Fundamentos de Derecho y objeto de la convocatoria</b></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm; widows: 2; orphans: 2"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">La Constitución configura la educación como un derecho fundamental básico, tal y como establece el artículo 27, que señala en el apartado 1 que “todos tienen derecho a la educación”, especificando en el apartado 4 que “la enseñanza básica es obligatoria y gratuita”. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">El artículo 1 de la Ley Orgánica 2/2006, de 3 de mayo, de Educación (LOE), establece como uno de los principios del sistema educativo, la calidad de la educación para todo el alumnado, independientemente de sus condiciones y circunstancias; el artículo 83.1 establece que para garantizar la igualdad de todas las personas en el ejercicio del derecho a la educación, los estudiantes en situaciones socio económicas desfavorables tendrán derecho a obtener becas y ayudas al estudio. En este sentido, en el art. 80 de la citada Ley se establece que las Administraciones Públicas desarrollarán acciones de carácter compensatorio en relación con las personas que se encuentran en situaciones desfavorables y proveerán los recursos económicos y los apoyos precisos para ello. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>El objeto</b> de esta convocatoria es convocar ayudas para el inicio de curso, destinadas a la adquisición de libros de texto, material curricular y material escolar para el alumnado de educación primaria o secundaria obligatoria para el curso escolar<span style="background: transparent none repeat scroll 0% 0%;"> 2017-2018, va </span>dirigida a alumnos de centros públicos de les Illes Balears residentes y empadronados en el municipio de Calvià.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">A la vez se pretende estimular la implantación en el municipio de la reutilización de libros y otro material didáctico, con los objetivos de: fomentar los valores de la conservación responsable del material y los libros, la solidaridad,<b> </b>la capacidad de saber compartir<b> </b>los recursos disponibles, promover la cooperación entre familias, el profesorado y el alumnado. Con la reutilización se alcanzan estos objetivos entre otros muchos, y permite rebajar la carga económica de las familias dirigida a la adquisición de los libros de texto y material escolar. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Segunda. Requisitos</b></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Serán beneficiarias de las ayudas las unidades familiares que cumplan los siguientes requisitos:</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">1.- Ser residente empadronado en el municipio de Calvià con una antigüedad mínima de día 1 de enero de 2017, y continuar empadronado en el momento de otorgarse la ayuda. Este requisito se aplica al solicitante (padre, madre o tutor legal) y al alumno o alumnos beneficiarios.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">2.- Estar matriculado en un centro público de educación primaria o de educación secundaria obligatoria.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">3- Estar al corriente en el cumplimiento de obligaciones tributarias estatales, autonómicas y con el Ayuntamiento de Calvià o impuestas por las disposiciones legales vigentes, salvo el alumnado que no disponga de recursos suficientes para efectuar la compra de los libros y material subvencionable, que solicitará cita con los Servicios Sociales del Ayuntamiento para que emitan informe de la situación de vulnerabilidad y precariedad económica. Esta circunstancia se acreditará, de conformidad con lo previsto por los artículos 24 y 25 del Reglamento de la Ley General de Subvenciones, mediante la presentación de la declaración responsable que figura en el anexo 4 de esta convocatoria.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">4.- No superar, en lo relativo a los rendimientos netos de la unidad familiar para el año 2016 (saldo neto de rendimientos de la base imponible general y de las imputaciones de la renta) los límites máximos siguientes:</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 2 miembros………………… 16.325,00 € </font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 3 miembros……………….... 21.222,00 €</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 4 miembros…………….…... 25.467,00 €</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 5 miembros……………….... 28.014,00 €</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 6 miembros………………… 30.814,00 €</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">-Familias de 7 y más miembros………….. 33.950,00 €</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">En los casos en los que el rendimiento neto del ahorro sea igual o superior a 250 € se denegará la solicitud de ayuda.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Se consideran integrantes de la unidad familiar para el cómputo de ingresos, las siguientes:</font></span></span></p> <p align="JUSTIFY" style="text-align:left;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">a) La integrada por los cónyuges no separados legalmente, o bien por ambos padres sin vínculo matrimonial legal, y los hijos:</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">- menores de edad;</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">- mayores de edad; </font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">- mayores de edad incapacitados legalmente sujetos a patria potestad prorrogada o rehabilitada;</font></span></span></p> <p align="JUSTIFY" style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">- menores a cargo en acogimiento familiar, debidamente acreditado, y siempre que el órgano administrativo que haya adjudicado la medida no cubra los gastos de los libros de texto.