&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Expediente 2048/2018&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En la Muy Leal Ciudad de Felanitx, el alcalde que subscribe, Sr. Jaume Monserrat Vaquer, vengo a dictar la siguiente resolución &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedentes de hecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Mediante Decreto 485/2015 de 29 de junio de 2015, el alcalde, Sr. Joan Xamena Galmés, resolvió, entre otros, las delegaciones que el alcalde puede hacer de sus atribuciones en distintos regidores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Mediante Decreto 656/2018 de 18 de junio de 2018, el alcalde, Sr. Jaume Monserrat Vaquer, resolvió, entre otros, las delegaciones que el alcalde puede hacer de sus atribuciones en distintos regidores. Específicamente, se delegó a favor del Sr. Joan Xamena Galmés, regidor del equipo de gobierno, las competencias de urbanismo y Plan de movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Visto el parte médico de baja del Sr. Xamena con registro de entrada de día 2 de julio de 2018. (núm. 3750/2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Mediante Decreto 716/2018, de 6 de julio de 2018, el alcalde, Sr. Jaume Monserrat Vaquer, delegó a favor del Sr. Pere Mestre Manzanares, la competencia en materia de urbanismo y Plan de movilidad, mientras se mantengan las circunstancias que han dado lugar a la presente delegación.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Visto el parte médico de alta del Sr. Xamena con registro de entrada de día 3 de septiembre de 2018 (núm. 4877/2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;I.- Delegación de competencias.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El artículo 43 y siguientes del RD 2568/1986, de 28 de noviembre, que aprueba el Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales (en adelante ROF) regula el régimen jurídico de las delegaciones que el alcalde puede hacer de sus atribuciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;II.- Eficacia de las delegaciones de atribuciones.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El artículo 44.2 del ROF determina que las delegaciones de atribuciones del alcalde tendrán efectos desde el día siguiente al de la fecha del Decreto, sin perjuicio de su preceptiva publicación en los boletines oficiales pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;III.- Dar cuenta al Pleno.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De acuerdo con los artículos 38 y 44.4 del ROF, de las delegaciones que el alcalde realice se dará cuenta al Pleno en la primera sesión que se celebre con posterioridad a la resolución de delegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En base a los hechos y fundamentos de derecho expuestos, esta Alcaldía, dicta la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;Delegar a favor del Sr. Joan Xamena Galmés (Bloc), regidor del equipo de gobierno, la competencia en materia de urbanismo y Plan de movilidad, según el establecido en el Decreto núm. 656/2018 de 18 de junio de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Notificar la presente resolución a los interesados, y publicarla en el BOIB, sin perjuicio de su efectividad desde mañana, de acuerdo con lo que establece el artículo 44.2 del ROF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;De la presente resolución se dará cuenta al Pleno en la primera sesión que se celebre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
