es CAIB es 2017-12-21 41575 CAIB ![CDATA[Aprobación definitiva tasa prestación servicios y realización actividades "Escuela municipal y banda música Can Blau"]] 2017-12-19 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Mediante acuerdo del Pleno de la Corporación Municipal, en sesión ordinaria celebrada el día 26 de octubre de 2017, se aprobó inicialmente la Ordenanza Fiscal reguladora de la tasa de prestación de los servicios y realización de actividades en la escuela municipal de música de Sant Josep de sa Talaia. Dicho acuerdo aparece publicado en el BOIB núm. 134, de 2 de noviembre de 2017.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Terminado el plazo de exposición pública sin haberse presentado alegaciones, el acuerdo hasta entonces inicial, se entiende definitivamente aprobado, de acuerdo con lo dispuesto en el art. 49 de la Ley 7/85, por lo que, una vez adaptado el lenguaje a las recomendaciones del informe sobre impacto de género, emitido por el Instituto Balear de la Mujer, que afectan a la forma pero no al fondo, se publica el texto íntegro de la Ordenanza fiscal reguladora de la tasa por prestación de los servicios y realización de actividades en la escuela municipal de música de Sant Josep de la Talaia "Escuela y Banda de música Can Blau", que a continuación se transcribe:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>"Ordenanza fiscal reguladora de la tasa por prestación de los servicios y realización de actividades en la escuela municipal de música de Sant Josep de sa Talaia “Escuela y Banda de Música Can Blau "</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 1. Fundamento y naturaleza</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Haciendo uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución española y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, y de conformidad con lo dispuesto en los artículos 15 a 27 del Texto refundido de la Ley reguladora de las haciendas locales, aprobado por Real decreto legislativo 2/2004, de 5 de marzo, este Ayuntamiento establece la tasa por prestación de servicios, realización de actividades en la escuela municipal de música de Sant Josep de sa Talaia "Escuela y Banda de música Can Blau".</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 2. Hecho Imponible</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Constituye el hecho imponible de la tasa la prestación de servicios y realización de actividades en la escuela municipal de música de Sant Josep de sa Talaia "Escuela y Banda de Música Can Blau".</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 3. Sujeto pasivo</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Son sujetos pasivos de esta tasa, todas las personas físicas o jurídicas y las entidades a que se refiere el artículo 36 de la Ley General Tributaria, que soliciten la prestación de servicios de la escuela municipal de música de Sant Josep de sa Talaia "Escuela y Banda de Música Can Blau".</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 4. Responsables</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Responderán de la deuda tributaria los deudores principales junto a otras personas o entidades. A estos efectos, se considerarán deudores principales los obligados tributarios del apartado 2 del artículo 35 de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Salvo precepto legal expreso en contra, la responsabilidad será siempre subsidiaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Con relación a la responsabilidad solidaria y subsidiaria de la deuda tributaria, se estará a lo establecido en los artículos 42 y 43, respectivamente, de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 5. Exenciones y Bonificaciones</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se concederán las bonificaciones que constan en el cuadro del artículo anterior y que son las siguientes:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- descuento de 5,00 € por matrícula y mensualidad a los niños empadronados en el municipio.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- descuento de 10,00 € por matrícula a los adultos empadronados que cursen de 1º a 6º de enseñanzas elementales</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- descuento de 30,00 € por pago mensual durante 3 meses a los adultos empadronados que cursen de 1º a 6º de enseñanzas elementales.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- descuento de 5,00 € por 2º y 3º hermano en las mensualidades.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">- se pagará sólo una matrícula, la que suponga más coste, por familia cuando haya más de un miembro de la unidad familiar cursando estudios.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">-descuento de 5,00 € a los empadronados por curso de piano o voz (como segundo instrumento)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 7. Devengo</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se devenga la tasa y nace la obligación de contribuir desde el momento en que se solicita la prestación de cualquiera de los servicios que se regulan en esta Ordenanza.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ARTÍCULO 8.
