	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En el presente procedimiento ORDINARIO 1153/2012 seguido a instancia de MONICA RADO GARCIA frente a CP POSADA DE MONTSERRAT 14, FRANCISCO THOMÁS MIR, FRANCISCO DE ASÍS THOMÁS DARDER, MÓNICA ISABEL TUBERT SERANTES, MARÍA DEL CARMEN THOMÁS DARDER, LAURA RIERA LÓPEZ, MARÍA JOSÉ MÁRMOL DONAIRE, FRANCISCO TRUYOLS JUAN DE SENTMENAT se ha dictado sentencia, cuyo tenor literal es el siguiente: &lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;SENTENCIA nº 003 / 2.017&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;En Palma de Mallorca, a 12 de Enero de 2.017. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vistos por mí, Dª Mª Teresa Olivera Sánchez del Campo, Magistrada- Juez Titular del Juzgado de Primera Instancia nº 19 de Palma de Mallorca los autos del juicio ordinario registrados con el nº 1.153 / 12, siendo demandante Dª Mónica Rado García , representada por el Procurador de los Tribunales D. Xim Aguiló de Cáceres P&lt;span style="color: windowtext;"&gt;lanas , y asistida por la Letrada Dª Mª Dolores García Sánchez, y demandados la Comunidad de Propietarios del Edificio Posada de Montserrat nº 14 de Palma de Mallorca, D. Francisco Thomás Mir, D. Francisco de Asís Thomás Darder y Dª Mónica Isabel Turbet Serantes, Dª María del Carmen Thomás Darder, Dª Laura Riera López, representados por Dª Sara Truyols Álvarez Novoa, y asistidos por el Letrado D. Diego Coronado Mansilla, y Dª Mª José Mármol Donaire , en situación procesal de rebeldía, y D. Juan Francisco Truyols Juan de Sentmenat, representado por la Procuradora de los Tribunales Dª Ana María Vicens Pujol, y asistido por el Letrado D. Fernando J. Vidal de Villalonga. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;FALLO&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;QUE DESESTIMANDO ÍNTEGRAMENTE LA DEMANDA &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;interpuesta por Dª Mónica Rado García , representada por el Procurador de los Tribunales D. Xim Aguiló de Cáceres Planas , contra la Comunidad de Propietarios del Edificio Posada de Montserrat nº 14 de Palma de Mallorca, D. Francisco Thomás Mir, D. Francisco de Asís Thomás Darder y Dª Mónica Isabel Turbet Serantes, Dª María del Carmen Thomás Darder, Dª Laura Riera López, Dª Mª José Mármol Donaire, y D. Juan Francisco Truyols Juan de Sentmenat, debo absolver y absuelvo a los demandados de todos los pedimentos contenidos en el escrito de demanda , condenando a la parte actora al pago de las costas procesales. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;Notifíquese a las partes y háganles saber que contra esta resolución cabe recurso de apelación, que en su caso se interpondrá en el plazo de 20 días ante este Juzgado, siendo necesaria la consignación del depósito al que hace referencia la Ley Orgánica 1 / 09.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;Conforme a la D.A. decimoquinta de la LOPJ, introducida por la LO 1/09 para el anuncio o la preparación o la interposición del recurso de apelación será precisa la consignación como depósito de 50 euros en la “Cuenta de Depósitos y Consignaciones” abierta a nombre del Juzgado en la entidad BANESTO y acreditándolo documentalmente ante este Tribunal, aportando copia del resguardo de ingreso. No se admitirá a trámite ningún recurso cuyo depósito no esté constituido. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;Así lo pronuncio, mando y firmo, Dª Mª Teresa Olivera Sánchez del Campo, Magistrada- Juez Titular del Juzgado de 1ª Instancia nº 19 de Palma de Mallorca. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: windowtext;"&gt;Publicación: Leída y publicada esta Sentencia por el Juez que la suscribe celebrando Audiencia Pública. Doy fe. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: windowtext;"&gt;Y encontrándose dicho demandado, MARÍA JOSÉ MÁRMOL DONAIRE, en paradero desconocido, se expide el presente a fin de que sirva de notificación en forma al mismo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
