	&lt;span style="font-family:times new roman,serif;"&gt;Notificación de Resolución&lt;/span&gt; de desistimiento a los beneficiarios de las ayudas, R1 de fecha 7 de octubre de 2016, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 19 de febrero de 2015 por la que se convocan subvenciones para la Protección de variedades autóctonas en riesgo de erosión genética, para los años 2015 a 2019.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,serif;"&gt;El apartado&lt;/span&gt;&lt;span style="font-family:times new roman,serif;"&gt; 9.3&lt;/span&gt;. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, subvenciones para la Protección de variedades autóctonas en riesgo de erosión genética, correspondientes a los años 2015-2019, &amp;nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt; Islas Baleares &lt;/em&gt;de acuerdo con los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,serif;"&gt;Los expedientes&lt;/span&gt;&lt;span style="font-family:times new roman,serif;"&gt; han sido&lt;/span&gt; tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,serif;"&gt;El vicepresidente&lt;/span&gt;&lt;span style="font-family:times new roman,serif;"&gt; del &lt;/span&gt;FOGAIBA, con fecha 14 de octubre de 2016, firmó la siguiente resolución,&lt;/p&gt;

	&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Convocatoria: VREG 2015_ RDS1&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Antecedentes&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;1. Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;2. Con fecha de 28 de febrero de 2015 se publicó en el BOIB núm. 30, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas a la protección de variedades autóctonas en riesgo de erosión genética.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;3. Con fecha 11 de junio de 2015 se publicó en el BOIB núm. 87, una modificación de la Resolución citada anteriormente&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;4. De conformidad con el apartado sexto de la mencionada Resolución y el orden AAA / 872/2015 de 2 de mayo, publicado en el BOE núm.114 del 05/13/2015, el plazo de presentación de solicitudes de la convocatoria terminó el día 06/15/2015, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 71 solicitudes de ayuda para la protección de variedades autóctonas en riesgo de erosión genética (convocatoria 2015)&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;6. De acuerdo lo previsto en el apartado 6.5. de la convocatoria se requirió, a las personas que figuran en el Anexo I, el certificado de pertenecer a alguna asociación o agrupación de agricultores y / o productores que tenga como objetivo la conservación o el mantenimiento de los cultivos en peligro de erosión genética &lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;7. A fecha de hoy las personas que figuras en el anexo I no han presentado dicho documento, y como prevé la convocatoria (punto 8 del apartado 6), se entiende que desisten de su solicitud de ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;1. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;17. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;18. Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Propuesta de resolución de desistimiento/ renuncia&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

	&lt;li&gt;
		&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Informar a los interesados que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle Reina Constança, núm. 4 de Palma).&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
	&lt;li&gt;
		&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Publicar la Resolución en el BOIB.&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-family:times new roman,serif;"&gt;Interposición de recursos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
