&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Los efectos de los nombramientos en el punto primero, serán del día siguiente a la aprobación del presente decreto (excepto el de la Sra. Teresa Berastain Bilbao, que los efectos serán de día 12/09/2018, en virtud de la resolución de la Concejala del Área de Función Pública y Gobierno Interior número 17.601 de 31/08/2018).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;.Todo ello en base a la legislación aplicable establecida en los art. 80 del Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto básico del empleado público, art. 79 de la Ley 3/2007, de 27 de marzo, de Función Pública de las Islas Baleares, art. 64 del RD 364/95, de 10 de marzo, que aprueba el reglamento general de ingreso del personal al servicio de la administración general del estado y la provisión de los puestos de trabajo y promoción profesional de los funcionarios civiles del estado, así como lo establecido en el Pacto Regulador de las condiciones generales de trabajo y las relaciones laborales del personal funcionario del Ayuntamiento de Palma.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; Declarar desierto el puesto de trabajo F60360002 Chófer Protocolo II, de acuerdo con el informe emitido por los responsables del Área a la que está adscrito el puesto de trabajo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.-&lt;/strong&gt; Notificar el presente decreto a los interesados ​​y publicarlo en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, se puede interponer recurso de reposición ante el mismo órgano que la ha dictado, conforme lo que dispone el artículo 123 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas. El plazo para interponerlo es de un mes contado desde el día siguiente de recibir la presente notificación. En este caso no se podrá interponer recurso contencioso administrativo hasta que se haya resuelto el de reposición.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El recurso de reposición potestativo debe presentarse en el registro general de este Ayuntamiento o en las dependencias a que se refiere el artículo 16.4 de la Ley 39/2015, de 1 de octubre, antes mencionada, y se entenderá desestimado cuando no haya resuelto y notificada la resolución, en el plazo de un mes, contado desde el día siguiente de su interposición. En este caso expedita la vía contencioso administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si no se utiliza el recurso potestativo de reposición, se puede interponer directamente recurso contencioso administrativo, conforme a lo establecido en el artículo citado anteriormente, y los 45 y siguientes de la ley 29/98, de 13 de julio, reguladora de la jurisdicción contenciosa, ante el Juzgado Contencioso Administrativo, en el plazo de dos meses contados desde el día siguiente de recibir la presente notificación. Esto sin perjuicio de cualquier otro recurso o acción que se considere conveniente.&lt;/span&gt;&lt;/p&gt;
