30936 CAIB 2018-09-11 ![CDATA[Aprobación definitiva modificación Bases de Ejecución del Presupuesto de 2018]] ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span><span style="font-family:Times New Roman,Times,serif; font-size:12px">La alcaldesa del Ayuntamiento de Sant Lluís hace saber, de conformidad con la legislación vigente en materia de haciendas locales, que contra el acuerdo de aprobación inicial del expediente de modificación de la base 9ª, 28ª y 48ª de las Bases de ejecución del Presupuesto de 2018, adoptado por el Pleno del Ayuntamiento en sesión de 26 de julio de 2018, no se ha presentado ningua reclamación, por lo que queda aprobado definitivamente, transcribiéndose a continuación las mencionadas bases 9ª, 28ª y 48ª:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;<strong>“Base 9ª. font-size:12px">&nbsp;<strong>Base 28ª. Subvenciones</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Con carácter general, las subvenciones que conceda el Ayuntamiento en concepto de ayuda económica directa y gratuito, se otorgarán conforme los principios de publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación. No obstante, se aprobarán de forma directa las subvenciones previstas nominativamente en el presupuesto de la corporación, aquellas cuyo otorgamiento o cuantía venga impuesto por una norma de rango legal y con carácter excepcional, aquellas en que se acrediten razones de interés público, social, económico o humanitario, u otras debidamente justificadas sin convocatoria pública.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones y ayudas concedidas se pagarán una vez justificado el gasto realizado, objeto de la subvención. Sin embargo, los actos administrativos de concesión, convenios o convocatorias públicas podrán regular los pagos anticipados y / o abonos a cuenta.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones se justificarán mediante facturas y demás documentos de valor probatorio equivalente con validez en el tráfico jurídico-mercantil o con eficacia administrativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El artículo 56 del Reglamento de la Ley general de subvenciones permite la tramitación anticipada del expediente, siempre que la ejecución del gasto se realice en la misma anualidad en que se produzca la concesión y que normalmente exista crédito adecuado y suficiente para la cobertura presupuestaria del gasto de que se trate o exista crédito adecuado y suficiente en el proyecto de presupuesto del ejercicio siguiente. En estos casos, la cuantía total máxima que figure en la convocatoria tendrá carácter estimado por lo que se deberá hacer constar expresamente en la misma que la concesión de las subvenciones queda condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de concesión. En estos casos, se incorporará al expediente un certificado de intervención de existencia habitual de crédito o un informe del concejal del área correspondiente de existencia de crédito adecuado y suficiente en el proyecto de presupuesto de la corporación que esté en fase de elaboración o tramitación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La interventora municipal y los servicios económicos llevarán a cabo el control financiero sobre toda clase de subvenciones otorgadas por el Ayuntamiento, tanto si su otorgamiento se ha hecho a través de concurrencia competitiva o por concesión directa. A tal efecto podrán requerir, en cualquier momento, todos los documentos o actuaciones administrativas que considere necesarios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este control tendrá principalmente como objeto comprobar el cumplimiento por parte de los beneficiarios de sus obligaciones en la gestión y aplicación de la subvención y en la adecuada y correcta financiación de las actividades subvencionadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los beneficiarios y terceros relacionados con el objeto de la subvención o de su justificación estarán obligados a prestar colaboración y facilitar la documentación que les sea requerida por el personal que efectúe el control financiero, el cual tendrá las siguientes facultades: libre acceso a la documentación objeto de comprobación; los locales de negocio y demás establecimientos o lugares donde se desarrolle la actividad subvencionada; la obtención de facturas, documentos equivalentes y cualquier otro documento relativo a las operaciones en que haya indicios de la incorrecta obtención o destino de la subvención y el libre acceso a la información de cuentas bancarias relacionadas con las subvenciones objeto de control.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las facultades y deberes del personal controlador así como el procedimiento para el ejercicio del control financiero serán los previstos en los arts. 47 a 50 de la Ley General de Subvenciones, con la excepción que cuando haya disconformidad entre el informe de la Intervención y el órgano gestor se someterá a consideración del Plenario municipal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para cualquier otro asunto estará a lo dispuesto en la Ordenanza general reguladora de la concesión de Subvenciones y la Ley General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Base 48ª. Normas Especiales de fiscalización</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estarán sujetos a fiscalización previa las fases de autorización y disposición de gastos que corresponda a suministros menores o gastos de carácter periódico y demás de tracto sucesivo, aunque haya intervenido el gasto correspondiente al acto o contrato inicial.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En materia de gastos corrientes en bienes y servicios se ejercerá la fiscalización limitada, en los términos recogidos en el artículo 219.2 del TRLRHL, limitándose a comprobará los siguientes extremos:</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1) La existencia de crédito presupuestario y que el presupuesto es el adecuado a la naturaleza de gasto u obligación que se proponga contraer.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2) Que las obligaciones o gastos se generan por órgano competente.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3) Aquellos otros extremos que, por su trascendencia en el proceso de gestión, se determinen plenario, a propuesta del/la presidente/a.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, las obligaciones o gastos referidos serán objeto de fiscalización plena posterior en los términos del apartado 3º del citado precepto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fiscalización plena previa de los derechos e ingresos, en general, queda sustituida por la inherente toma de razón en contabilidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El ejercicio del control financiero posterior de dichos derechos e ingresos comprenderá la comprobación de:</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- El cumplimiento de la legalidad tanto en los procedimientos de gestión que hayan dado lugar al reconocimiento, liquidación, modificación o extinción de derechos, como en la realización de cualquier ingreso público.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que el derecho económico es reconocido y liquidado por el órgano competente y de acuerdo con las normas en cada caso aplicables.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que el importe es el correcto, teniendo en cuenta las posibles causas de la modificación de éste, como los aplazamientos y fraccionamientos de las deudas liquidadas o los hechos que puedan dar lugar a la extinción del derecho.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que los ingresos se han realizado en las cajas o cuentas corrientes de las entidades de depósito debidamente autorizadas, dentro de los plazos legalmente establecidos y por la cuantía debida.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Que el pagador es el correcto, examinando, en su caso, los supuestos de derivación de responsabilidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Excepciones a la fiscalización previa limitada y control posterior:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Las devoluciones de ingresos indebidos</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- La enajenación de inversiones reales</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;Esta verificación posterior se realizará sobre una muestra representativa de los actos, documentos o expedientes de contenido económico, origen del reconocimiento o liquidación de derecho.
