text/html CAIB 140 es es 2017-02-11 590641 CAIB ![CDATA[Resolución del director general del Servicio de Salud de les Illes Balears de 1 de febrero de 2016 por la cual se aprueba la lista de aspirantes que han superado el concurso-oposición para cubrir plazas vacantes de la categoría de Terapeuta ocupacional dependientes del Servicio de Salud de las Islas Baleares, convocadas mediante la resolución del director general del Servicio de Salud de las Islas Baleares de 1 de septiembre de 2015 (BOIB núm. 132 de 5 de septiembre) ]] 3799 ![CDATA[<p> <strong><span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">Hechos y fundamentos de derecho</span></span></strong></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: windowtext;">1. </span>Mediante <span style="color: windowtext;">la resolución del director general del Servicio de Salud de las Islas Baleares </span>de 1 de septiembre de 2015 <span style="color: windowtext;">(BOIB núm. 132 de 5 de septiembre) se aprobó la convocatoria por la que se establecen las bases&nbsp; que tienen que regir las pruebas selectivas para cubrir plazas vacantes de categoría de </span>terapeuta ocupacional dependientes del Servicio de Salud de las Islas Baleares <span style="color: windowtext;">&nbsp;correspondientes a las ofertas de empleo público para el año 2009 (BOIB núm. 159, de 29 de octubre de 2009).</span></span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">2. Una vez finalizadas las pruebas selectivas, el Tribunal calificador ha elevado al director general del Servicio de Salud de les Illes Balears la lista de aspirantes que han superado el proceso selectivo y una relación complementaria de personas aspirantes que siguen por orden de puntuación a las propuestas, para el caso de que se produzcan renuncias o cuando de la documentación exigida en la base 11.2 se desprenda que alguna de las personas seleccionadas no cumple los requisitos para ser nombrada como personal estatutario fijo.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">Por todo ello y de acuerdo con la base 11 de la convocatoria, dicto la siguiente</span></span></p> <p style="text-align: center;"> <strong><span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">Resolución</span></span></strong></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">1. Aprobar la lista de aspirantes (Anexo I) que han superado el concurso-oposición para cubrir plazas vacantes de la categoría de Terapeuta ocupacional&nbsp; dependientes del Servicio de Salud de las Islas Baleares, convocadas mediante la r<span style="color: windowtext;">esolución del director general del Servicio de Salud de las Islas Baleares </span>de 1 de septiembre de 2015 <span style="color: windowtext;">(BOIB núm. 132 de 5 de septiembre).</span></span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">2. </span>Publicar una lista complementaria (Anexo II) de&nbsp; personas aspirantes que siguen por puntuación a las que han superado el proceso selectivo, para el caso de que se produzcan renuncias o cuando de la documentación exigida en la base 11.2 de la convocatoria se desprenda que alguna de las personas seleccionadas no cumple los requisitos para ser nombrada como personal estatutario fijo.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">3. </span>Publicar la lista de plazas (Anexo III) que se ofertan a las personas que han superado las pruebas selectivas.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">4. </span>En el plazo de 20 días hábiles a contar desde el día siguiente a la fecha en que se publique esta resolución en el BOIB, las personas aspirantes seleccionadas y las que figuren en la lista complementaria deben presentar los documentos siguientes:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: windowtext;">a. </span><span style="color: windowtext;">Fotocopia del documento nacional de identidad o —en el caso de no tener la nacionalidad española— de un documento oficial que acredite su identidad, edad y nacionalidad. Los familiares que, de acuerdo con la base 2.1. , tengan derecho a participar a en el proceso selectivo deben presentar una fotocopia compulsada de algún documento que acredite el vínculo de parentesco o, en su caso, el hecho de ser dependientes de esos familiares.</span></span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: windowtext;">b.&nbsp; </span><span style="color: windowtext;">Fotocopia compulsada del título académico exigido en esta convocatoria o certificado académico que acredite haber llevado a cabo todos los estudios para obtener el título. En el caso de las titulaciones obtenidas en el extranjero, hay que acreditar que están homologadas por el Ministerio de Educación.</span></span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: windowtext;">c.&nbsp; </span><span style="color: windowtext;">Declaración jurada o prometida de la persona aspirante de no haber sido separada —mediante un expediente disciplinario— del servicio de cualquier servicio de salud o administración pública en los seis años anteriores a la convocatoria, y de no estar inhabilitada con carácter firme para ejercer funciones públicas ni para la profesión correspondiente.</span></span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: windowtext;">d. </span><span style="color: windowtext;">Lista mediante la cual se elijan —de mayor a menor interés— los puestos de trabajo ofertados. Es necesario incluir todas las plazas. Esta lista puede rellenarse por medio del trámite telemático publicado en la web &lt;http://opoibsalut.caib.es&gt;. También&nbsp; está disponible en formato de impreso en papel en los Servicios Centrales del Servicio de Salud y en las gerencias de atención primaria y de atención especializada y en la gerencia de atención a urgencias 061 y en la web www.ibsalut.es. En todo caso, es necesario presentarla en algún registro según lo que dispone el apartado siguiente.</span></span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">5. </span>Hay que presentar toda la documentación en el Registro General de los Servicios Centrales del Servicio de Salud o bien en cualquiera de los lugares o según las formas que establece la ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las Administraciones Públicas.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">6. </span>Si no se presenta la documentación en el plazo establecido —excepto en los casos de fuerza mayor, que deben ser constatados debidamente y, si procede, apreciados por la Administración mediante una resolución motivada— o si al examinar la documentación se deduce que la persona aspirante no cumple alguno de los requisitos, no puede ser nombrada como personal estatutario, por lo que hay que anular sus actuaciones, sin perjuicio de la responsabilidad en que haya incurrido por falsedad en la solicitud inicial.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">7. </span>Antes de efectuar los nombramientos, el Servicio de Prevención de Riesgos Laborales del Servicio de Salud debe emitir un certificado que acredite que la persona aspirante tiene capacidad funcional para desempeñar las tareas del puesto de trabajo. A tal efecto, las personas aspirantes aprobadas y las que figuren en la relación complementaria serán citadas mediante un anuncio que se publicará en el tablón de anuncios de la sede del Tribunal y en la web &lt;www.ibsalut.es&gt; con una antelación mínima de tres días a la fecha de la revisión. El resultado de este informe será remitido por el Servicio de Prevención al órgano convocante, de tal manera que no es necesario que lo presenten las personas aspirantes.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">8. </span>Publicar esta resolución en el <em>Boletín Oficial de las Islas Baleares.</em></span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;"><strong><span style="color: windowtext;">Interposición de recursos</span></strong></span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">Contra esta resolución, que agota la vía administrativa, se puede interponer recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo establecido en los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. También se puede interponer cualquier otro recurso que se considere procedente.</span></span></p> <p> <span style="font-size: 12px;"><span style="font-family: times new roman,times,serif;">No obstante, los interesados ​​podrán optar por interponer contra esta resolución recurso de reposición ante el mismo órgano que la ha dictado, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución.
