    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1. Finalidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Inca, con la finalidad de avanzar hacia la consecución de la enseñanza obligatoria gratuita y para contribuir a no privar a ningún niño del municipio de acceder al sistema educativo por motivos económicos, crea esta línea de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;2. Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Constituye el objeto de las presentes bases la regulación de la convocatoria pública para la concesión de subvenciones a las familias de Inca con hijos en edad escolar obligatoria que presenten dificultades económicas para hacer frente al gasto que suponen los libros de texto o material substitutivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se entiende por material sustitutivo el conjunto formado por todos aquellos documentos, fotocopias y otros materiales que sustituyen a los libros de texto. El software educativo tendrá también la consideración de material sustitutivo cuando sea utilizado para este fin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Los libros de texto o material sustitutivo deben corresponder a alumnos matriculados en centros escolares de Inca, en niveles obligatorios de enseñanza y al curso 2018/2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Igualmente con esta convocatoria se pretende fomentar y, al mismo tiempo, facilitar la reutilización de los libros de texto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3. Entidades beneficiarias / destinatarios o beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Pueden ser beneficiarias de estas subvenciones las familias de Inca con hijos en edad escolar obligatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Solicitarán la subvención el padre, la madre o el tutor legal en representación del alumno/a, que cumplan los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Todos los miembros de la unidad familiar deben estar empadronados/as en el municipio de Inca con una antigüedad mínima de un año anterior a la solicitud, con excepción de aquellos alumnos que hayan sido escolarizados de oficio en un centro concertado.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Haber realizado la adquisición de los libros de texto o material sustitutivo dentro del periodo comprendido entre el día 1 de junio de 2018 y el día que finaliza el plazo para la presentación de solicitudes de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar matriculados los alumnos en centros escolares ubicados en el municipio de Inca.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;No ser alumnos repetidores del curso para el cual se solicita la ayuda, con excepción de los casos en que hayan variado los libros de texto o el material sustitutivo.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Comprometerse a reutilizar los libros de texto para los cuales se solicita la ayuda en el caso de que el centro escolar donde estén matriculados, o la AMIPA, cuente con programa de reutilización de libros de texto; de ser así se depositarán en el mismo centro al acabar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Poseer capacidad jurídica y de obrar.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;No haber solicitado y/o recibido subvención del Ayuntamiento de Inca por el mismo concepto.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Haber justificado las subvenciones concedidas en ejercicios anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar al corriente de las obligaciones fiscales con el Ayuntamiento de Inca y no encontrarse sometidos a ningún procedimiento de reintegro de subvenciones públicas o a ningún procedimiento sancionador incoado por este motivo.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;No incurrir en ninguno de los supuestos contemplados en el art. 13.2 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;4. Naturaleza de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las subvenciones de esta convocatoria son de carácter voluntario, excepcional y anulable. Son revocables y reintegrables en cualquier momento por las causas previstas en la ley o en estas bases. No generan ningún derecho a la obtención de otras subvenciones en años posteriores y no se pueden alegar como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Asimismo, son compatibles con otras ayudas o subvenciones que pueda recibir la entidad beneficiaria para el mismo concepto, siempre y cuando el total de las ayudas o subvenciones recibidas no supere el coste del concepto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El hecho de recibir una subvención implica la obligatoriedad de llevar a cabo el concepto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En caso de no cubrirse el total de la cuantía máxima de la subvención, se procederá a reducir al cantidad solicitada proporcionalmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;5. Dotación presupuestaria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para esta finalidad existe crédito adecuado en el Presupuesto General del Ayuntamiento de Inca del ejercicio 2018, en la partida presupuestaria 2018/000/320/48908/01, por un importe de 60.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;6. Solicitud y documentación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las familias interesadas que cumplan los requisitos que determinan estas bases o estén en condiciones de cumplirlas en el plazo de presentación de solicitudes deben presentar la siguiente documentación, estarán exentos de presentar la documentación requerida aquellas personas que la hayan presentado dentro de la convocatoria de Libros de texto del curso 2017-18, en esta misma administración (siempre que se encuentren en vigor).