	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Notificación de Resolución de denegación de prórroga a los beneficiarios de las ayudas, R37 de fecha 6 de marzo de 2017, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan para los años 2015-2019 subvenciones para inversiones no productivas vinculadas a la realización de los compromisos agroambientales y clima&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan, subvenciones para las Inversiones no productivas vinculadas a la realización de los compromisos agroambientales y clima, correspondientes a los años 2015-2019, &amp;nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt; Islas Baleares &lt;/em&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El vicepresidente del FOGAIBA, con fecha 13 de enero de 2017, firmó la siguiente resolución, &lt;/span&gt;&lt;/p&gt;

	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vista la solicitud de prórroga formulada por los interesados &lt;/em&gt;&lt;em&gt;​​&lt;/em&gt;&lt;em&gt;señalados en el Anexo I, en relación con la ayuda concedida para rehabilitar márgenes y / o paredes secas, amparada por la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 13 de noviembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la Comunidad Autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Informe - propuesta de resolución&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;De acuerdo con la normativa reguladora de la ayuda que tienen concedida, el artículo 20 de las bases reguladoras establece que sólo con carácter excepcional y por razones justificadas los beneficiarios podrán solicitar la ampliación de los plazos establecidos en la respectiva convocatoria .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Visto el punto 12 de la convocatoria donde se especifica que, únicamente, por razones justificadas de demora en la concesión de licencias por parte de los ayuntamientos, bajas laborales e incidencias graves que no sean imputables al solicitante, los beneficiarios podrán solicitar la ampliación del plazo de realización y justificación establecido en la resolución de concesión.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se informa DESFAVORABLEMENTE de la concesión de un plazo de prórroga por los motivos señalados en el Anexo I, y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Denegar la prórroga solicitada a los interesados &lt;/em&gt;&lt;em&gt;​​&lt;/em&gt;&lt;em&gt;que figuran en el Anexo I, que comienza con &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;&lt;span style="font-size:12.0pt;"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt; y termina con &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, y que en total son 3, relativa a la línea de ayudas Inversiones no productivas (márgenes y cierres), por no cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el citado anexo.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Notificar los interesados &lt;/em&gt;&lt;em&gt;​​&lt;/em&gt;&lt;em&gt;que, de acuerdo con lo establecido en el artículo 49 de la Ley 30/1992, de 26 de noviembre, el plazo para la justificación de las inversiones no se amplía, en consecuencia el plazo para la justificación de la inversión será el establecido en la correspondiente Resolución de concesión.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Posar en conocimiento de los peticionarios que, contra el acuerdo de denegación de prórroga, no se podrá interponer recurso según se establece en el artículo 49.3 de la Ley 30/1992, de 26 de noviembre.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
