	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;1. La Administración deportiva de las Illes Balears convoca y regula en los últimos años, con la colaboración de los consejos insulares, el asesoramiento de la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears y el apoyo técnico de las federaciones deportivas de las Illes Balears el programa de competición del deporte para la edad escolar de ámbito autonómico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;2. Los consejos insulares de Mallorca, Menorca, Ibiza y Formentera, definen, planifican y ejecutan programas dirigidos a una mayor práctica deportiva, así lo hacen con los programas de competición insular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Cada año, finalizadas las competiciones insulares escolares, corresponde a la Administración deportiva autonómica, mediante la Dirección general de Deportes y Juventud, la organización y la ejecución de las fases finales del programa de competición escolar autonómico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;3. El día 18 de octubre de 2016, la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar acordó proponer los deportes, las fechas y las islas sede de las finales del programa de competición del deporte para la edad escolar de las Illes Balears de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;1. El artículo 11.7 de la Ley 6/1994, de 13 de diciembre, que atribuye las competencias a los consejos insulares en materia de patrimonio histórico, de promoción sociocultural, de animación sociocultural, de depósito legal de libros y de deportes, y que regula las convocatorias y los programas de promoción deportiva de ámbito balear y las fases finales de estas competiciones como competencias reservadas en la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;“11.7. La convocatoria y la regulación de los programas de promoción deportiva de ámbito balear, los cuales se llevarán a cabo con la colaboración de los consejos insulares, así como las fases finales de las competiciones que incluyan los programas mencionados.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;2. La Ley 14/2006, de 17 de octubre, del deporte de las Illes Balears, recoge:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Artículo 5.j como objetivo y finalidad de la Administración Pública el promover y planificar el deporte de competición. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El artículo 6, los principios generales que tienen que regir las políticas deportivas de las administraciones públicas de las Illes Balears:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;a) La coordinación y la complementariedad entre las administraciones públicas y entre estas y las entidades deportivas u otras entidades de promoción del deporte. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;b) La coherencia de todas las actuaciones de las administraciones públicas con los valores y las finalidades que establece esta ley.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;c) La planificación de la actividad pública en materia de deportes, con participación de las entidades deportivas y del resto de organizaciones de promoción del deporte.&amp;nbsp;&amp;nbsp; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El artículo 10.1 d, establece como competencias de la Administración de la Comunidad Autónoma de las Illes Balears convocar y regular los programas de promoción deportiva de ámbito balear que se tienen que llevar a cabo en colaboración con los consejos insulares y las fases finales de las competiciones que incluyen estos programas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El Artículo 19.1, en relación en el Programa de deporte escolar, &lt;em&gt;“La administración deportiva de la comunidad autónoma tiene que aprobar el programa de deporte escolar, en el cual se tiene que determinar el conjunto de actividades físico-deportivas que se tienen que implantar para fomentar la práctica de la actividad deportiva organizada en el ámbito de la población en edad escolar”.&amp;nbsp; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;3. El Decreto 38/2015, de 22 de mayo, por el cual se regula la actividad deportiva en edad escolar en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El artículo 5 que recoge los tres ámbitos de participación en la actividad física y deportiva en edad escolar, más concretamente el apartado &amp;nbsp;c recoge el ámbito de competición &lt;em&gt;“Competición, dirigida a los deportistas en edad escolar interesados en desarrollar un más alto nivel deportivo de ámbito federativo.”&lt;/em&gt; y&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El artículo 6, concreta los valores a trabajar en los programas del deporte en edad escolar, &lt;em&gt;“El deporte en la edad escolar tendrá especialmente en cuenta la formación en valores de las personas que lo practican, por lo que los agentes que participan, tanto las entidades deportivas, con su personal directivo, coordinador, técnico y monitor, así como las familias, dedicarán atención especial a la promoción del juego limpio y del respeto de las normas. Igualmente, se dedicará atención especial al desarrollo de los valores relacionados con el trabajo en equipo, el compañerismo y la consideración hacia las personas adversarias, el respeto y la tolerancia en consonancia con la integración de todo el mundo sin discriminación en razón de sexo, ofreciendo las mismas oportunidades de crecer a través del deporte, sin perder el derecho a ser diferente y a la igualdad de oportunidades a través de la integración y del reconocimiento de las identidades minoritarias, ya sea en razón de capacidades o de procedencia&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El Artículo 11, explicita los contenidos, los programas que lo pueden integrar y la forma de aprobación del Pla&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;“El Plan de la Actividad Física y Deportiva para la Edad Escolar de las Illes Balears está constituido por los programas de actividad física y deportiva para la edad escolar en los ámbitos de promoción, iniciación y competición, promovidos a iniciativa de la Administración del Gobierno de las &lt;span style="color: black;"&gt;Illes Balears&lt;/span&gt; y de los consejos insulares, y con la colaboración de las federaciones deportivas, de los ayuntamientos y de las entidades deportivas baleares, en general.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;La propuesta de inclusión de programas de actividad física y deportiva para la edad escolar en el plan se hará anualmente a la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar de las &lt;span style="color: black;"&gt;Illes Balears&lt;/span&gt; prevista en el artículo 14.