	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;El Pleno del Ayuntamiento, en sesión ordinaria de día 10 de octubre de 2016, adoptó el acuerdo que – a reserva de los términos definitivos que resulten de la aprobación del acta correspondiente – a continuación se transcribe:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;“&lt;strong&gt;Propuesta de la delegada de Recursos Humanos de modificación del artículo 29 del pacto/convenio de los empleados públicos del Ayuntamiento de Manacor.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;La Sra. Sansó Jaume da cuenta de la propuesta, dictaminada previamente por la Comisión Informativa General y Especial de Cuentas de día 3 de octubre de 2016, que a continuación se transcribe:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;“PROPUESTA DE LA DELEGADA DE RECURSOS HUMANOS A LA COMISIÓN INFORMATIVA GENERAL PARA SU POSTERIOR ELEVACIÓN AL AYUNTAMIENTO EN PLENO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Acuerdo de la Mesa General Negociadora Común al personal funcionario y laboral, aprobado por unanimidad en la sesión extraordinaria núm. 3/2016, de 7 de septiembre, de elevar este acuerdo al Ayuntamiento en Pleno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;Art. 3 del Real Decreto Legislativo 5/2015, de 30 de octubre, por el cual se aprueba el Texto Refundido de la Ley del Estatuto Básico del Empleado Público y legislación de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;PROPUESTA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Modificar el pacto/convenio de los empleados públicos del Ayuntamiento de Manacor, que quedará redactado según se establece a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;a) Modificar el artículo 29 C b) 5. al objeto de modificar la vigencia de este artículo hasta día 31 de diciembre de 2017 y que queda redactado de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 80px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;“Artículo 29 C b) 5. Hasta el 31 de diciembre de 2017, el personal funcionario de carrera y el personal laboral fijo podrá solicitar un permiso por asuntos propios con una duración máxima de seis meses anuales, sin derecho a percibir retribuciones, durante los cuales tendrán derecho a reserva de lugar de trabajo y al cómputo de tiempo a efectos de trienios y grado personal, con la obligación de cotizar lo que corresponda de acuerdo con la normativa vigente. La concesión de esta licencia, que será discrecional, está supeditada, en todo caso, a las necesidades del servicio y no supondrá la autorización para la contratación o el nombramiento de personal temporal sustituto”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;b) Modificar el artículo 29 bis 1. al objeto de modificar la vigencia de este artículo hasta día 31 de diciembre de 2017 y que queda redactado de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 80px;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;“Artículo 29 bis 1. Hasta el 31 de diciembre de 2017, el personal funcionario de carrera y el personal laboral fijo podrán solicitar una excedencia voluntaria especial con duración mínima de seis meses y máxima de tres años, durante la cual tendrán derecho a la reserva del puesto de trabajo y al cómputo del tiempo de excedencia a efectos de trienios y grado personal.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family: times new roman,times,serif;"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Elevar este acuerdo al pleno del Ayuntamiento para su aprobación y posterior publicación en el BOIB. Su vigencia empezará a partir del día siguiente de la mencionada publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
