En fecha 11 de noviembre de 2016 la Fundación Balear de Innovación y Tecnología presenta ante la Vicepresidencia y Consejería de Innovación, Investigación y Turismo la documentación justificativa de la actualización de tarifas de servicios de Call Center y de nuevos servicios de banda ancha que se proponen para la ejecución de los encargos que hagan a la Fundación Balear de Innovación y Tecnología la Administración de la Comunidad Autónoma de las Islas Baleares y el resto de poderes adjudicadores.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fundamentos de derecho</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El Texto refundido de la Ley de contratos del sector público, aprobado por el Real decreto legislativo 3/2011, de 14 de noviembre y, en particular, los artículos 4.1 n y 24.6 del Texto refundido mencionado.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Decreto 147/2000, de 10 de noviembre, sobre contratación de la Comunidad Autónoma de las Islas Baleares y, en particular, el artículo 9 del Decreto mencionado.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Los Estatutos de la Fundación Balear de Innovación y Tecnología, autorizados por el Acuerdo del Consejo de Gobierno de 26 de julio de 2013 y, en particular, el artículo 4 de este Estatuto.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Por todo esto, dicto la siguiente </span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Resolución</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprobar la actualización de tarifas de servicios de Call Center y de nuevos servicios de banda ancha aplicables a los encargos que hagan a la Fundación Balear de Innovación y Tecnología la Administración de la Comunidad Autónoma de las Islas Baleares y el resto de poderes adjudicadores, según los siguientes puntos:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a. Las tarifas mencionadas, aprobadas por el Patronato de la Fundación el 11 de noviembre de 2016, que incluyen todos los costes directos e indirectas imputables al encargo de gestión, y a las cuales habrá que añadir, si procede, el impuesto sobre el valor añadido vigente, se tienen que aplicar en función del tipo de servicio y de las unidades contratadas que se asignen a la ejecución de los encargos en los términos que se indican en el anexo de esta resolución.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b. En los casos en que para gestionar o ejecutar mejor los encargos se exija o se haga recomendable la subcontratación de actividades a terceras personas, las tarifas que tenga que percibir la Fundación Balear de Innovación y Tecnología por razón del encargo se tienen que incrementar por un importe inherente al coste que tiene que atender la Fundación por razón de la subcontratación de la actividad y/o bienes y servicios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c. Sin perjuicio de estas tarifas de aplicación general, se pueden aprobar tarifas específicas por los encargos que lo requieren por consideración a sus particularidades, por medio de otra resolución del consejero de Economía y Competitividad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Notificar esta Resolución a la Fundación Balear de Innovación y Tecnología.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.
