El 15 de agosto de 2016, la jefa del Departamento de Formación y Selección, una vez elaborado el Plan de Formación de Seguridad y Emergencias, que incluye la oferta de cursos de las áreas de policía, emergencias, seguridad, bomberos y protección civil para el segundo semestre del año 2016, y las instrucciones aplicables, emitió un informe propuesta sobre esta oferta, con la finalidad de aprobar la convocatoria correspondiente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. En la sesión de 8 de septiembre de 2016, el Consejo de Dirección, en ejercicio de la función que establece el artículo 11.2 <em>e</em> del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública, aprobó el Plan de Formación de Seguridad y Emergencias, que incluye la oferta de cursos para el segundo semestre del año 2016 dirigidos al personal de las áreas de policía, emergencias, seguridad, bomberos y protección civil (anexo 1), y las instrucciones por las que se rigen estos cursos (anexos 2 y 3).</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Fundamentos de derecho</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1. De acuerdo con lo que establece el artículo 12 de la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Islas Baleares, corresponde a la Escuela Balear de Administración Pública (EBAP) la formación, la capacitación y el perfeccionamiento del personal al servicio de la Administración autonómica y de las entidades que dependen de ésta. Asimismo, esta norma añade que, en los términos que se establezcan, corresponde a la EBAP la realización de actividades formativas y de selección del personal al servicio de las otras administraciones del ámbito territorial de las Islas Baleares.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. El artículo 1 del Decreto 191/1996, de 25 de octubre, por el que se regulan las condiciones generales de las actividades formativas que organiza la Consejería de Interior (actualmente, Consejería de Hacienda y Administraciones Públicas), indica que el Instituto Balear de Administración Pública (actualmente, Escuela Balear de Administración Pública) es el principal instrumento de la política formativa de la Administración pública de las Islas Baleares, y elabora periódicamente diferentes planes de formación que responden a los principios de eficacia y de calidad de las actividades formativas, con la finalidad de favorecer la participación del personal al servicio de la Administración.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3. El artículo 5.9 del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública, incluye, entre sus funciones, la promoción, la organización y la gestión de la formación de capacitación, reciclaje y perfeccionamiento del personal de los cuerpos de policía local y, si procede, autonómica; de los integrantes de los servicios de prevención y extinción de incendios; del voluntariado de protección civil; del personal de salvamento y de rescate, y de los servicios públicos de emergencias sanitarias extrahospitalarias en el ámbito territorial de la comunidad autónoma de las Islas Baleares.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4. El artículo 28.1 de Ley 4/2013, de 17 de julio, de Coordinación de las Policías Locales de las Islas Baleares dispone que, de acuerdo con el artículo 3 de esta ley, corresponde a la consejería competente en materia de coordinación de policías locales, mediante la Escuela Balear de Administración Pública, el ejercicio de las competencias relacionadas con la formación de los miembros de los cuerpos de policía local para asegurar su homogeneización y la coordinación, además de otras que tenga atribuidas.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5. La Ley 59/2003, de 19 de diciembre, de Firma Electrónica, regula este tipo de firma, su eficacia jurídica y la prestación de servicios de certificación.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">De acuerdo con las atribuciones que me otorga el artículo 9 del Decreto 31/2012, dicto la siguiente</span></span></p> <p style="text-align: center;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>RESOLUCIÓN</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1. Aprobar la convocatoria de cursos que se ofrecen al personal de las áreas de policía, emergencias, seguridad, bomberos y protección civil de las Islas Baleares según el Plan de Formación de Seguridad y Emergencias aprobado por el Consejo de Dirección de la EBAP para el segundo semestre del año 2016, de acuerdo con lo que establece el anexo 1 de esta Resolución.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2. Publicar las instrucciones generales que rigen el desarrollo de este plan de formación, aprobadas por el Consejo de Dirección, de acuerdo con lo que establece el anexo 2 de esta Resolución.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3. Publicar las instrucciones específicas que rigen el desarrollo de este plan de formación, aprobadas por el Consejo de Dirección, de acuerdo con lo que establece el anexo 3 de esta Resolución.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4. Publicar esta Resolución en el <em>Boletín Oficial de las Islas Baleares</em>.