traslados voluntario para proveer plazas básicas vacantes de diversas categorías de personal estatutario del Servicio de Salud de las Islas Baleares convocado por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 8 de marzo de 2018 (BOIB n.º 34/2018, de 17 de marzo) y, en consecuencia, adjudicar definitivamente las plazas ofertadas a las personas admitidas en el concurso según las plazas solicitadas y el orden determinado por la puntuación obtenida.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar la lista definitiva de aspirantes admitidos —que se adjunta como anexo 1—, en la que figuran el número del documento de identidad, los apellidos y el nombre, la puntuación obtenida y, en su caso, la plaza adjudicada.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aceptar la alegación presentada por la señora Ana Ramallo Alcover.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la base 6.8 de la convocatoria, las plazas adjudicadas son irrenunciables, a menos que la renuncia esté motivada por la obtención de una plaza en virtud de la resolución de un procedimiento de movilidad voluntaria convocado por otra administración pública, de acuerdo con el artículo 37.4 de la Ley 55/2003, de 16 de diciembre, del estatuto marco del personal estatutario de los servicios de salud.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la base 7.1 de la convocatoria, las personas concursantes que hayan obtenido una plaza deben cesar en la plaza que estén ocupando en el plazo de los tres días hábiles siguientes a la fecha de publicación de esta resolución en el Boletín Oficial de las Islas Baleares.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la base 7.2 de la convocatoria, la toma de posesión de la nueva plaza debe efectuarse en los plazos siguientes: dentro de los tres días hábiles siguientes a la fecha del cese si ambas plazas están ubicadas en el mismo municipio; en quince días hábiles si están ubicadas en municipios diferentes pero en la misma área de salud; en un mes si están ubicadas en un municipio y en una área de salud diferentes o cuando implique un cambio de servicio de salud. De acuerdo con la base 7.4 de la convocatoria, en el caso de que la adjudicación de la plaza implique reingresar en el servicio activo, el plazo para tomar posesión es de un mes a contar desde la fecha de publicación de la resolución definitiva del concurso.&nbsp;</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar esta resolución en el web &lt;www.ibsalut.es&gt; y en el Boletín Oficial de las Islas Baleares.&nbsp;</span></li> </ol> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos </strong></span></p> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución —que agota la vía administrativa— puede interponerse un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente a la fecha de publicación de esta resolución, de acuerdo con los artículos 123 y 124 de la Ley 39/2015,de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif;