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;El plan tiene carácter anual, recogerá la totalidad de los programas específicos incluidos y se aprobará por resolución del titular de la Dirección General de Deportes antes del inicio del año escolar. En la resolución se determinarán, como mínimo, el órgano o entidad responsable de la convocatoria y la organización, la gestión y la financiación de todos los programas.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El Artículo 12 concreta el ámbito y los objetivos del programa de competición&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;“Los programas incluidos en el plan atenderán los siguientes objetivos específicos, dependiendo de los diferentes ámbitos participativos del deporte en edad escolar en los que se enmarquen: 3.Los programas incluidos en el ámbito de la competición escolar se dirigirán a: Desarrollar actividades o competiciones específicas de deporte en edad escolar de modalidades o especialidades deportivas de temporada relacionadas con el ámbito federativo y competitivo. Iniciar y hacer progresar a los niños y niñas deportistas en el rendimiento deportivo. Corresponder la educación en valores y el ámbito competitivo como valor fundamental de la práctica deportiva.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El artículo 14, crea y establece como órgano de gestión la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears, también recoge sus funciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;1&lt;/em&gt;&lt;em&gt; Con el fin de optimizar los recursos, mejorar la coordinación entre todas las administraciones competentes en materia de deporte en edad escolar e integrar y dar continuidad y coherencia a los programas y actividades propuestos, se crea la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears (en adelante CTP), como órgano de gestión en el ámbito del deporte en edad escolar en las &lt;span style="color: black;"&gt;Illes Balears&lt;/span&gt;, adscrito a la Consejería de Turismo y Deportes del Gobierno de las Illes Balears. El presupuesto anual de la CTP queda integrado en el de la Consejería de Turismo y Deportes. Así, la CTP dispone, para cumplir sus finalidades, de los recursos económicos que se le asignen de los presupuestos de la Consejería de Turismo y Deportes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;2 La CTP tiene las siguientes funciones:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;Estudiar las propuestas de programas específicos de deporte para la edad escolar en las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;Proponer la introducción o la supresión de los programas específicos de deporte para la edad escolar en las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;Proponer los criterios generales de desarrollo y de control de las actividades que integran los programas del plan.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;Controlar y evaluar los programas desarrollados y proponer mejoras.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;em&gt;En general, coordinar y desarrollar el Plan de Actividad Física y Deportiva para la Edad Escolar en las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;También hay que considerar de manera especial el que regula el Artículo 15 que establece el régimen de organización, desarrollo y ejecución de las actividades, y el artículo 16 que habla de las instalaciones deportivas y de la necesaria colaboración institucional, así como el que recoge el artículo 17 sobre la futura regulación de la formación, la experiencia o las titulaciones mínimas requeridas al personal técnico responsable del desarrollo de las actividades. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;1. Aprobar el programa de competición autonómico del Plan de la actividad física y deportiva para la edad escolar de las Illes Balears de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;2. Convocar las finales del Programa de competición del deporte para la edad escolar de las Islas Baleares de 2017, en las cuales pueden tomar parte los consejos insulares de Mallorca, Menorca, Ibiza y Formentera representados por sus equipos y/o deportistas que se han clasificados dentro del programa de competición insular, de acuerdo con el que establecen esta Resolución, las normas generales de organización y desarrollo de los campeonatos y los reglamentos técnicos específicos de cada modalidad deportiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;3. Establecer el contenido&amp;nbsp; del programa de competición del año 2017 (deportes, categorías, islas sedes y el mes del campeonato), de acuerdo con la propuesta de la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears de 6 de octubre de 2015 los deportes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;La Dirección general de Deportes y Juventud publicará en su página web, las normas generales de organización y desarrollo de las competiciones programadas, los reglamentos técnicos de cada modalidad deportiva y el reglamento de disciplina deportiva. Estos documentos se elaboran en colaboración con los consejos insulares y las federaciones deportivas y tienen que ser analizados por la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;La inscripción de los deportistas y equipos de las diferentes islas a la final de esta competición es responsabilidad de los consejos insulares de Mallorca, Menorca, Ibiza y Formentera, de acuerdo con las fechas, los plazos y todo aquello que determinen las normas generales de organización y desarrollo, y los criterios aprobados por la Comisión Técnica Permanente del Plan de la Actividad Física y Deportiva para la Edad Escolar en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;4. Financiar, el programa de competición autonómico del Plan de la actividad física deportiva para la edad escolar de las Illes Balears de 2017, con los presupuestos de la Consejería de Transparencia, Cultura y Deportes del Gobierno de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;5. Ordenar que esta Resolución se publique en el Boletín Oficial de las Illes Balears y en la página web de la Dirección general, de Deportes y Juventud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Contra esta Resolución, que no agota la vía administrativa, las personas interesadas pueden interponer un recurso de alzada ante la consejera de Transparencia, Cultura y Deportes, en el plazo de un mes, a contar desde el día siguiente de haberse publicado esta Resolución, de acuerdo con el que se establece a los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y el que se establece en el artículo 58 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
