	Notificación de Resolución de concesión a los beneficiarios de las ayudas, R8 de fecha 4 de abril de 2017, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 14 de noviembre de 2015 por la que se convocan subvenciones para las Inversiones en la Transformación y la Comercialización de productos agrícolas , para los años 2015-2019&lt;/p&gt;
&lt;p&gt;
	El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 14 de noviembre de 2015 por la que se convocan, subvenciones para las Inversiones en la Transformación y la Comercialización de&amp;nbsp; productos agrícolas, correspondientes a los años 2015-2019, &amp;nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt; Islas Baleares &lt;/em&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/p&gt;
&lt;p&gt;
	Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/p&gt;
&lt;p&gt;
	El vicepresidente del FOGAIBA, con fecha 4 de abril de 2017, firmó la siguiente resolución,&lt;/p&gt;
&lt;p align="center" style="margin:0px;"&gt;
	&lt;strong&gt;&lt;em&gt;" RESOLUCIÓN DE CONCESIÓN&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="center" style="margin:0px;"&gt;
	&lt;strong&gt;&lt;em&gt;Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="center" style="margin:0px;"&gt;
	&lt;strong&gt;&lt;em&gt;Medida 4.2- Transformación y Comercialización de productos agrícolas.&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="center" style="margin:0px;"&gt;
	&lt;strong&gt;&lt;em&gt;Convocatoria: ITC2016_1 / R8&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;1. Con fecha de 14 de noviembre de 2015 se publicó en el BOIB núm. 168, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para Inversiones en la Transformación y la Comercialización de productos agrícolas.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes de la convocatoria &amp;nbsp;2016_1 terminó el día 30/06/2016, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 31 solicitudes de ayuda.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;4. Los interesados ​​señalados en el Anexo I adjunto han presentado, dentro del plazo establecido y en la forma, toda la documentación necesaria prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad de la convocatoria, los beneficiarios les corresponde una ayuda máxima detallada en el Anexo I, después de aplicar la deducción de inversiones y / o actuaciones que no son elegibles para esta línea de ayudas descrita en el Anexo II.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver estos expedientes sin afectar lo dispuesto en los apartados séptimo y octavo de la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. Con fecha 26 de enero de 2017 el Servicio de Ayudas al Desarrollo Rural ha emitido informe favorable y propuesta provisional de concesión de ayuda a los beneficiarios relacionados en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;8. Con fecha 16 de febrero de 2017 se notifica, mediante publicación en la página web http: //www.caib.es, dicha propuesta provisional a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;9. A día de hoy, y una vez finalizado el plazo, los interesados &lt;/em&gt;&lt;em&gt;​​&lt;/em&gt;&lt;em&gt;no han presentado alegaciones.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura ya la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y los pagos al desarrollo rural.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Real Decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, de la viña.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;13. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;14. Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;15. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;16. Ley 30/1992, de 26 de noviembre del Régimen jurídico de las Administraciones Públicas&amp;nbsp; y del Procedimiento Administrativo Común.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el Anexo I, que son un total de 3 expedientes y que comienza con &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;. y termina con &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt; que suma un importe total de 45.258,28 euros, relativa a la línea de ayuda "Transformación y comercialización de productos agrícolas", decuciendo las inversiones/actuaciones no elegibles especificadas en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Autorizar y disponer el gasto señalada en cada uno de los beneficiarios con cargo a los presupuestos y porcentajes de cofinanciación detallados en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Notificar la resolución a cada uno de los beneficiarios del Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, del procedimiento administrativo común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Realizar las inversiones o actividades auxiliadas en el plazo establecido en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en la Resolución de convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Mantener la inversión objeto de subvención y su destino durante por lo menos cinco años contados desde la fecha de pago de la ayuda, y también mantener los requisitos y condiciones exigibles respecto a la explotación y el beneficiario, durante este periodo.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;No efectuar la inversión objeto de subvención ninguna modificación importante que afecte a su naturaleza o a sus condiciones de ejecución o que proporcione una ventaja inadecuada a una empresa o a un organismo público, y que resulte, bien de un cambio en la naturaleza del régimen de propiedad, de una determinada infraestructura o bien de la interrupción o del cambio de localización de una actividad productiva.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Cumplir las normas comunitarias aplicables a la inversión y en especial las relativas a la durabilidad de las operaciones previstas en el artículo 71 del Reglamento (UE) núm. 1303/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad. Para acciones que supongan inversiones que superen un coste total de 50.000 euros, el beneficiario deberá&amp;nbsp; colocar una placa o cierra explicativa.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;En caso de que sea obligatoria la inscripción de acuerdo con la normativa vigente, registrar las actuaciones objeto de subvención en el Registro sanitario o en el Registro de establecimientos del sector de la alimentación animal, antes de la fecha de finalización del plazo establecido en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;En el supuesto de adquisición, construcción o rehabilitación y mejora de bienes inventariables, en el caso de bienes inscribibles en un registro público, deberá hacerse constar en la escritura que el beneficiario deberá destinar los bienes con la finalidad para la que se concedió la subvención durante un mínimo de cinco años, así como el importe de la subvención concedida, y estos extremos deben ser objeto de inscripción en el registro público correspondiente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Someterse a los controles que lleve a cabo la administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Se informa a los beneficiarios que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle Reina Constanza, núm. 4 de Palma).”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
