text/html es 2196 2018-02-27 CAIB 110 6369 es CAIB 6370 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les comunico que la consejera ejecutiva del Departamento de Modernización y Función Pública del Consell Insular de Mallorca en el día de hoy, ha resuelto:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>“Hechos</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El artículo 15 de la Ley &nbsp;3/2007, de 27 de marzo, de la Función Pública de la Comunidad autónoma de las Illes Balears, en materia de nombramiento de funcionario interino y de acuerdo con lo que se establece en el artículo 4 del Decreto 30/2009 de 22 de mayo, por el cual se aprueba el procedimiento de selección de funcionarios al servicio de la Administración de la Comunidad Autónoma de las Illes Balears, cuando se, cuando se agote una bolsa, no haya ninguna anterior que disponga de aspirantes y se prevea la necesidad de cobertura de vacantes para diferentes escalas, clases o categorías, se deberá hacer una convocatoria pública de concurso para constituir una nueva bolsa con los aspirantes que superen el nivel mínimo exigido a este efecto, ordenados de acuerdo con el baremo establecido en cada caso.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. En fecha 12 de febrero de 2018 se emite la propuesta de la Junta Calificadora de aprobación de la lista provisional de méritos de los aspirantes seleccionados para constituir dos bolsas de esta categoría.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El plazo para presentar alegaciones a estos resultados provisionales finalizó el día 15 de febrero de 2018 y tres aspirantes interpusieron reclamación en relación a su puntuación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. En fecha 23 de febrero de 2018 se reúne la Junta Calificadora para revisar las peticiones de valoración realizadas de los méritos, i acuerda lo siguiente:&nbsp;</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a. Desestimar la reclamación interpuesta por el Sr. Antonio Ayné Carbó,&nbsp; referente a un curso obtenido fuera del plazo de presentación de instancias, de acuerdo con la Base 9, apartado 9.1 de las Bases de esta convocatoria. Por todo lo expuesto la Junta Calificadora considera como correcta la valoración inicial realizada.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b. Desestimar les reclamaciones del Sr. Miguel Ángel Ríos Cebollada y la Sra. Mª Magdalena Colom Arenas, dado que no se puede valorar la superación de un examen de oposición de otra categoría diferente a la categoría convocada, de acuerdo con el punto 8 del Anexo 2 de las Bases de esta convocatoria. Por todo lo expuesto, la Junta Calificadora considera como correcta la valoración inicial realizada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Por todo esto, dicto la siguiente</span></p> <p style="text-align: center;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">RESOLUCIÓN</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprobar, de conformidad con la propuesta efectuada por la Junta Calificadora, la lista definitiva de aspirantes seleccionados para constituir dos bolsas de la subescala, clase o categoría de práctico –a topográfico –a con indicación de la puntuación obtenida y del número de orden de prelación, que se adjunta en el anexo I.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Esta Resolución se publicará en el &nbsp;<em>Butlletí Oficial de les Illes Balears</em> y se expondrá al público en el tablón de edictos del edificio de la Llar de la Infància y en la Sede electrónica del Consell de Mallorca.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra esta resolución, que no pone fin a la vía administrativa, podéis interponer el recurso de alzada ante la Presidencia del Consell Insular de Mallorca, en el plazo de un mes, contado a partir del día siguiente de recibir esta notificación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra la desestimación expresa de este recurso de alzada podéis interponer el recurso contencioso administrativo ante el Juzgado contencioso Administrativo de Palma que corresponda en el plazo de dos meses, contados a partir del día siguiente de recibir la notificación de la desestimación del dicho recurso de alzada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si han transcurrido tres meses desde la interposición del recurso de alzada y no&nbsp; habéis recibido la notificación de resolución expresa, se entiende desestimado por silencio y podéis interponer el recurso contencioso administrativo ante el Juzgado contencioso Administrativo de Palma que corresponda, sin limitación de tiempo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstante lo anterior, podéis interponer, si procede, cualquier otro recurso que consideréis oportuno. Todo esto en conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las
