Aprobación inicial expediente colectivo de anulación/cancelación de los saldos pendientes de pago, correspondientes al ejercicio 2012 y anteriores]] ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Pleno del Ayuntamiento de Palma de día 27 de octubre de 2016 aprobó inicialmente el expediente colectivo de anulación / cancelación de los saldos pendientes de pago, correspondientes al ejercicio 2012 y&nbsp; anteriores&nbsp; por los conceptos e importes contenidos &nbsp;en este mismo anuncio, que asciende a 214.280,29&nbsp; €.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Al no existir normativa propia el Texto Refundido de la Ley Reguladora de la Hacienda Local (TR LRHL), aprobada por RDL 2/2004&nbsp; de 5 de marzo, se considera aplicable supletoriamente lo establecido en el articulo 25 de la Ley 47/2003, de 26 de noviembre, General Presupuestaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Será también de aplicación lo establecido en:</span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Ley 30/1992, de 26 de noviembre, del Régimen Jurídico de las Administraciones Públicas y del Procedimiento administrativo común.</span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Orden EHA/4041/2004, de 23 de noviembre, que aprueba la Instrucción del Modelo Normal de Contabilidad Local</span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Ley 7/1985, de 2 de abril Reguladora de las Bases del Régimen Local.</span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Código Civil.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">De los antecedentes normativos expuestos y según el informe emitido por el departamento económico, se concluye que existen los saldos pendientes de pago dentro del plazo de prescripción, así como se constata que los interesados de cada uno de ellos no han practicado ninguna gestión que implique el ejercicio de &nbsp;su derecho, motivo por el cual se puede incoar el expediente para declarar la prescripción de los saldos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Así, se ha procedido a relacionar los saldos pendientes de pago susceptibles de ser incluidos en el expediente, correspondientes al ejercicio 2012 y anteriores, según el siguiente detalle de trámites seguidos:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En primer lugar se relacionan aquellos expedientes en los que se han iniciado trámites para&nbsp; preceptivo el trámite de audiencia a los interesados, titulares de los créditos, que puedan resultar afectados para la decisión de la modificación/declaración de prescripción de los saldos, es por el que se procede a la exposición pública de cada uno de los saldos relacionados del acuerdo de aprobación inicial del expediente de prescripción, para que puedan presentar las reclamaciones que crean oportunas, otorgándoles trámite de audiencia por un plazo de quince días contados a partir del siguiente de esta publicación. Una vez finalizado el plazo mencionado, si se han presentado reclamaciones, el Pleno dispondrá de un plazo de tres meses para resolverlas y en su caso, aprobar definitivamente la declaración de prescripción.
