&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;El apartado&lt;/span&gt;&lt;span&gt;&amp;nbsp;8&lt;/span&gt;&lt;span&gt;.3&lt;/span&gt;&lt;span&gt;. &lt;/span&gt;&lt;span&gt;de la Resolución del&lt;/span&gt;&amp;nbsp;&lt;span&gt;Presidente del Fondo de&lt;/span&gt;&amp;nbsp;&lt;span&gt;Garantía Agraria&lt;/span&gt;&amp;nbsp;&lt;span&gt;y Pesquera de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;Islas Baleares&lt;/span&gt;&amp;nbsp;&lt;span&gt;(&lt;/span&gt;&lt;span&gt;FOGAIBA) &lt;/span&gt;&lt;span&gt;de 30 de enero de 2017 por la&lt;/span&gt;&amp;nbsp;&lt;span&gt;que se convocan&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;subvenciones&lt;/span&gt;&amp;nbsp;&lt;span&gt;para las ayudas destinadas al pago compensatorio de montaña en las Islas Baleares, correspondiente al año 2017, &lt;/span&gt;&amp;nbsp;&lt;span&gt;especifica&lt;/span&gt;&amp;nbsp;&lt;span&gt;que la resolución&lt;/span&gt;&amp;nbsp;&lt;span&gt;expresa&lt;/span&gt;&amp;nbsp;&lt;span&gt;se notificará&lt;/span&gt;&amp;nbsp;&lt;span&gt;a los interesados mediante&lt;/span&gt;&amp;nbsp;&lt;span&gt;su publicación en el&lt;/span&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;Boletín Oficial de las&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;Islas Baleares&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;span&gt;de acuerdo con los&lt;/span&gt;&amp;nbsp;&lt;span&gt;términos&lt;/span&gt;&amp;nbsp;&lt;span&gt;previstos en el artículo&lt;/span&gt;&lt;span&gt;&amp;nbsp;45&lt;/span&gt;&lt;span&gt;.2&lt;/span&gt;&amp;nbsp;&lt;span&gt;de la Ley&lt;/span&gt;&amp;nbsp;&lt;span&gt;39/2015&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;de 1&lt;/span&gt;&amp;nbsp;&lt;span&gt;de octubre&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;procedimiento administrativo común de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;Los expedientes&lt;/span&gt;&amp;nbsp;&lt;span&gt;han sido&lt;/span&gt;&amp;nbsp;&lt;span&gt;tramitados&lt;/span&gt;&amp;nbsp;&lt;span&gt;por el Fondo&lt;/span&gt;&amp;nbsp;&lt;span&gt;de Garantía Agraria&lt;/span&gt;&amp;nbsp;&lt;span&gt;y Pesquera de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;Islas Baleares&lt;/span&gt;&amp;nbsp;&lt;span&gt;(&lt;/span&gt;&lt;span&gt;FOGAIBA) &lt;/span&gt;&lt;span&gt;en cumplimiento de lo&lt;/span&gt;&amp;nbsp;&lt;span&gt;dispuesto en el artículo&lt;/span&gt;&lt;span&gt;&amp;nbsp;43&lt;/span&gt;&lt;span&gt;&amp;nbsp;de&lt;/span&gt;&amp;nbsp;&lt;span&gt;la Ley&lt;/span&gt;&amp;nbsp;&lt;span&gt;39/2015&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;de 1 de octubre, procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1 Co&lt;/em&gt;&lt;em&gt;n fecha de 31 de enero de 2017 se publicó en el BOIB núm. 13, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2017 de las ayudas destinadas al pago compensatorio en zonas de montaña en las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la mencionada Resolución y el orden AAA / 726/2016 de 13 de mayo, publicado en el BOE número 117 del 05/14/2016, el plazo de presentación de solicitudes de la convocatoria terminó el día 05/15/2017, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 259 solicitudes de ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previsto en el apartado Tercero de la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5.Co&lt;/em&gt;&lt;em&gt;n fecha 15 de jun&lt;/em&gt;&lt;em&gt;io&lt;/em&gt;&lt;em&gt;&amp;nbsp;de 2018 el Servicio de Ayudas al Desarrollo Rural ha emitido informe desfavorable y propuesta provisional de denegación de la ayuda a los interesados.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. &lt;/em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;em&gt;n fecha 15 de junio de 2018 se notifica, mediante publicación en la página web http://www.caib.es, dicha propuesta provisional a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. &lt;/em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;em&gt;n fecha 14 de julio de 2018 se publica en el BOIB núm.87, "Resolución de denegación a los beneficiarios de las ayudas, RD5, de fecha 9 de julio de 2018, destinadas al pago compensatorio de montaña en las Islas Baleares, para el año 2017 ".&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;8. &lt;/em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;em&gt;n fecha 16 de julio, el Servicio de Ayudas al Desarrollo Rural tiene constancia de que el interesado Pla de Buc SC con CIF J57738114 y número de expediente 04004916, dentro del plazo establecido de la propuesta provisional de resolución presentó ale alegaciones que deben ser estimadas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;15.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:18,0000pt;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;16. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:18,0000pt;"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Propuesta de resolución de &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;modifica&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;ción&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Por todo ello, se informa favorablemente &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;la modificación de la &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;“Resolución de denegación a los beneficiarios de las ayudas, RD, de fecha 9 de julio de 2018, destinadas al pago compensatorio de montaña en las Islas Baleares, para el año 2017” en el sentido de quitar del anexo I al beneficiario PLA DE BUC S.C., &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:14,2000pt;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;1. Denegar la&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;solicitud&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;es&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;presentada&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;por l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;os&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;interesado&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;s indicados en el &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;Anexo I, por incumplimiento de &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;los &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;requisitos que se indican en el mencionado anexo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:18,0000pt;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;2. Declarar concluido el procedimiento y proceder al archivo de&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;os&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;expediente&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;detallado&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;s&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;en el Anexo I.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