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Anexo 1 – Solicitud de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Fotocopia del DNI de la persona firmante de la solicitud o documento que acredite la representación mediante la cual actúa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Fotocopia o documento que acredite la titularidad del/la solicitante de la cuenta corriente o libreta de ahorros de la entidad financiera objeto de abono de la concesión de la subvención. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Fotocopia del Libro de Familia o certificado de nacimiento, donde se pueda identificar al menor y a sus progenitores.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En caso de hijos discapacitados, fotocopia del documento original oficial acreditativo.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En caso de separación de los padres, es necesario presentar la sentencia judicial y en su caso del convenio regulador.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Certificado/lista oficial del centro educativo que acredite que los alumnos utilizan material escolar lectivo sustitutivo de los libros de texto, detallando en qué consiste el material sustitutivo (número de unidades, títulos o cualquier otra referencia que posibilite identificar el material y su número en la factura y justificante de gasto).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Facturas oficiales de los libros o material sustitutivo adquirido (pagadas o debidamente justificadas). Se tendrá que presentar una factura individual para cada alumno/a. Si la factura responde a conceptos a los cuales correspondan diferentes tipos de IVA, se debe especificar (por ejemplo libros de texto y fotocopias).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. Anexo 2 – Declaración responsable.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Anexo 3 – Relación clasificada de ingresos u otras subvenciones recibidas en su caso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7. Determinación de la unidad familiar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A los efectos de esta convocatoria, se considera que conforman la unidad familiar:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los padres no separados legalmente y, si procede, el tutor o persona encargada de la guarda y protección del menor.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los hijos menores de edad, con excepción de los emancipados.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los hijos mayores de edad con discapacidad psíquica, física o sensorial, o incapacitados judicialmente. &lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los hijos solteros menores de veinticinco años y que convivan en el domicilio familiar a 31 de diciembre del año inmediatamente anterior.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los ascendientes de los padres que justifiquen la residencia en el mismo domicilio que éstos a 31 de diciembre del año inmediatamente anterior.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando no exista vínculo matrimonial, la unidad familiar se entenderá constituida por el padre, la madre y todos los hijos y ascendientes de los padres que convivan y reúnan los requisitos del apartado anterior. En caso de que no exista convivencia se deberá acreditar documentalmente, mediante certificado de convivencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de separación o divorcio, no se considerará miembro computable aquel que no conviva con la persona solicitante de la beca. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La separación o divorcio se acreditará de la siguiente manera:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la separación de hecho se deberá presentar un documento justificando la interposición de demanda u otros documentos que avalen esta situación.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la separación o divorcio es legal, se deberá presentar sentencia judicial o el convenio regulador en el que conste la custodia del menor.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A los efectos de cálculo de la renta computarán por dos los hijos de la unidad familiar con una discapacidad igual o superior al 33 %, situación que se deberá acreditar fehacientemente.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8. Renta familiar&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La renta familiar será el resultado de sumar las rentas de todos los miembros de la unidad familiar computables que hayan generado ingresos. Se calculará atendiendo a la suma de los ingresos familiares provenientes de rendimientos del trabajo, rendimientos del capital mobiliario, rendimientos del capital inmobiliario, ganancias y pérdidas patrimoniales, y actividades económicas de la declaración del IRPF del año 2017.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;9.&lt;/span&gt;&lt;/strong&gt; &lt;strong&gt;&lt;span style="color:black"&gt;Gastos subvencionables e importe&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De acuerdo con lo establecido en el art. 31 de la Ley 38/2003, General de Subvenciones, son gastos subvencionables aquellos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Que son estrictamente necesarios para planificar, preparar, coordinar, difundir y ejecutar el proyecto de actividades que se haya llevado a cabo durante la temporalización prevista en la base 2 y responda a la naturaleza del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Que sean razonables y cumplan los principios de buena gestión financiera y, en especial, de rentabilidad y eficacia de costes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Que no superen el valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;No forman parte de los gastos subvencionables ni del presupuesto del proyecto:&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos cuyo importe se haya adquirido a un precio superior al valor de mercado.