&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;1. La Comunidad Autónoma de las Islas Baleares es propietaria de dos locales situados en el Paseo del Borne, 17, 3º y 4º piso de Palma, en virtud de la Escritura Pública de extinción de la sociedad CAIB Patrimoni, SAU, por cesión global de activos y pasivos, otorgada ante el Notario de Palma de Mallorca, D. Jesús María Morote Mendoza, con el número de protocolo 1.826, de 12 de diciembre de 2013, inscrita en el Registro Mercantil de Palma de Mallorca, en el tomo 2501, folio 181, hoja PM-40007, Inscripción 23, de 13 de mayo de 2014.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;2. La Resolución del Director General del Tesoro, Política Financiera y Patrimonio de 24 de agosto de 2015, por la que adscribió a la Consejería de Territorio, Energía y Movilidad, los inmuebles situados en el paseo del Born, núm.17, 3ª y 4ª planta de Palma de Mallorca (Boletín Oficial de las Islas Baleares núm. 130, de 1 de septiembre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;3. La Resolución de la Consejera de Hacienda y Administraciones Públicas por la que ordena el inicio del expediente para enajenar en subasta pública al alza del inmueble situado en el Paseo del Borne núm.17, planta 3ª y 4ª de Palma, de fecha de 26 de diciembre de 2016.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;4. La Resolución del director general del Tesoro, Política Financiera y Patrimonio por la que autoriza la desafectación del dominio público y la desadscripción de dos locales situados en el Paseo del Borne, 17, 3º y 4º piso de Palma, de fecha 2 de enero de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;1. Los artículos 53 a 59 y 87 de la Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 49, de 24 de abril), y el resto disposiciones aplicables concordantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;2. Los artículos 94 a 119 del Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001, de 11 de abril, del patrimonio de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 192, de 24 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;3. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 44, de 3 de abril de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Decreto 8/2015, de 2 de julio, de la presidenta de las Islas Baleares, por el que se determina la composición del Gobierno y establece la estructura de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 97, de 2 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El Decreto 9/2015, de 2 de julio, de la presidenta de las Islas Baleares, por el que se dispone el nombramiento de los miembros del Gobierno de las Islas Baleares (BOIB núm. 97, de 2 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;6. El Decreto 24/2015, de 7 de agosto, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la Estructura Orgánica Básica de las Consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 120, de 8 de agosto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;7. El Decreto 49/2016, de 22 de julio, por el que se nombra director general del Tesoro, Política Financiera y Patrimonio de la Consejería de Hacienda y Administraciones Públicas de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 93, de 23 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;Propongo a la Consejera de Hacienda y Administraciones Públicas, que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: black"&gt;1. Declarar la alienabilidad de los inmuebles, no pertenecen al dominio público, no son necesarios para prestar un servicio público ni para las funciones que debe desarrollar la Comunidad Autónoma de las Islas Baleares, al amparo del informe de la secretaria General de 10 de enero 2017, teniendo en cuenta el altísimo coste por metro cuadrado aplicado al funcionario que ocupa el espacio de los inmuebles objeto de subasta, se justifica la venta con la cuantía y la descripción que se indican a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
