805 CAIB ![CDATA[Notificación de Resolución de concesión a los beneficiarios de las ayudas, RP4 de fecha 30 de diciembre de 2016, para el Fomento de la Agricultura Ecológica, para el año 2015]] es CAIB 2017-02-02 2017-01-31 text/html 660 2017-02-02 2892 2887 590318 CAIB ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Notificación de Resolución de concesión a los beneficiarios de las ayudas, RP4 de fecha 30 de diciembre de 2016, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 19 de febrero de 2015 &nbsp;por la que se aprueba la convocatoria de ayudas para el Fomento de la Agricultura Ecológica, para el año 2015</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El apartado 8.4. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 19 de febrero de 2015 por la que se aprueba la convocatoria para el Fomento de la Agricultura Ecológica, para el año 2015, &nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresidente del FOGAIBA, con fecha 30 de diciembre de 2016, firmó la siguiente resolución, </span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>" RESOLUCIÓN DE CONCESIÓN”</strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Programa de Desarrollo Rural de las Islas Baleares 2014-2020</strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Medida 11.2.1- Fomento de la Agricultura Ecológica.</strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Convocatoria 2015 / RP_4</strong></span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Antecedentes</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Con fecha 26 de febrero de 2015, se publicó el BOIB núm. 29 la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Con fecha de 28 de febrero de 2015 se publicó en el BOIB núm. 30, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al Fomento de la Agricultura Ecológica.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Con fecha 11 de junio de 2015 se publicó en el BOIB núm. 87, una modificación de la Resolución citada anteriormente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. De conformidad con el apartado sexto de la citada Resolución de y el orden AAA / 872/2015 de 2 de mayo, publicado en el BOE núm.114 del 13/05/2015, el plazo de presentación de solicitudes terminó el día 15/06/2015 y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 273 solicitudes de ayuda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">6. Los interesados señalados en el Anexo I adjunto han presentado, dentro del plazo establecido y en la forma, la documentación prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">7. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad de la convocatoria, los beneficiarios les corresponde una ayuda máxima detallada en el Anexo I, después de aplicar las reducciones de superficies adecuadas descritas en el Anexo II.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8. En fecha 05/12/2016 se publicó en la página WEB del FOGAIBA una propuesta provisional de resolución de concesión.</span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Fundamentos de derecho</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 28 de febrero de 2015 por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al "Fomento de la Agricultura ecológica ", la Resolución de 9 de junio de 2015 (modificación de la primera) y Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución del presidente del Fondo de Garantía Agraria y pesquera de las Islas Baleares (FOGAIBA), de 26 de febrero de 2015, por la que se aprueba la convocatoria, para el año 2015, de las ayudas destinadas al Fomento de la Agricultura Ecológica.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 22 de julio BOIB núm. 95 de 28 de julio de 2016 por la que se modifican los créditos y las cofinanciaciones de varias convocatorias de subvenciones del FOGAIBA, correspondientes a las medidas contempladas en el Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agrícola Común, por el que se derogan los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm. 485/2008 del Consejo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. Reglamento delegado (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, por el que se completa el Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo relativo al sistema integrado de gestión y control ya las condiciones sobre la denegación o retirada de los pagos y sobre las sanciones administrativas aplicables a los pagos directos, a la ayuda al desarrollo rural ya la condicionalidad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">6. Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">7. Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo relativo al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8. Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura ya la Ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y los pagos al desarrollo rural.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">9. Real Decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, de la viña.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">10. Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">14. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">15. Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">16. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">17. Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común</span></p> <p style="text-align: center;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Resolución de concesión</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Por todo ello, dicto una resolución en los siguientes términos:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Conceder la ayuda solicitada a los beneficiarios por los importes y con los plazos detallados en el Anexo I, que son un total de 9 expedientes y que comienza con </span><span style="font-family:times new roman,serif;"><span style="font-size:12.0pt;"><span class='lopd'>(datos personales ocultos)</span><span style="font-family:times new roman,times,serif;font-size:12px;"> y termina con </span><span class='lopd'>(datos personales ocultos)</span></span></span><span style="font-family:times new roman,times,serif;font-size:12px;"> que suma un importe total de CINQUENTA Y UN MIL OCHOCIENTOS SESENTA Y CINCO EUROS CON CINCUENTA Y TRES CÉNTIMOS (51.865,53€), relativa a la línea de ayuda "Fomento de la Agricultura Ecológica", con las superficies y grupos de cultivo especificados en el Anexo I.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Autorizar y disponer el gasto señalada en cada uno de los beneficiarios con cargo a los presupuestos y porcentajes de cofinanciación detallados en el Anexo I.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4. resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 114 y 115 de la BENEFICIARIO</strong></p> <p> - Mantener sin disminuir la superficie comprometida a nivel de grupo de cultivo, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considera cumplido con una tolerancia máxima de disminución de la superficie comprometida de 0,1 ha en grupos de cultivo que tengan hasta 0,5 has de superficie comprometida y un 10% en aquellos de más de 0,5 has de superficie comprometida.</p> <p> - Cumplir las parcelas lo establecido en las normas genéricas y específicas de cada cultivo sobre producción ecológica.</p> <p> - Mantener y actualizar el cuaderno de explotación específico para la agricultura ecológica donde se inscribirán operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas en caso de ser el mismo cultivo), con indicación de la fecha de realización y las incidencias, si las hubiera.</p> <p> - Participar, durante el período de compromiso, en actividades de formación relacionadas con la agricultura ecológica.
