2017-10-12 1160 CAIB text/html ![CDATA[Notificación de Resolución de concesión a los beneficiarios de las ayudas, R22 de fecha 26 de setiembre de 2017, para Inversiones en las explotaciones agrarias, para los años 2015-2019]] 33178 es CAIB 2017-10-12 33182 es 2017-10-10 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Notificación</strong><strong> de Resolución de concesión a los beneficiarios de las ayudas, R22 de fecha 26 de setiembre de 2017, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan subvenciones para Inversiones en las explotaciones agrarias, para los años 2015-2019</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, subvenciones para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de &nbsp;1 de octubre, y del procedimiento administrativo común de las administraciones públicas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresidente del FOGAIBA, con fecha 26 de setiembre de 2017, firmó la siguiente resolución,</span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>“INFORMEPROPUESTADE RESOLUCIÓN/ RESOLUCIÓN &nbsp;DE CONCESIÓN</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Programa de Desarrollo Rural de las Islas Baleares 2014-2020</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Medida 4.1- Inversiones en las explotaciones agrarias </em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Submedida 4- Inversiones en activos físicos</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Convocatoria: INEA 2015_2/R22 </em></strong></span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Antecedentes</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1. Con fecha de 16 de julio de 2015 se publicó en el BOIB núm. 106, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes finalizó el día 31 de diciembre 2015, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 208 solicitudes de ayuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>4. Los interesados señalados en el Anexo I han presentado, dentro del plazo establecido y en la forma, toda la documentación necesaria prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>5. Las actuaciones solicitadas por los interesados cumplen con los requisitos establecidos en la convocatoria para poder ser subvencionables.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>6. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver estos expedientes sin afectar lo dispuesto en los apartados séptimo y octavo de la convocatoria.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Fundamentos de derecho</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>16. Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>17. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>18. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Propuesta de Resolución de concesión</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Por todo ello, se informa favorablemente y propuesta al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1. Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el Anexo I, que son un total de 5 expedientes y que comienza con </em></span><em><span style="font-family:times new roman,serif;"><span class='lopd'>(datos personales ocultos)</span><span style="font-family:times new roman,times,serif;font-size:12px;"> &nbsp;y termina con </span><span class='lopd'>(datos personales ocultos)</span></span></em><span style="font-family:times new roman,times,serif;font-size:12px;"><em>, que suma un importe total de 67.375,33 euros, relativa a la línea de ayuda "Inversiones en las explotaciones agrarias".</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>2. Autorizar y disponer el gasto señalada en cada uno de los beneficiarios con cargo a los presupuestos y porcentaje s de cofinanciación detallado s en el Anexo I.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>3. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>4. las inversiones o actividades auxiliadas en el plazo establecido.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en la presente Resolución.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Ejercer la actividad agraria en cualquier explotación y mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la
