&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;El apartado&lt;/span&gt;&amp;nbsp;&lt;span&gt;9.3&lt;/span&gt;&lt;span&gt;. &lt;/span&gt;&lt;span&gt;de la Resolución del&lt;/span&gt;&amp;nbsp;&lt;span&gt;Presidente del Fondo de&lt;/span&gt;&amp;nbsp;&lt;span&gt;Garantía Agraria&lt;/span&gt;&amp;nbsp;&lt;span&gt;y Pesquera de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;Islas Baleares&lt;/span&gt;&amp;nbsp;&lt;span&gt;(&lt;/span&gt;&lt;span&gt;FOGAIBA) &lt;/span&gt;&lt;span&gt;de &lt;/span&gt;&lt;span&gt;6&lt;/span&gt;&lt;span&gt;&amp;nbsp;de &lt;/span&gt;&lt;span&gt;julio&lt;/span&gt;&lt;span&gt;&amp;nbsp;de 201&lt;/span&gt;&lt;span&gt;7&lt;/span&gt;&lt;span&gt;&amp;nbsp;por la&lt;/span&gt;&amp;nbsp;&lt;span&gt;que se convocan&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;subvenciones&lt;/span&gt;&amp;nbsp;&lt;span&gt;para la Creación de empresas&lt;/span&gt;&amp;nbsp;&lt;span&gt;para actividades no agrarias en las zonas rurales&lt;/span&gt;&lt;span&gt;, correspondientes al año 201&lt;/span&gt;&lt;span&gt;7&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&amp;nbsp;&lt;span&gt;especifica&lt;/span&gt;&amp;nbsp;&lt;span&gt;que la resolución&lt;/span&gt;&amp;nbsp;&lt;span&gt;expresa&lt;/span&gt;&amp;nbsp;&lt;span&gt;se notificará&lt;/span&gt;&amp;nbsp;&lt;span&gt;a&lt;/span&gt;&amp;nbsp;&lt;span&gt;los interesados mediante&lt;/span&gt;&amp;nbsp;&lt;span&gt;su publicación en el&lt;/span&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;Boletín Oficial de las&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;Islas Baleares&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;span&gt;de acuerdo con los&lt;/span&gt;&amp;nbsp;&lt;span&gt;términos&lt;/span&gt;&amp;nbsp;&lt;span&gt;previstos en el artículo&lt;/span&gt;&lt;span&gt;&amp;nbsp;45&lt;/span&gt;&lt;span&gt;.2&lt;/span&gt;&amp;nbsp;&lt;span&gt;de la Ley&lt;/span&gt;&amp;nbsp;&lt;span&gt;39/2015&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;de 1&lt;/span&gt;&amp;nbsp;&lt;span&gt;de octubre&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;del&lt;/span&gt;&amp;nbsp;&lt;span&gt;procedimiento administrativo común de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;Los expedientes&lt;/span&gt;&amp;nbsp;&lt;span&gt;han sido&lt;/span&gt;&amp;nbsp;&lt;span&gt;tramitados&lt;/span&gt;&amp;nbsp;&lt;span&gt;por el Fondo&lt;/span&gt;&amp;nbsp;&lt;span&gt;de Garantía Agraria&lt;/span&gt;&amp;nbsp;&lt;span&gt;y Pesquera de&lt;/span&gt;&amp;nbsp;&lt;span&gt;las&lt;/span&gt;&amp;nbsp;&lt;span&gt;Islas Baleares&lt;/span&gt;&amp;nbsp;&lt;span&gt;(&lt;/span&gt;&lt;span&gt;FOGAIBA) &lt;/span&gt;&lt;span&gt;en cumplimiento de lo&lt;/span&gt;&amp;nbsp;&lt;span&gt;dispuesto en el artículo&lt;/span&gt;&lt;span&gt;&amp;nbsp;43&lt;/span&gt;&lt;span&gt;&amp;nbsp;de&lt;/span&gt;&amp;nbsp;&lt;span&gt;la Ley&lt;/span&gt;&amp;nbsp;&lt;span&gt;39/2015&lt;/span&gt;&lt;span&gt;, &lt;/span&gt;&lt;span&gt;de 1 de octubre, del procedimiento administrativo común de las&lt;/span&gt;&amp;nbsp;&lt;span&gt;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. &lt;/em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;em&gt;n fecha de 15/07/2017 se publicó la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de día 6 de julio de 2017, por la que se convocan, para el año 2017, subvenciones para la creación de empresas por actividades no agrarias en las zonas rurales.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2.&lt;/em&gt;&amp;nbsp;&lt;em&gt;De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes finalizó el día 16 de octubre de 2017.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Con fecha 13 de abril de 2018, se publicó en la web del Fogaiba una notificación de deficiencias requiriendo a los interesados, señalados en el anexo, que completassin la documentación presentada o esmenassin los errores detectados.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5.&lt;/em&gt;&amp;nbsp;&lt;em&gt;Los interesados aportaron diversa documentación pero no fueron enmendar todas las deficiencias y se publicó en la web del Fogaiba (14 de mayo de 2018), un informe desfavorable y la propuesta provisional de denegación.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6.&lt;/em&gt;&lt;em&gt;&amp;nbsp;Los interesados&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:times new roman;"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt; presentaron alegaciones a la propuesta provisional de denegación, pero no fueron subsanar las deficiencias o incumplimientos detectados.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. &lt;/em&gt;&lt;em&gt;Por lo tanto, los interesados &lt;/em&gt;&amp;nbsp;&lt;em&gt;señalados en el anexo, no cumplen con los requisitos del apartado tercero de la resolución de convocatoria según lo indicado en el anexo y procede denegar sus solicitudes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