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Interposición de recursos </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Contra esta Resolución —que agota la vía administrativa— se puede interponer un recurso potestativo de reposición ante la presidenta de la EBAP en el plazo de un mes, a contar a partir del día siguiente al de la publicación en el <em>Boletín Oficial de las Islas Baleares</em>, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; Número máximo de solicitudes</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Las personas interesadas pueden solicitar un máximo de cinco cursos presenciales. Debe rellenarse una solicitud para cada curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">En ningún caso, la persona interesada puede asistir dos veces a la misma actividad formativa, aunque se trate de ediciones diferentes. El plazo de inscripción a los cursos correspondientes al segundo semestre del Plan de Formación Policial es del 9 al 18 de septiembre. En lo referente al plazo de inscripción a los cursos correspondientes al segundo semestre del Plan de Formación de Voluntarios de Protección Civil, los periodos de inscripción serán específicos para cada actividad formativa. Se informará de estos periodos de inscripción una vez que estén cerradas las fechas de impartición de los cursos. El periodo de inscripción estará relacionado con las fechas del curso, y se concederá un mínimo de siete días naturales para poder inscribirse a la actividad formativa.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.3. Es de aplicación a estos planes de formación la Instrucción del gerente de la Escuela Balear de Administración Pública (EBAP) de 2 de noviembre de 2011 por la que la EBAP deja de reproducir material didáctico en formato de papel y en formato de CD para los cursos que organiza. Salvo excepciones debidamente justificadas, el material didáctico de los cursos se publicará en el repositorio de material que hay en la página web &lt;http://ebap.caib.es&gt;.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. En ningún caso, el material didáctico se enviará por correo electrónico. Listas de personas admitidas </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.1. La EBAP publicará en la página web &lt;http://ebap.caib.es&gt; la lista de personas admitidas, y también comunicará individualmente la admisión mediante la dirección electrónica adscrita al número de registro de personal o, en su caso, la dirección electrónica facilitada en la solicitud en papel o en la matrícula por Internet.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.2. En caso de que las personas solicitantes hayan cambiado de dirección electrónica, deben informar de ello a la EBAP. También tienen que informar a la EBAP si ya no es operativa la dirección electrónica que facilitaron en un principio.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5.3. En el caso de los empleados públicos de la Comunidad Autónoma de las Islas Baleares, la admisión a los cursos, sea cuál sea el horario de impartición, no supone ninguna autorización de la EBAP para dejar el puesto de trabajo si el curso coincide con el horario laboral.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 6. Anulación y modificación de los cursos y resolución de casos especiales</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.1. La EBAP, para desarrollar mejor las funciones que tiene encomendadas, puede suprimir cursos, organizar cursos no programados con anterioridad por necesidades puntuales que hayan surgido, efectuar varias ediciones de cursos siempre que las circunstancias lo aconsejen así, y modificar, si es pertinente, los contenidos, la duración, las fechas y los programas anunciados para adaptarlos a los requerimientos de la formación.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.2. Corresponde a la jefa del Departamento de Formación y Selección de la EBAP, a propuesta de los jefes de estudios correspondientes, y una vez consultado el Servicio Jurídico de la EBAP, resolver las dudas, las confusiones o las incidencias que puedan surgir sobre la aplicación de estas instrucciones, o sobre los casos concretos que no se prevean o surjan de manera excepcional.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6.3. Los comportamientos y las actitudes de los participantes que impidan que los cursos se desarrollen con normalidad podrán dar lugar a la exclusión del alumnos, o a modificar o cancelar los cursos, con el informe justificativo de la jefa del Departamento de Formación y Selección de la EBAP, a propuesta de los jefes de estudios correspondientes.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 7. Lista de espera</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">7.1. En todas las actividades formativas se pueden establecer plazas de reserva para cubrir las bajas o las renuncias que se den. La lista de espera se publicará en la página web &lt;http://ebap.caib.es&gt; en el momento de la selección, y se actualizará, permanentemente, de manera interna.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">7.2. En cualquier caso, corresponde a la EBAP la confirmación y la comunicación de la admisión a un curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 8. Obligación de asistencia y comunicación de baja. Penalización</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>8.1. Modalidad presencial</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.1 Con la solicitud se contrae la obligación de asistir o acceder a la actividad formativa, según la modalidad de impartición. Si no se puede asistir a un curso, debe comunicarse por escrito a la EBAP y justificarse, como mínimo, cinco días hábiles antes de su inicio. El hecho de no comunicar una baja será causa de exclusión, durante un año, para otros cursos que la EBAP organice con posterioridad.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">No obstante, la asistencia a un mínimo del 50 % de la actividad formativa no representa motivo de penalización.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.2. Las ausencias superiores a los límites fijados (20 %), aunque estén justificadas, suponen la pérdida del derecho a obtener el certificado de asistencia y el certificado de aprovechamiento que se regulan en el punto 10 de estas instrucciones.