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos financieros y los de gestión, los gastos notariales y registrales, los gastos periciales para la realización del proyecto subvencionado y los de administración específicos si no están directamente relacionados, y no son indispensables para prepararlo ni llevarlo a cabo.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los intereses deudores de las cuentas bancarias, los intereses, los recargos y las sanciones administrativas y penalizaciones, y los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los impuestos indirectos, cuando sean susceptibles de recuperación o compensación, ni los impuestos personales sobre la renta.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El material fungible, agendas y otro material que no se considere libros de texto.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En los casos de material sustitutivo de los libros de texto, todo aquel material no incluido en el certificado/listado oficial emitido por el centro educativo. &lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10. Criterios objetivos de otorgamiento de la subvención y cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La concesión de las subvenciones de esta convocatoria se rige por los principios de publicidad, concurrencia, objetividad, igualdad y no discriminación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe máximo de la subvención será de 180 € por alumno/a solicitante.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Para la concesión de las becas o ayudas se aplicará la siguiente fórmula:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;A partir del sexto miembro se aplica un incremento del 50 % del salario mínimo por cada miembro&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las solicitudes que cumplan la fórmula anterior quedarán admitidas a trámite y las que no la cumplan quedarán excluidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En caso de que el importe consignado a la aplicación presupuestaria con cargo a la cual se debe abonar la subvención no sea suficiente para cubrir todas las solicitudes admitidas a trámite, se aplicará la proporción correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En ningún caso el importe de la subvención puede ser de tal cuantía que, aisladamente o en concurrencia con otras subvenciones de cualquier Administración pública o de entes públicos o privados, supere el 100 % del coste total del proyecto de actividades que se ha llevado a cabo por la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Cuando las entidades beneficiarias sean deudoras del Ayuntamiento de Inca, como consecuencia de una deuda vencida, liquidada y exigible, se podrá acordar la compensación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;11. Plazo y lugar de presentación de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El modelo normalizado de la solicitud y el resto de documentos anexos se encuentran a disposición de las personas interesadas en la página web del Ayuntamiento de Inca www.incaciutat.com&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las solicitudes de subvenciones se dirigirán al alcalde del Ayuntamiento de Inca y se deben presentar, junto con la documentación que se especifica en el punto 6 de estas bases, en el Registro General Municipal o por cualquiera de los medios y lugares señalados en el artículo 16 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El plazo de presentación de solicitudes es de quince (15) días hábiles contados a partir del siguiente a la publicación de las bases de esta convocatoria en el Boletín Oficial de las Illes Balears. Finaliza a las 14 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Durante este plazo las bases estarán publicadas en el tablón de anuncios del Ayuntamiento de Inca, así como en su página web www.incaciutat.com&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12. Procedimiento. Órganos competentes para iniciar, instruir y resolver el procedimiento&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El procedimiento de concesión de las subvenciones regulado en las presentes bases será el de concurrencia competitiva.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12.1. Iniciación&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El procedimiento de concesión de subvenciones se iniciará de oficio, mediante la aprobación simultánea por Pleno de las bases y la convocatoria. Una vez aprobadas, éstas serán publicadas en el Boletín Oficial de las Illes Balears (BOIB), en el tablón de anuncios del Ayuntamiento y en la página web www.incaciutat.com &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La convocatoria de estas subvenciones también se publicará en la Base de Datos Nacional de Subvenciones, BDNS, de acuerdo con el art. 20.8.b de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son aplicables a la instrucción y la resolución del procedimiento de concesión de subvenciones en régimen de concurrencia competitiva los artículos del 18 al 22 de la Ordenanza General Reguladora de la Concesión de Subvenciones del Ayuntamiento de Inca (publicada en el BOIB núm. 66 de día 26 de mayo de 2016).