	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El apartado 8.4. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 19 de febrero de 2015 por la que se aprueba la convocatoria para el Fomento de la Agricultura Ecológica, para el año 2015, &amp;nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt; Islas Baleares &lt;/em&gt;de acuerdo con los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El vicepresidente del FOGAIBA, con fecha 29 de noviembre de 2016, firmó la siguiente resolución, &lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;" INFORME PROPUESTA DE RESOLUCIÓN/ RESOLUCIÓN DE RECTIFICACIÓN”&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center" style="margin:0px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Medida 11.2.1- Fomento de la Agricultura Ecológica.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Convocatoria 2015 / RM_2&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Con fecha 26 de febrero de 2015, se publicó el BOIB núm. 29 la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Con fecha de 28 de febrero de 2015 se publicó en el BOIB núm. 30, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al Fomento de la Agricultura Ecológica.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Con fecha 11 de junio de 2015 se publicó en el BOIB núm. 87, una modificación de la Resolución citada anteriormente, y el 30 de junio de 2016 se volvió a modificar en el BOIB núm. 86 de 7 de julio de 2016.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Con fecha 22 de julio de 2016, se publica en el BOIB núm. 65 de 28 de julio de 2016 la Resolución del Presidente del FOGAIBA por la que se modifican los créditos y las cofinanciaciones de varias convocatorias de subvenciones del FOGAIBA, correspondientes a las medidas contempladas en el Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. De conformidad con el apartado sexto de la mencionada Resolución y el orden AAA / 872/2015 de 2 de mayo, publicado en el BOE núm.114 del 05/13/2015, el plazo de presentación de solicitudes de la convocatoria terminó el día 06/15/2015, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 272 solicitudes de ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. Con fecha 15 de junio de 2015 el Sr. &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt; presentó la documentación necesaria prevista en la convocatoria, y se comprobó que cumplía con los requisitos exigidos para poder ser beneficiarios de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;8. Con fecha 10/10/2016 se publicó en la página WEB del FOGAIBA una propuesta provisional de resolución de concesión, de la que no se recibieron alegaciones.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;9. En fecha 04 de noviembre de 2016 se dictó la resolución de concesión, ésta se publicó en el BOIB en fecha 10 de noviembre de 2016, con un importe para el beneficiario &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt; de € 7,397.12, con las siguientes superficies aceptadas; 21,05 ha de herbáceos de secano, 12,70 debe Herbáceos de regadío y 9,02 ha de frutales de secano.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;10. Posteriormente se ha detectado que había un error administrativa tanto en la propuesta, como en la resolución referente a este beneficiario, ya que el beneficiario había presentado un escrito de modificación parcial de la superficie.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;17. &amp;nbsp;Artículo 3 del Reglamento de ejecución (UE) 809/2014 de la Comisión de 17 de julio de 2014.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;18. De acuerdo con el artículo 105.2 de la Ley 30/1992, de 26 de enero, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, las administraciones públicas podrán rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actes.0 / 1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Propuesta de Resolución de Rectificación&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por todo ello, informa que se ha de rectificar parcialmente la resolución de fecha 04 de noviembre de 2016 y propongo al vicepresidente del FOGAIBA que dicte una resolución de modificación en los términos siguientes:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Rectificar parcialmente la resolución de concesión de fecha 04 de noviembre de 2016, únicamente para el beneficiario &lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt; con los plazos detallados en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Autorizar y disponer el gasto señalada para el beneficiario con cargo a los presupuestos y porcentajes de cofinanciación detallados en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Determinar la superficie comprometida por beneficiario y grupo de cultivo detallada en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo II.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. Publicar la resolución en el BOIB.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 114 y 115 de la Ley 30/92, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, modificada por la Ley 4/99, de 13 de enero.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	OBLIGACIONES DEL BENEFICIARIO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;- &lt;em&gt;Mantener sin disminuir la superficie comprometida a nivel de grupo de cultivo, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considera cumplido con una tolerancia máxima de disminución de la superficie comprometida de 0,1 ha en grupos de cultivo que tengan hasta 0,5 has de superficie comprometida y un 10% en aquellos de más de 0,5 has de superficie comprometida.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Cumplir las parcelas lo establecido en las normas genéricas y específicas de cada cultivo sobre producción ecológica.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Mantener y actualizar el cuaderno de explotación específico para la agricultura ecológica donde se inscribirán operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas en caso de ser el mismo cultivo), con indicación de la fecha de realización y las incidencias, si las hubiera.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Participar, durante el período de compromiso, en actividades de formación relacionadas con la agricultura ecológica. Por ello, deberá justificar la asistencia a algún curso o actividad de formación técnica, relacionados con la materia, de un mínimo de 25 horas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Someterse a las actuaciones de comprobación y de control que procedan de la Administración autonómica, estatal y comunitaria, la Sindicatura de Cuentas u otros órganos de control externo, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Cumplir, en su explotación, los requisitos legales de gestión, así como las buenas condiciones agrarias y medioambientales establecidas en los artículos 91, 92, 93, 94 y 95 del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Mantener los requisitos y condiciones exigibles respecto a la explotación y al beneficiario.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Los beneficiarios se comprometen y obligan, durante un período de 5 años, incluido el de la solicitud de ayuda, a estar inscritos en el registro de operadores del consejo Balear de la Producción Agraria Ecológica (CBPAE) como titulares de las parcelas inscritas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Se informa a los beneficiarios que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle Reina Constança, núm. 4 de Palma)."&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
