&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;En el presente procedimiento ORDINARIO 214/2015 seguido a instancia de ALBERTO RUPEREZ DE MIGUEL Y ALMUDENA RUPEREZ DE&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;MIGUEL frente a RAFAL MAREK MLYNARCKUZ se ha dictado sentencia, cuyo tenor literal es el siguiente:&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 160px;"&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;&amp;nbsp; SENTENCIA&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;N&lt;/span&gt;&lt;span style="color: rgb(35, 31, 32);"&gt;2&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;290/2016&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;En Ibiza,&lt;/span&gt; a &amp;nbsp;26 de septiembre de 2.016.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;D. ALFONSO&lt;/span&gt; MANUEL FERNANDEZ GARCIA, Magistrado-Juez Titular del Juzgado del Primera Instancia nº 2 de Ibiza, habiendo visto los autos seguidos en este Juzgado al Juicio Ordinario número 214/2015, a instancia de la procuradora Doña ANA LOPEZ WOODCOCK, en nombre y representación de D. ALBERTO RUPEREZ DE MIGUEL y Doña ALMUDENA RUPEREZ DE MIGUEL, como parte demandante, con la asistencia del letrado D. FRANCISCO JAVIER MARIÑO GONZÁLEZ, contra D. RAFAL MAREK MLYNARCZUK, como parte demandada, declarada en situación de rebeldía procesal, &amp;nbsp;procede&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;EN NOMBRE&lt;/span&gt; DE S.M. EL REY &lt;span style="color: rgb(35, 31, 32);"&gt;a &amp;nbsp;dictar&lt;/span&gt; la presente resolución&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;PARTE&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;DISPOSITIVA&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;Que&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;estimando&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;las&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;pretensiones&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;deducidas&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;a instancia&lt;/span&gt; de D. ALBERTO RUPEREZ DE MIGUEL y Doña ALMUDENA RUPEREZ DE MIGUEL, como parte demandante, contra D. RAFAL MAREK MLYNARCZUK, como parte demandada, declarada en situación de rebeldía procesal, debo condenar y condeno a ésta a abonar a la actora la cantidad de 26.123,48 euros, más las mensualidades que se devenguen &lt;span style="color: rgb(35, 31, 32);"&gt;con posterioridad&lt;/span&gt; a la presentación de la demanda a razón de 6.530,87 euros mensuales hasta el mes de octubre de 2016, inclusive, y los intereses de todas las sumas impagadas, al tipo del 10 % anual pactado, lo que se fijará en ejecución de sentencia, y con condena en las costas ocasionadas en el presente procedimiento.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;Notifíquese&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;la&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;presente&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;resolución&lt;/span&gt; &lt;span style="color: rgb(35, 31, 32);"&gt;a las&lt;/span&gt; partes, haciéndoles saber que contra la misma podrá interponerse en este Juzgado recurso de apelación dentro del término de VEINTE días, a partir de su notificación, y cuyo conocimiento le corresponderá a la Audiencia Provincial, de conformidad con lo dispuesto en el art. 458 y siguientes de la LEC.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;Así por esta mi sentencia,&lt;/span&gt; la pronuncio, mando y firmo.&lt;/p&gt;
&lt;p&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;Y como consecuencia&lt;/span&gt; del ignorado paradero de RAFAL MAREK MLYNARCKUZ, se extiende la presente para que sirva de cédula de notificación.&lt;/p&gt;
&lt;p style="margin:0px;text-align:left;"&gt;
	&lt;span style="color: rgb(35, 31, 32);"&gt;En IBIZA/EIVISSA, a veintisiete de septiembre de dos mil dieciséis.&lt;/span&gt;&lt;/p&gt;