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12.2. Instrucción&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La instrucción del procedimiento de concesión de subvenciones corresponderá a la Concejalía de Educación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las actividades de instrucción incluirán:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) La petición de todos los informes que se estimen necesarios para resolver o que sean exigidos por las normas que regulan la subvención. El plazo para su emisión será de diez (10) días hábiles, excepto que por parte del órgano instructor se acuerde otro.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) La evaluación de las solicitudes efectuada conforme a los criterios, formas y prioridades de valoración establecidos en estas bases y convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para estudiar y evaluar las solicitudes se constituye la Comisión de Evaluación encargada de la instrucción del procedimiento, integrada por las personas relacionadas a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Presidente: &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El regidor delegado/a de Alcaldía de Educación o persona en quien delegue.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vocales:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La técnica de Educación o persona en quien delegue.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El/la TAE de Intervención o persona en quien delegue.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Secretaria&lt;/strong&gt;: auxiliar administrativo/iva del departamento de Educación (con voz, pero sin voto).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A la Comisión de Evaluación, le corresponde examinar las solicitudes presentadas, evaluarlas y emitir el informe que tiene que servir de base para elaborar la propuesta de resolución por parte de la Concejalía de Educación, de acuerdo con los criterios de valoración y los requisitos establecidos en estas bases.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cualquier caso, la Comisión de Evaluación puede realizar todas las actuaciones que considere necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de los cuales deba pronunciarse la resolución, y solicitar todos los informes y la documentación que considere pertinentes para resolver.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano instructor, a la vista del expediente y del informe del órgano colegiado, formulará propuesta de resolución provisional, debidamente motivada, y la notificará a las personas interesadas, previo acuerdo del órgano competente; se otorgará un plazo de diez (10) días hábiles para presentar alegaciones. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Examinadas, si procede, las alegaciones presentadas por las personas interesadas, el órgano instructor formulará propuesta de resolución definitiva, que tendrá que expresar el/la solicitante o la relación de solicitantes para los cuales se propone la concesión de la subvención, su cuantía, especificando su evaluación y los criterios de valoración seguidos para efectuarla.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Excepcionalmente, se podrá llevar a cabo el prorrateo, entre las personas solicitantes, del importe global máximo destinado a subvención. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El expediente de concesión de la subvención contendrá el informe del órgano instructor en el cual conste que, de la información que obra en su poder, se desprende que las personas beneficiarias cumplen todos los requisitos necesarios para acceder a las subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La propuesta de resolución definitiva, cuando resulte procedente de acuerdo con lo establecido en estas bases y convocatoria, se publicará en el tablón de anuncios del Ayuntamiento e incluirá la relación de las personas solicitantes que hayan sido propuestas como beneficiarias en la fase de instrucción para que en el plazo de diez (10) días hábiles puedan formular las alegaciones pertinentes; en el caso de que no lo hagan, se entenderá que han aceptado las subvenciones concedidas. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mientras no se haya notificado la resolución de concesión, las propuestas de resolución provisional y definitiva no crean ningún derecho a favor de la persona beneficiaria propuesta ante la Administración.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12.3. Resolución&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aprobada la propuesta de resolución definitiva, el órgano competente resolverá el procedimiento de concesión de forma motivada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolución, además de expresar la persona solicitante o relación de solicitantes a los cuales se concede la subvención, hará constar, de forma expresa, la desestimación del resto de las solicitudes, indicando la persona solicitante o relación de solicitantes a los cuales se desestima la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento no podrá exceder de seis (6) meses, a contar desde la publicación de la correspondiente convocatoria, salvo que esta aplace sus efectos a una fecha posterior. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vencimiento del plazo máximo, sin que se haya notificado la resolución, legitima a las personas interesadas para entender desestimada por silencio administrativo la solicitud de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, se puede interponer recurso potestativo de reposición ante el órgano que la ha dictado en el plazo de un (1) mes contado desde que se haya notificado, o bien se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma en el plazo de dos (2) meses desde que se haya notificado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;13. Obligaciones de las personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son obligaciones de las personas beneficiarias de las subvenciones, de acuerdo con la Ordenanza General Reguladora de la Concesión de Subvenciones del Ayuntamiento de Inca (publicada en el BOIB núm. 66 de día 26 de mayo de 2016), las siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Justificar ante el órgano otorgante el cumplimiento de los requisitos y condiciones, así como la realización de la actividad y el cumplimiento de la finalidad que determinan la concesión de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Someterse a las actuaciones de comprobación, a efectuar por el órgano otorgante, así como a cualquier otra de comprobación y control financiero que puedan realizar los órganos de control competentes, tanto nacionales como comunitarios, con la aportación de toda la información que le sea requerida en el ejercicio de estas actuaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluidos los documentos electrónicos, en la medida en que puedan ser objeto de comprobación y control.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;d) Reintegrar los fondos recibidos en los casos en que proceda por concurrir causa de reintegro.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;e) Asistir a las actividades lectivas de los centros en los cuales se encuentran matriculados.&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;14. Justificación y pago&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son aplicables a la justificación y al cobro del procedimiento de concesión de subvenciones en régimen de concurrencia competitiva, los artículos del 23 al 25 de la Ordenanza general reguladora de la concesión de subvenciones del Ayuntamiento de Inca (publicada en el BOIB núm. 66 de día 26 de mayo de 2016).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Solamente en casos justificados de imposibilidad de presentar originales, se admitirán fotocopias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los gastos se justificarán con facturas originales y otros documentos de valor provatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa, en original. En caso que se tengan que devolver las facturas o justificantes originales, a petición de la persona beneficiaria, se reflejará con un sello la fecha de concesión de la subvención, así como el importe del justificante que se imputa a la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las facturas originales, acreditativas del gasto subvencionado, expedidas a nombre de las personas subvencionadas y con su NIF, tienen que expresar claramente:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fecha de emisión, que debe corresponder al periodo de actividades subvencionables.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Datos fiscales (nombre, domicilio, NIF, etc.) de la entidad emisora y de la entidad pagadora.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Número de la factura.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las facturas deberán estar pagadas y debidamente justificadas (sello, justificante bancario…). &lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las facturas deben estar datadas durante el año escolar en curso. &lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tienen que hacer referencia a los libros de texto del curso 2018-2019. &lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Concepto detallado por el cual se expide, que deberá ser suficientemente claro.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Importe, desglosando la parte que corresponde al IVA, si procede. Si la operación está exenta de IVA, se tiene que mencionar en la factura.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la factura responde a conceptos a los cuales correspondan diferentes tipos de IVA, se tiene que especificar. (Por ejemplo libros de texto y fotocopias).&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se debe presentar una factura individual para cada alumno/a. &lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la justificación de la subvención no cumple los requisitos que antes se indican, se requerirá al interesado para que, dentro del plazo de diez (10) días hábiles, enmiende la carencia o aporte los documentos preceptivos con la indicación de que, si no lo hace, desiste de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El derecho a cobrar totalmente o parcialmente la subvención se extinguirá en los supuestos en que no se justifique o cuando concurra alguna de las causas que den lugar a reintegración. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;15. Revocación y reintegro&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15.1 Invalidez de la resolución de concesión&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son causas de nulidad de la resolución de la concesión:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Las indicadas en el artículo 47.1 de la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. La inexistencia o insuficiencia de crédito presupuestario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son causas de anulabilidad de la resolución de la concesión el resto de infracciones del ordenamiento jurídico, especialmente las reglas contenidas en la Ley 38/2003, de 17 de noviembre, general de subvenciones, de conformidad con lo establecido en el artículo 48 de la Ley 39/2015, del 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando concurran alguno de los supuestos indicados en los artículos anteriores, el órgano otorgante procederá a su revisión de oficio o, en su caso, a la declaración de lesividad