</font></span></span></p> <p align="JUSTIFY" style="text-align:left;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">b) En los casos de separación matrimonial, divorcio o separación de hecho, la formada por el padre o la madre y todos los hijos menores que convivan por sentencia judicial con uno u otro, y siempre justificada mediante original y copia de dicha sentencia judicial, así como los hijos mayores de edad en las mismas condiciones que en el epígrafe anterior. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Tercera. Criterios para otorgar las ayudas</b></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Cuando el montante de las solicitudes presentadas que reúnan los requisitos sea superior a la partida presupuestaria destinada a las ayudas, ésta se tiene que redistribuir proporcionalmente entre todos los solicitantes.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Cuarta. Documentación</b></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Todas las solicitudes tienen que ir acompañadas de los documentos originales y las fotocopias. No se valorarán las solicitudes sin fotocopia de los documentos, ni las que no permitan compulsar la copia porque no se ha mostrado el original.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">La documentación a presentar es la siguiente:</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">1.- Modelo de solicitud correctamente cumplimentado (Anexo 1). Se encontrará a disposición de los solicitantes en los registros municipales y en la web municipal.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">2.- Documento de identificación del padre y de la madre (o tutor/es legal/es si fuera el caso). Se acreditará mediante el DNI en vigor. En caso de personas extranjeras, se acreditará mediante el NIE. En caso de no disponer de NIE, se acreditará mediante el pasaporte. En los casos de separación con régimen de guarda y custodia con sentencia judicial, el documento de identificación del progenitor que la ostente; si la ostentan los dos, el documento de ambos.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">3.- Cuando la persona solicitante de la ayuda sea el tutor legal tiene que presentar el documento que lo acredite.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; background: transparent"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">4.- Declaración de la renta o certificado de imputaciones de la Agencia Estatal de la Administración Tributaria correspondiente al ejercicio fiscal del año <span style="background: transparent none repeat scroll 0% 0%;">2016 </span>del padre y de la madre o de los tutores de la persona solicitante, así como también la de los hijos mayores de edad que formen parte de la unidad familiar y que hayan contado con ingresos en dicho ejercicio. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">En los casos de separación con régimen de guarda y custodia con sentencia judicial:</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">a) Si sólo la ostenta uno de los progenitores, la documentación sobre ingresos será la referida al mismo.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">b) Si la ostentan de forma compartida los dos progenitores, la documentación será la referida a ambos.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">En el caso de que no aparezcan datos en la Agencia Tributaria y el Ayuntamiento lo considere conveniente, para una adecuada resolución de la solicitud, podrá requerir documentación alternativa.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">5.- En caso de separación, divorcio o cese de la convivencia, se requerirá al solicitante la sentencia que acredite la guarda y custodia de los menores.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">6.- Libro de familia con todos los componentes. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">7.- Documento sellado por el centro escolar que justifique la entrega al mismo de los libros de texto utilizados en el curso escolar 2016- 2017.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">8.- Autorización para consulta de datos expediente servicios sociales (Anexo 2).</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">9.- Compromiso de entrega de libros al finalizar el curso escolar 2017-2018 para su reutilización en las condiciones señaladas en el centro escolar para la participación en dicho programa (Anexo 3).</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">10.- Declaración responsable de situación de precariedad económica y solicitud de emisión de informe social (Anexo 4).</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">11.- Si procede, declaración jurada de traducción del contenido de la sentencia de divorcio/separación a una de las lenguas oficiales de la Comunitat Autònoma de las Illes Balears (Anexo 5).