Duración</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La duración de la comisión de servicios es de un año, sin perjuicio de que se pueda prorrogar de acuerdo con aquello que prevé el apartado 4.3 de la Instrucción 2/2012.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>3. Publicidad</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Esta convocatoria se publica en el tablón de anuncios de la Consejería de Hacienda y Administraciones Públicas, en la Intranet y en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>4. Requisitos de los aspirantes</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se puede presentar a todo el personal funcionario de carrera que esté en la situación administrativa de servicio activo que pertenezca al subgrupo al cual está adscrito el puesto de trabajo convocado.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El personal funcionario está en la situación de servicio activo cuando ocupa un puesto de trabajo dotado presupuestariamente con carácter permanente o provisional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">De conformidad con el punto 12.2 de la Instrucción 2/2012, en una segunda convocatoria de comisión de servicios para proveer un puesto de trabajo correspondiente a una prefectura orgánica no serán de aplicación las restricciones incluidas en las letras <em>a</em>, <em>b</em> y <em>c</em> del punto 3.3 de la mencionada Instrucción relativo a los requisitos de los aspirantes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En los supuestos que el puesto convocado pueda ser provisto por personal funcionario de carrera de otras administraciones públicas, este se puede presentar siempre que cumpla también el resto de requisitos establecidos por la relación de puestos de trabajo y la normativa de aplicación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>5. Solicitudes y plazo de presentación</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">Las solicitudes de participación en la convocatoria, junto con la documentación que corresponda, se tienen que presentar en el registro de entrada de la Consejería de Hacienda y Administraciones Públicas, o en cualquiera de las formas previstas en el artículo 16 de la Ley 39/2015, de 2 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el portal de Servicios de Personal/Comisiones de servicios se encuentran a disposición de las personas interesadas el modelo de solicitud de participación en la convocatoria y el modelo de índice de los documentos presentados. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En esta solicitud las personas interesadas pueden adjuntar el certificado al que hace referencia el apartado 5.6 de la Instrucción 2/2012, o bien una copia compulsada de la documentación que corresponda. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El plazo de presentación de las solicitudes es de siete días hábiles y empieza a transcurrir a <span style="color: black;">partir del día siguiente de la publicación de esta convocatoria en el portal de Servicios al Personal de la Intranet, <em>del 17 al 27 de noviembre de 2017.</em>&nbsp; </span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>6. Baremo de méritos </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">De acuerdo con lo que prevé el apartado 9.1 de la Instrucción 2/2012, no se establece baremo de méritos para adjudicar esta comisión de servicios. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>7. Propuesta de resolución definitiva</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">Después de haber agotado el plazo de presentación de las solicitudes, se emitirá directamente una propuesta de resolución definitiva de adjudicación de la comisión de servicios a favor de la persona participante que se considere más idónea, esté o no adscrita a la consejería convocante o a un ente del sector público instrumental de esta.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">En caso de que la propuesta de resolución definitiva de adjudicación de la comisión de servicios se haga a favor de una persona que no pertenezca a la consejería convocante o a un ente instrumental que esté adscrito, se debe disponer de la conformidad de la consejería o del ente al cual esté adscrito el funcionario o la funcionaria correspondiente.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">La propuesta de resolución se publicará en los tablones de anuncios de la Consejería de Hacienda y Administraciones Públicas, en los tablones de los entes del sector público instrumental dependientes y en el portal de Servicios al Personal de la Intranet durante un periodo mínimo de 7 días hábiles.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><span style="color: black;">8. Resolución de adjudicación </span></strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">El director general de Función Pública i Administraciones Públicas es el órgano competente para resolver el procedimiento de adjudicación de la comisión de servicios convocada, de acuerdo con la delegación de competencias vigente en la actualidad.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">Contra la Resolución de la adjudicación de la comisión de servicios las personas interesadas (que hayan participado en la convocatoria) podrán interponer un recurso de reposición ante el director general de Función Pública i Administraciones Públicas en el plazo de un mes contado a partir del día siguiente de su notificación.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><span style="color: black;">9. Convocatoria desierta </span></strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">La convocatoria se tiene que declarar desierta si no se presentan solicitudes para participar dentro del plazo establecido, o cuando las personas que se presenten no cumplan los requisitos por los cuales se les pueda adjudicar.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">La Consejería de Hacienda y Administraciones Públicas, tiene que publicar la resolución correspondiente en el tablón de anuncios y en la Intranet.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><span style="color: black;">10. Convocatoria sin efectos</span></strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">Se puede emitir una resolución motivada mediante la cual se deje sin efectos la convocatoria.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">De acuerdo con la Instrucción 2/2012, esta resolución se tiene que emitir antes de que acabe el plazo para presentar las solicitudes, excepto en los casos de fuerza mayor y de supuestos justificados en los que la resolución no se pueda emitir dentro de este plazo.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">La resolución, en caso de que se emita, se tiene que publicar en el tablón de anuncios de la Consejería de Hacienda y Administraciones Públicas y en el portal de Servicios al Personal de la Intranet, y se tienen que especificar los recursos que las personas interesadas pueden interponer. </span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><span style="color: black;">11.