y ulterior impugnación, de conformidad con lo establecido en los artículos 106 y 107 de la Ley 39/2015 del 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La declaración judicial o administrativa de nulidad o anulación implica el reintegro de las cantidades entregadas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15.2 Causas de reintegro&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además de los casos en que se declare la invalidez de la resolución de concesión, también procederá el reintegro de las cantidades recibidas más los intereses de demora correspondientes des del momento del pago de la subvención hasta la fecha que se acuerde la procedencia del reintegro, en los siguientes supuestos:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Obtención de la subvención falseando las condiciones requeridas para ello u ocultando aquellas que, de haberse conocido, hubiesen impedido la obtención de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Incumplimiento total o parcial del objetivo, la actividad, el proyecto o la no adopción del comportamiento que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. Incumplimiento de la obligación de la justificación o la justificación insuficiente en los términos establecidos por la Ordenanza y por las bases reguladoras o la convocatoria de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. Incumplimiento de las obligaciones de adoptar las medidas de difusión exigidas en las bases reguladoras.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e. Resistencia, excusa, obstrucción o negativa a las actuaciones de comprobación y control financiero, así como incumplimiento de las obligaciones contables, registrales o de conservación de documentos cuando ello se derive la imposibilidad de verificar la utilización que ha sido dada a los fondos recibidos, el cumplimiento del objetivo, la realidad y la regularidad de las actividades subvencionadas o la concurrencia de subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualquier administración o ente público o privado, nacionales, de la Unión Europea o de organismos internacionales.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f. Incumplimiento de las obligaciones impuesta por la Administración a las entidades colaboradoras y beneficiarias, así como de los compromisos asumidos por estas con motivo de la concesión de la subvención, siempre que afecten o hagan referencia a la forma de acuerdo con la cual se han de conseguir los objetivos, realizar la actividad, ejecutar el proyecto o adoptar el comportamiento que fundamenta la concesión de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g. Incumplimiento de la obligaciones impuestas por la Administración a las entidades colaboradoras y beneficiarias, así como de los compromisos asumidos por estos, con motivo de la concesión de la subvención, distintos del anterior, cuando de esto se derive la imposibilidad de verificar la utilización que se ha sido dada a los fondos recibidos, el cumplimiento del objetivo, la realidad y regularidad de las actividades subvencionadas o la concurrencia de subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualquier administración o ente público o privado, nacionales, de la Unión Europea o de organismos internacionales. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;h. La adopción, en virtud de lo establecido en los artículos del 87 al 89 del Tratado de la Unión Europea, de una decisión de la cual se derive una necesidad de reintegro.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;i. El resto de supuestos previstos en las bases reguladoras de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el supuesto que el importe de la subvención supere el coste de la actividad subvencionada, procederá el reintegro del exceso, incrementado con los intereses de demora.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15.3 Naturaleza de los créditos a reintegrar&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las cantidades a reintegrar tendrán la consideración de ingresos de derecho público; resultará de aplicación para su cobro lo establecido en la Ley general presupuestaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El interés de demora aplicable en materia de subvenciones será el interés legal del dinero incrementado en un 25%, excepto que la ley de Presupuestos Generales del Estado establezca otro.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15.4. Procedimiento de reintegro&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El procedimiento para exigir el reintegro de las subvenciones tendrá carácter administrativo y, como tal, se regirá por las disposiciones generales sobre procedimientos administrativos contenidas en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo caso, en el procedimiento de reintegro se observarán las siguientes fases:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Acuerdo de inicio del procedimiento. Se podrá iniciar de oficio, con denuncia previa o como consecuencia del informe emitido por el órgano de control financiero de la Intervención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;El órgano competente para iniciar el procedimiento será el órgano otorgante de la subvención.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Trámite de alegaciones, garantizando el derecho de audiencia de la persona interesada.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Si procede, informe de valoración de las alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Informe-propuesta emitido por el órgano de control financiero.