</span></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Quinta. Naturaleza jurídica y normativa aplicable</b></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Las ayudas de esta convocatoria tienen carácter de máximos, carácter voluntario y temporal, no son invocables como precedente y no se puede exigir aumento o revisión de la cuantía asignada.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Son compatibles con otras ayudas por el mismo concepto. En aplicación de los artículos 14 y 19 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, será obligación de la persona beneficiaria comunicar al Ajuntament de Calvià la obtención de otra ayuda, ingreso o recurso que financie el mismo concepto, y el importe de la subvención en ningún caso podrá ser de una cuantía que, aisladamente o en concurrencia con otras subvenciones, supere el coste del concepto subvencionable.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">En todo aquello no previsto en estas bases le será de aplicación la Ley 38/2003, de 17 de noviembre, General de Subvenciones, <span style="font-style: normal;">el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el reglamento que desarrolla la Ley 38/2003, </span><span style="font-style: normal;">la</span> Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, el RDL 2/2004, de 5 de marzo, que aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, las bases de ejecución del presupuesto municipal de 2017, y el resto de la normativa aplicable para la concesión de subvenciones.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Sexta. Gastos subvencionables y cuantía individual de la subvención</b><i>. </i></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">1.- A los efectos de esta convocatoria se consideran gastos subvencionables el gasto por el beneficiario en la compra del siguiente material para el curso 2017/2018 hasta el límite fijado en esta convocatoria de ayudas para cada curso escolar: </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">a) Libros de texto: material impreso de carácter duradero en el que se recogen los contenidos correspondientes al currículo vigente de un área, ámbito, materia o módulo para un determinado curso, ciclo o nivel. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">b) Libros de texto digitales susceptibles de ser reutilizados: <span style="background: transparent none repeat scroll 0% 0%;">con carácter excepcional,</span> para el curso 2017/2018 se podrá incluir el material digital con licencia limitada a un curso escolar. También se incluye el material informático de carácter no inventariable, que se requiera para el desarrollo de las actividades derivadas del currículo en el centro y se recogen los contenidos correspondientes al currículo vigente de un área, ámbito, materia o módulo para un determinado curso, ciclo o nivel. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">c) Material curricular: aquel material que, sin tratarse de libros de texto, tiene un carácter complementario a los mismos y se requiere para el desarrollo de las actividades derivadas del currículo en el centro. A efectos de esta convocatoria también se considerará material curricular los cuadernos del alumno asociados al libro de texto. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">d) Material complementario destinado a actividades de carácter escolar: equipamiento para deporte, material fungible tales como bolígrafos, rotuladores, cuadernos, lápices, etc., libros de lectura, diccionarios, mochilas o maletas escolares.</font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm; font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">2.- No es objeto de la ayuda la compra de material inventariable, como tabletas, ordenadores, sillas ergonómicas, mesas, etc.. </font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Séptima. Plazos y presentación de solicitudes</b></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm; font-weight: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">Las solicitudes pueden presentarse del 26 de junio al 14 de julio de 2017, de lunes a viernes, de 9:00 a 14:00 horas, en el Registro General de la Corporación. También se podrán presentar en los registros auxiliares municipales de la Policía Local y en el Centre Municipal de Serveis (el Intercambiador, en Palmanova), durante los horarios establecidos por cada uno de ellos; o en cualquiera de las formas previstas en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Novena. Obligaciones de las personas beneficiarias </b></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">La obtención de las ayudas reguladas por esta convocatoria comporta las siguientes obligaciones: </font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">a) Comunicar las alteraciones que se produzcan en las circunstancias y requisitos objetivos y subjetivos tenidos en cuenta para la concesión de la subvención.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">b) Someterse a las actuaciones de comprobación y a facilitar la información que se les requiera.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">c) Comunicar al Ayuntamiento de Calvià la obtención de otras subvenciones, ayudas, ingresos o recursos que financien la adquisición del material para el cual se solicitó la ayuda. </font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">d) Procurar un uso adecuado y cuidadoso de los libros de texto y demás material curricular y escolar adquirido.