text/html 240 2016-11-09 CAIB 12687 ![CDATA[<div> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Ref Base Datos Nacional de Subvenciones: 314924</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresidente primero y consejero ejecutivo de Cultura, Patrimonio y Deportes ha dictado, el 7 de noviembre de 2016, la resolución que transcribo literalmente a continuación:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Antecedentes</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El vicepresidente primero y consejero ejecutivo de Cultura, Patrimonio y Deportes aprobó, mediante resolución de 3 de agosto de 2016, la convocatoria de subvenciones 2016 para proyectos de actividades culturales con motivo de la celebración del VII centenario de la muerte del beato Ramón Llull, y las bases que la rigen. Esta resolución se publicó en el Boletín Oficial de las Islas Baleares núm. 105, de 18 de agosto de 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. La comisión técnica de evaluación emitió, mediante acta de sesión de 7 de octubre de 2016, el informe propuesta relativo a la concesión de la convocatoria de subvenciones 2016 para proyectos de actividades culturales con motivo de la celebración del VII centenario de la muerte del beato Ramón Llull, previsto en la base decimocuarta de la convocatoria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El 7 de octubre de 2016, el órgano instructor ha emitido el informe sobre el cumplimiento de los requisitos de las bases de la convocatoria mencionada por parte de las entidades beneficiarias propuestas y la Unidad Jurídica Administrativa de Cultura ha emitido informe favorable sobre los aspectos jurídicos de la concesión de las subvenciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Día 27 de octubre de 2016 la Intervención General ha emitido informe favorable de fiscalización de la propuesta de resolución de la convocatoria. A pesar de la deficiencia indicada por la Intervención General de no cumplir con el principio de anualidad presupuestaria, el Consejero de Economía autorizó, de manera excepcional continuar con la tramitación del expediente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. La existencia de crédito presupuestario adecuado y suficiente en la partida presupuestaria 20.33460.48900 (RC con el núm. de referencia 22016/000234) del presupuesto de gastos del Consejo de Mallorca del ejercicio 2016, según lo establecido en &nbsp;la base quinta de la convocatoria (dotación presupuestaria total 100.000,00 €), así como el contenido del acta de la comisión técnica de evaluación de 7 de octubre de 2016, para atender la concesión de las subvenciones propuestas, con el importe total a conceder de 100.000,00 €.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fundamentos de derecho</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La base decimocuarta de la convocatoria establece que la comisión técnica de evaluación es la encargada de estudiar y evaluar las solicitudes &nbsp;así como de fijar el importe de las subvenciones de las solicitudes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El segundo párrafo de la base octava recoge que el procedimiento de selección de las entidades beneficiarias se lleva a cabo mediante concurrencia competitiva, en virtud de la cual se comparan, en un único procedimiento todas las &nbsp;solicitudes presentadas, con la intención de establecer una prelación a cada modalidad a traves de los criterios de evaluación previstos en la base decimotercera de esta convocatoria y, de este modo, conceder las subvenciones a las &nbsp;solicitudes que han obtenido una mayor puntuación, dentro de los límites recogidos en la base duodécima y hasta el importe del crédito presupuestario establecido.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Dado que el crédito presupuestario no es suficiente para satisfacer el importe total de la solicitud admitida, teniendo en cuenta los proyectos presentados y los límites aplicables en la determinación de este importe, la comisión fija por unanimidad los importes de la subvención para cada proyecto.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El párrafo quinto del artículo 24.4 de la Ley 38/2003, de 17 de noviembre, general de subvenciones establece que en el expediente debe haber un informe del órgano instructor en el que conste que, en virtud de la información de que se dispone, se desprende que los beneficiarios propuestos cumplen los requisitos establecidos en las bases de la convocatoria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. El cuarto párrafo de la base octava establece que el órgano encargado de resolver la convocatoria es el vicepresidente primero y consejero ejecutivo de Cultura, Patrimonio y Deportes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Dados los antecedentes y fundamentos de derecho expuestos, y en el ejercicio de las atribuciones que tengo conferidas, de acuerdo con el Decreto de organización del Consejo de Mallorca vigente y con las bases de ejecución del presupuesto del Consejo de Mallorca del año 2016, <strong>RESUELVO:</strong></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1- Conceder la cantidad total de 100.000,00 € a favor de la entidad Obispado de Mallorca, con NIF R0700002I, y disponer el gasto a su favor, por los importes y para los proyectos que se indican en el anexo 1, con cargo a la partida presupuestaria 20.33460.48900, RC con el núm. de referencia 22016/000234, de acuerdo con lo establecido en las bases de la convocatoria de subvenciones 2016 para proyectos de actividades culturales con motivo de la celebración del VII centenario de la muerte del beato Ramón Llull (BOIB núm. 105, de 18 de agosto de 2016).</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Comunicar esta resolución a la Intervención General del Consejo Insular de Mallorca</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Publicar esta resolución en el BOIB, por conducto de la base de datos nacional de subvenciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra esta resolución, que no pone fin a la vía administrativa, puede interponerse el recurso de alzada ante la presidencia del Consejo de Mallorca, en el plazo de un mes, contado a partir del día siguiente de su publicación en el Boletín Oficial de las Islas Baleares.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra la desestimación expresa del recurso de alzada se puede interponer el recurso contencioso administrativo, en el plazo de dos meses, contados a partir del día siguiente de recibir la notificación de la desestimación del mencionado recurso.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Una vez transcurridos tres meses desde la interposición del recurso de alzada sin que se haya notificado la resolución, puede interponer el recurso contencioso administrativo, contra la desestimación presunta del recurso mencionado, sin limitación temporal, mientras no haya resolución expresa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstante, se puede interponer, en su caso, cualquier otro recurso que considere oportuno, todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, y de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Palma, 9 de noviembre de 2016</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>El secretario técnico del Departamento de Cultura Patrimonio y Deportes, por delegación</strong><br /> (Resolución de delegación de competencias del vicepresidente primero y consejero<br /> ejecutivo de Cultura, Patrimonio y Deportes de 15/03/2016;