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Resolución del procedimiento que pondrá fin a la vía administrativa. El plazo máximo para resolver y notificar la resolución será de doce (12) meses desde el acuerdo de inicio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La obligación de reintegro que en su caso se apruebe será independiente de las sanciones que, si procede, resulten exigibles.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;16. Régimen jurídico&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo aquello no previsto en estas bases reguladoras será de aplicación la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y el Reglamento General de Subvenciones 887/2006, aprobado el 21 de julio; Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas; el Reglamento de Servicios de las Corporaciones Locales de 17 de junio de 1955; el Real Decreto Legislativo 2/2004, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales; la Ordenanza General Reguladora de la Concesión de Subvenciones del Ayuntamiento de Inca; las bases de ejecución del Presupuesto Municipal para 2018 y la normativa para la concesión de subvenciones públicas, así como el resto de normativa que sea de aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;17. Recursos &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el acuerdo de resolución de la convocatoria se puede interponer recurso potestativo de reposición ante el mismo órgano que haya dictado la resolución, o bien recurso contencioso administrativo ante el Juzgado Contencioso Administrativo. Sin embargo, se puede presentar, si es el caso, cualquier otro recurso que sea pertinente. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo de acuerdo con la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contencioso administrativa, y la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;18. Protección de datos de carácter personal&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal (LOPD), se informa a las personas solicitantes de que los datos facilitados serán incluidos en un fichero propiedad del Ayuntamiento de Inca, con la finalidad única y exclusiva de gestionar y tramitar el procedimiento de concesión de subvenciones establecido en esta convocatoria de la Concejalía delegada de Alcaldía de Educación, de acuerdo con los principios de seguridad y confidencialidad de los datos que la normativa de protección de datos establece.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, se informa a la persona interesada de la posibilidad de ejercer los derechos de acceso, rectificación, cancelación y oposición, en los términos incluidos en la legislación vigente, mediante escrito presentado en el Registro del Ayuntamiento de Inca.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Facturas oficiales de los libros o material sustitutivo adquirido (pagadas o debidamente justificadas)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Anexo 2 – Declaración responsable.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;&lt;span style="color:black"&gt;Documentación ya presentada y que se encuentra en vigor, presentada ante esta misma administración dentro de la convocatoria de Libros de texto del curso 2017/18:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;span style="color:black"&gt;Fotocopia del DNI de la persona solicitante de la solicitud o documento que acredite la representatividad mediante la cual actúa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;span style="color:black"&gt;Fotocopia del Libro de Familia o certificado de nacimiento, donde se pueda identificar al/la menor y a sus progenitores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;span style="color:black"&gt;En caso de hijos discapacitados, fotocopia del documento original oficial acreditativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- En caso de separación de los padres, es necesario presentar la sentencia judicial y el convenio regulador. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Certificado/lista oficial del centro educativo que acredite que los alumnos utilizan material escolar lectivo sustitutivo de los libros de texto, detallando en qué consiste el material sustitutivo (número de unidades, títulos o cualquier otra referencia que posibilite identificar el material y su número en la factura y justificantes de gasto).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Facturas oficiales de los libros o material sustitutivo adquirido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;span style="color:black"&gt;Declaración responsable (anexo 2).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los datos relativos al empadronamiento y la convivencia en el mismo domicilio serán comprobados por el propio Ayuntamiento de Inca y, por lo tanto, no es necesario aportar los certificados.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Según el artículo 28 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, se entiende otorgado el consentimiento para la consulta de los datos relativos de estar al corriente de las obligaciones tributarias y con la Seguridad Social, al objeto de acreditar el cumplimiento de los requisitos exigidos en los artículos 13.2 e), 14 y 34.5 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, para demostrar el cumplimiento de los requisitos exigidos para la tramitación de los procedimientos de subvenciones. En caso de no autorizar esta consulta se debe aportar la documentación oficial original y/o copia para que conste en el expediente administrativo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, autorizo al Ayuntamiento de Inca a informar al centro educativo correspondiente respecto al otorgamiento de esta subvención (previa solicitud motivada por parte del centro):&lt;/span&gt;&lt;/p&gt;