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">e) Cooperar con la Administración en cuantas actividades de inspección y verificación lleven a cabo, para asegurar el correcto destino de la ayuda. </font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">f) Ceder gratuitamente los libros de texto y el otro material curricular adquirido, al terminar el curso escolar 2017/18 al centro escolar para que puedan ser utilizados por otros alumnos en los cursos posteriores. Los libros y el material deberán estar en buen estado de conservación para su uso futuro y no tener señales de deterioro, responsabilizándose de su reposición en caso contrario. El incumplimiento de esta obligación impedirá participar en el programa el curso siguiente. El plazo máximo para la entrega de los libros de texto y el otro material curricular será el 30 de junio 2018. No obstante, el alumnado que tenga que realizar alguna prueba extraordinaria finalizado el curso escolar, podrá quedarse con el libro correspondiente hasta que se examine y, como máximo, hasta el 10 de septiembre de 2018. Esta circunstancia deberá de acreditarse documentalmente al solicitar la ayuda.</span></font></span></span></p> <p align="JUSTIFY" lang="ca-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">g)<span lang="es-ES"> Justificar las ayudas conforme a lo señalado en la cláusula décima. La no justificación de las ayudas en el modo y forma señalado implicará la no concesión de la misma en la siguiente convocatoria.</span></span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Décima. Justificación de las ayudas</b></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">1.- La ayuda se justificará en el plazo máximo de 20 días hábiles desde la fecha de la recepción de la transferencia bancaria realizada por el Ajuntament de Calvià en la cuenta bancaria señalada por el beneficiario o beneficiaria. La justificación se presentará de lunes a viernes, de 9.00 a 14.00 horas, en el Registro General de la Corporación. También se podrán presentar en los registros auxiliares municipales de la Policía Local y <span style="font-weight: normal;">y en el Centre Municipal de Serveis (el Intercambiador, en Palmanova), durante los horarios establecidos por cada uno de ellos; o en cualquiera de las formas previstas en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">2.- La justificación del cumplimiento de las condiciones impuestas y de la consecución de los objetivos previstos en el acto de concesión de la ayuda se documentará de la manera que se detalla a continuación: </span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">a) La justificación se efectuará mediante la presentación de facturas o documentos de valor probatorio equivalente, con validez en el tráfico jurídico mercantil o eficacia administrativa. </span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">b) Los justificantes deberán contener, como mínimo, el nivel de detalle para que puedan ser considerados válidos por el Reglamento por el que se regulan las obligaciones de facturación, aprobado por Real Decreto 1619/2012, de 30 de noviembre, e incluirán: </span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- NIF/CIF del proveedor.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- Número de factura. </span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- Fecha.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- Dirección completa.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- Relación nominal de los productos adquiridos con el precio, es decir, los nombres de los libros y materiales comprados, relacionados uno por uno con su precio individual o resumen de los mismos. En el caso de que una misma factura englobe los libros y/o el material curricular de varios alumnos hermanos, se deberá presentar original o copia compulsada de la misma, en la primera solicitud que se realice, adjuntando fotocopia de la misma en las siguientes solicitudes del resto de hermanos, haciendo referencia siempre a la solicitud que contiene la justificación original o copia compulsada.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">- Cuando se trate de material curricular elaborado por el propio centro, el alumnado deberá solicitar al Centro un “documento justificativo individualizado” con los datos del alumno/a, el importe, concepto y relación de material.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="font-style: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">3.- El incumplimiento de la obligación de justificación de la subvención en los términos establecidos en este capítulo o la justificación insuficiente de la misma llevará aparejado el <strong>reintegro en las condiciones previstas en el artículo 37 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones</strong>.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Décimo primera. Resolución</b></font></span></span></p> <p align="JUSTIFY" lang="ca-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span lang="es-ES">La Junta de Gobierno Local, previo dictamen de la comisión informativa correspondiente, asignará objetivamente y de forma individual las ayudas sin otro trámite que la fiscalización previa del expediente que, en este caso, se ha de limitar a controlar la competencia del órgano para aprobar el gasto y la existencia de crédito presupuestario adecuado y suficiente.