	&lt;strong&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;1. El 27 de julio de 2017 se publicó en el BOIB la Resolución del consejero de Trabajo, Comercio e Industria de 24 de julio de 2017 por la qua se aprueba la convocatoria para conceder ayudas destinadas a promover actuaciones de inversiones para la modernización de la estructura productiva y tecnológica de la actividad industrial para el año 2017.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;2. Se ha detectado que por un error material se omitió el apartado de la convocatoria relativo al régimen de &lt;em&gt;minimis&lt;/em&gt; que debía decir:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;A los beneficiarios de esta convocatoria se les debe aplicar la norma de ayudas de &lt;/em&gt;minimis,&lt;em&gt; que determina que el importe total de las ayudas de &lt;/em&gt;minimis&lt;em&gt; a una única empresa no puede ser superior a 200.000 euros durante cualquier periodo de tres ejercicios fiscales (artículo 3 del Reglamento (CE) núm. 1407/2013 de la Comisión, de 16 de diciembre).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;También por un error material se omitió el anexo 2 de la convocatoria relativo a la declaración responsable de datos, correspondiente en el régimen de &lt;em&gt;minimis&lt;/em&gt; de la convocatoria de subvenciones destinadas a promover actuaciones de inversiones para la modernización de la estructura productiva y tecnológica de la actividad industrial para el año 2017.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;1. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, dispone que las administraciones públicas pueden rectificar en cualquier momento, de oficio o a instancia de las personas interesadas, los errores materiales, de hecho o aritméticos existentes en sus actos.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;2. El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, establece que la rectificación de los errores materiales, aritméticos o de hecho en actos y disposiciones administrativas corresponde al órgano que dictó el acto o la disposición.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Por todo esto, dicto la siguiente &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;1. Aprobar las rectificaciones de errores observados en la Resolución mencionada,&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;1.1En el apartado duodécimo de la convocatoria,&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;strong&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Dónde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;Duodécimo &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;Concurrencia de ayudas o subvenciones &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;El importe de las ayudas o subvenciones que establece esta convocatoria no puede ser, en ningún caso, de una cuantía que, aisladamente o en concurrencia con subvenciones o ayudas de otras administraciones públicas, o de otros entes públicos o privados, nacionales o internacionales, supere el 75% del coste de la actividad que tenga que desarrollar la entidad beneficiaria.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;strong&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;Duodécimo &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;&lt;em&gt;Concurrencia de ayudas o subvenciones y régimen de &lt;/em&gt;minimis&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 14.15pt"&gt;

	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Trabajo, Comercio e Industria en el plazo de un mes desde el día siguiente de haberse publicado, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses desde el día siguiente de haberse publicado la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
