Naturaleza, objeto y fundamento.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- De conformidad con lo previsto en el artículo 127 en relación con el artículo 41 ambos del RD Legislativo 2/2004, de 5 de marzo, texto refundido de la ley reguladora de las haciendas locales, el ayuntamiento de Lloseta&nbsp; establece el precio público para la prestación del servicio de utilización de elementos de mobiliario municipales, que se regulará mediante el presente acuerdo de regulación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Objeto. Sujeto pasivo</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Están obligados al pago del precio público, especificado en el artículo 3º siguiente., Quienes se beneficien de los elementos de mobiliario que son objeto de cesión temporal detallados en el artículo anterior.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 3º. Exenciones:</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Están exentas de estas tarifas:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;Los centros educativos: CP "SE PUIG", Escuela Infantil "Querubines", Escuela Infantil "Colorines", Escuela Infantil "Ilusiones", Escuela de Música Municipal.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Las entidades ciudadanas y asociaciones de Lloseta legalmente constituidas y por acciones sin ánimo de lucro.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Partidos políticos y cooperativas por acciones sin ánimo de lucro.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- Las ONG para acciones de solidaridad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 5. Obligación de pago.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La obligación de pago del precio público aquí regulado nace desde que se solicita la cesión temporal de cualquiera de los elementos de mobiliario especificados en el art. 3.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El pago del precio público se efectuará en el Ayuntamiento de Lloseta o bien por transferencia bancaria antes de la recogida del material, una vez recibida la confirmación de la disponibilidad. En el momento de realizar el pago se deberá hacer mención a la referencia indicada por el Ayuntamiento con la comunicación de la autorización.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 6. Normas de gestión.</strong></span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) La utilización de los elementos del mobiliario está sujeto a autorización previa, a solicitud por escrito del interesado. La autorización será discrecional según las necesidades y programación del Ayuntamiento; y la denegación será motivada.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Para realizar la solicitud se deberá utilizar el modelo publicado en la página web del Ayuntamiento (www.ajlloseta.net) en el apartado de trámites y documentos, modelo que ya incorporará la liquidación de la tarifa y el importe de los depósitos a constituir. Se podrán remitir por correo electrónico a la dirección ajuntament@ajlloseta.net, también por fax al nº. 971.519432 o personalmente en las oficinas del Ayuntamiento.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) La solicitud debe realizarse con una antelación mínima de 5 días hábiles antes del día por el que se pide el uso de los elementos de mobiliario. Comunicándose, al interesado, la confirmación, como máximo, en dos días hábiles desde la fecha de solicitud.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d) El período máximo para presentar la solicitud será de un mes antes del día por el que se pide el uso de los elementos de mobiliario. Se comunicará al interesado la confirmación de la misma en 5 días hábiles.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e) En la propia solicitud se deberá especificar el medio preferente para la comunicación de la autorización del uso o en su caso de la denegación, siendo exclusivamente por vía telefónica o por correo electrónico, con el objetivo de agilizar los trámites. En cuanto se le comunique la autorización se le indicará el importe a satisfacer así como una referencia de la liquidación efectuada, referencia que se deberá hacer constar como concepto de ingreso tanto si se efectúa con transferencia bancaria o con efectivo al Ayuntamiento.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Será obligatorio constituir un depósito por importe del 50% del total de la tarifa con un importe mínimo de 20'00 €. Una vez se hayan vuelto los elementos de mobiliario alquilados y comprobado que hay el número correcto de elementos así como su buen estado, se procederá a la devolución del depósito; de lo contrario no se devolverá el depósito.</span></p> <p style="margin-left:1.0cm;"> <span style="font-family:times new roman,times,serif;font-size:12px;">g) La vestimenta por mesas y sillas, así como las servilletas siempre deberán volver limpios. Y esta limpieza se debe realizar por una lavandería profesional. En caso de no especificarse, la devolución se hará con efectivo previa solicitud.</span></p> <p style="margin-left:14.2pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">i) La recogida de los elementos solicitados se realizará en horario de la brigada municipal, es decir, de lunes a viernes de 7'30 h a 15'00 h, en el lugar indicado por el jefe de la brigada municipal. Además será necesario presentar una copia de la solicitud realizada.</span></p> <p style="margin-left:14.2pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">j) Para la devolución de los elementos de mobiliario también serán aplicables las mismas condiciones que para la recogida.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 7. Infracciones y sanciones.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En materia de infracciones y su correspondiente sanción, hay que tener en cuenta lo dispuesto en la legislación sobre régimen local y disposiciones complementarias o supletorias.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La imposición de sanciones no impide, en ningún caso, la liquidación y el cobro de las cuotas defraudadas no prescritas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición final.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- En todo lo no previsto en este acuerdo se aplicará lo establecido en la vigente ley de régimen local y otras disposiciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Esta acuerdo de regulación del precio público entrará en vigor el día de su publicación en el boletín oficial de la comunidad autónoma de las Islas Baleares (BOIB).