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Décimo segunda. Pago</b></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span lang="es-ES">El presupuesto total de la presente convocatoria es de CIENTO VEINTISÉIS MIL NOVECIENTOS DIEZ EUROS (126.910,00 €) con cargo a la partida 301</span> 23101 4800002 del presupuesto para el 2017.</font></span></span></p> <p align="JUSTIFY" lang="ca-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span lang="es-ES">El Ayuntamiento de Calvià podrá realizar, mediante los procedimientos legales pertinentes, las comprobaciones necesarias respecto al destino y la aplicación de las ayudas concedidas.<span style="background: transparent none repeat scroll 0% 0%;"> Los beneficiarios que en años anteriores hayan sido requeridos para justificar la utilización de la ayuda y no lo hayan hecho, no tienen derecho a recibirla en esta convocatoria. </span></span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">La reserva de crédito de la convocatoria no podrá superar en conjunto el importe de crédito de la partida destinada anualmente a las ayudas para el inicio de curso escolar,<span style="background: transparent none repeat scroll 0% 0%;"> salvo modificaciones presupuestarias que doten de crédito la partida.</span></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Décimo tercera. Reformulación</b></font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">La Junta de Gobierno Local, una vez concedidas las subvenciones a las personas beneficiarias y, en aplicación del principio de proporcionalidad, podrá modificar su asignación mediante resolución motivada, ante la concurrencia de alguna de las circunstancias siguientes: </font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">a) La alteración de las circunstancias o requisitos objetivos y subjetivos tenidos en cuenta para la concesión de la ayuda.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">b) La obtención, por parte de la persona beneficiaria, de ayudas o subvenciones concedidas por otros órganos de la Administración Pública, con las excepciones que se especifican en las presentes bases.</font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-top: 0.49cm; margin-bottom: 0.49cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000">En el caso de darse la circunstancia indicada en el apartado a), se podrá revocar, en última instancia, la concesión de la ayuda. </font></span></span></p> <p align="JUSTIFY" lang="es-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><b>Décimo cuarta. <span style="background: transparent none repeat scroll 0% 0%;">Reintegro</span></b></font></span></span></p> <p align="JUSTIFY" lang="ca-ES" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;"><span lang="es-ES">Serán causas de reintegro </span><span lang="es-ES"><span style="font-weight: normal;">de las cantidades percibidas l</span></span><span lang="es-ES"><span style="font-style: normal;"><span style="font-weight: normal;">as recogidas en el artículo 37 de la</span></span></span><span lang="es-ES"><span style="font-weight: normal;"> </span></span><span lang="es-ES"><span style="font-style: normal;"><span style="font-weight: normal;">Ley 38/2003, de 17 de noviembre, General de Subvenciones </span></span></span><span lang="es-ES"><span style="font-weight: normal;">en los siguientes casos:</span></span></span></font></span></span></p> <p align="JUSTIFY" style="font-weight: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">a) Obtención de la subvención falseando las condiciones requeridas para ello u ocultando aquéllas que lo hubieran impedido.</span></font></span></span></p> <p align="JUSTIFY" style="font-weight: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">b) Incumplimiento total o parcial del objetivo que fundamenta la concesión de la ayuda.</span></font></span></span></p> <p align="JUSTIFY" style="font-weight: normal"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">c) Incumplimiento de la obligación de justificación o la justificación insuficiente, en los términos establecidos en la clausula décima de estas normas reguladoras de las ayudas.</span></font></span></span></p> <p align="JUSTIFY"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;"><span style="font-weight: normal;">d) Resistencia, excusa, obstrucción o negativa a las actuaciones de comprobación y control financiero previstas en los artículos 14 y 15 de la </span><span lang="es-ES"><span style="font-style: normal;"><span style="font-weight: normal;">Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></span></span><span lang="es-ES"><i><span style="font-weight: normal;"> </span></i></span></span></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;">e) La no utilización de la subvención concedida para la compra de los libros <span style="font-style: normal;"><span style="font-weight: normal;">o el material previsto en la cláusula sexta de las presentes bases.</span></span></span></font></span></span></p> <p align="JUSTIFY" style="margin-bottom: 0cm"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><font color="#000000"><span style="background: transparent none repeat scroll 0% 0%;"><span style="font-style: normal;"><span style="font-weight: normal;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
