2017-01-19 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Hechos</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Las personas y las entidades que figuran en el anexo 1 de esta Resolución han presentado a la Consejería de Transparencia, Cultura y Deportes una solicitud de subvención para facilitarles los desplazamientos entre las islas de la comunidad autónoma de las Islas Baleares para asistir a las competiciones oficiales de los diferentes calendarios federativos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Servicio de Administración Deportiva de la Dirección General de Deportes i Juventud ha examinado las solicitudes y no está conforme con la&nbsp;&nbsp; concesión de la subvención, por los motivos que se especifican en el apartado 1 de esta Resolución. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fundamentos de derecho</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El artículo 21.4 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005), dispone que la resolución, que finaliza el procedimiento de concesión de subvenciones, se ha de notificar individualmente o mediante publicación en el BOIB, de acuerdo con lo que se dispone en la convocatoria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. La Orden del Consejero de Turismo y Deportes de 18 de diciembre de 2012 por la cual se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB núm. 2, de 3 de enero de 2013).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El apartado 6.5 de la Resolución de la Consejera de Participación, Transparencia y Cultura (BOIB núm. 139, de 3 de noviembre de 2016) dispone que la resolución expresa de la Consejera de Participación, Transparencia y Cultura finaliza el procedimiento de concesión de subvención. La resolución colectiva se publicará en el <em>Boletín Oficial de las Islas Baleares</em> en el plazo de seis meses desde la finalización del período de presentación de solicitudes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La propuesta de resolución de denegación de ayudas de la Dirección General de Deportes y Juventud de 9 de diciembre de 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Por todo lo expuesto, dicto la siguiente</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp; </span></p> <p style="margin-left: -1pt; text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Resolución </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Denegar la concesión de una subvención, para facilitar los desplazamientos entre las islas de la comunidad autónoma de las Islas Baleares para poder asistir a las competiciones oficiales de los diferentes calendarios federativos, a las personas o entidades que figuran a continuación por los motivos que se exponen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Ordenar la publicación de esta Resolución en el BOIB. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Interposición de recursos</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra esta Resolución – que agota la vía administrativa – se puede interponer un recurso potestativo de reposición ante la Consejera de Transparencia, Cultura y Deportes en el plazo de un mes a partir del día siguiente de su publicación (o notificación), de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses desde el día siguiente a la publicación de esta Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. </span></p> <p style="margin-left:17.0pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