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.3. Las personas admitidas tienen la obligación de asistir a la primera hora del primer día del curso. En caso de que no asistan sin haberlo justificado previamente en la EBAP, su plaza podrá ser ocupada por personas que asistan en la modalidad de «último minuto», de acuerdo con lo que establece la Resolución de la presidenta de la EBAP de 11 de julio de 2009.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">8.1.4. Las personas en la situación de incapacidad temporal —excepto las que están en situación de licencia por maternidad o paternidad y excedencia por maternidad o paternidad, o cuidado de familiares— no pueden asistir a ninguna de las actividades formativas de los planes de Formación Policial; de Voluntarios de Protección Civil, y de Seguridad, Emergencias y Bomberos, que hay en el anexo 1 de esta Resolución. Esta circunstancia se tiene que comunicar por escrito, para que, si procede, se pueda cubrir la plaza vacante con otra persona y para evitar la penalización.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>8.2. Modalidad en línea</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Los cursos de la modalidad en línea correspondientes al Plan de Formación Policial; al Plan de Formación de Seguridad, Emergencias y Bomberos, y al Plan de Formación de Voluntarios de Protección Civil de 2016 se rigen por las instrucciones del Plan de Formación General y de Formación Sectorial de 2016.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 9. Número de personas asistentes</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">9.1. En general, los cursos deben tener entre quince y treinta alumnos. Esta cifra puede aumentar o disminuir sólo en caso de que la materia del curso o la estructura de la actividad formativa lo permitan o lo recomienden.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">9.2. Se pueden suspender los cursos que tengan un número de inscritos y no excluidos inferior al 70 % de las plazas ofrecidas o menos de quince personas inscritas y no excluidas en Mallorca; o inferior al 70 % o menos de diez personas inscritas y no excluidas en Menorca y en Ibiza; o inferior al 70 % o menos de siete personas inscritas y no excluidas en Formentera.</span></span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 10. Certificados de aprovechamiento o de asistencia</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.1. Las actividades objeto de esta convocatoria dan lugar a obtener el certificado de asistencia o de aprovechamiento, según corresponda.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2. Certificado de asistencia</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.1. El certificado de asistencia se entregará a los alumnos que acrediten una asistencia, como mínimo, del 80 % de las horas lectivas del curso. No se computarán las firmas de los asistentes que correspondan a los días en los que la persona interesada haya estado en la condición de incapacidad temporal.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.2. La única forma de demostrar la asistencia a un curso es mediante la firma; por eso, los alumnos deben asegurarse de que han firmado la hoja de control de entrada y de salida de cada una de las sesiones del curso a las que asistan.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.3. Por otra parte, la falsificación de la firma supone la pérdida del derecho a certificado y la exclusión de los cursos de la EBAP durante un año. En cualquier caso, la firma tiene que coincidir con la del DNI o con la de la solicitud de inscripción. La penalización se hará extensible a la persona autora de la falsificación, independientemente de todas las otras acciones que se ajusten al derecho que se puedan llevar a cabo.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.2.4. En ningún caso, los cursos de la modalidad en línea dan lugar a obtener el certificado de asistencia.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.3. Certificado de aprovechamiento</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">La obtención del certificado de aprovechamiento obliga a demostrar el conocimiento de las materias del curso. Este conocimiento será evaluado mediante la superación de pruebas escritas u orales, trabajos u otros ejercicios relacionados con el contenido de la actividad formativa, o mediante la evaluación continuada certificada por el profesorado.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">10.4. Evaluación de la transferencia</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">La EBAP puede establecer los mecanismos necesarios para evaluar la transferencia de la formación al puesto de trabajo del alumnado, con el objetivo de valorar la contribución de la formación a la mejora del desempeño individual y organizacional.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 11. Lista de personas con derecho al certificado de aprovechamiento o al certificado de asistencia. Solicitud de certificado y reclamaciones</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.1. En el plazo de un mes, a contar desde la finalización del curso, la EBAP publicará en la página web &lt;http://ebap.caib.es&gt; la lista de personas participantes que tienen derecho al certificado de asistencia o al certificado de aprovechamiento.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.2. Se pueden presentar reclamaciones en el plazo de treinta días naturales, a contar a partir del día siguiente de la publicación de la lista de personas participantes que tienen derecho al certificado de asistencia o al certificado de aprovechamiento. Una vez finalizado este plazo y resueltas las reclamaciones, el acta del curso será definitiva.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">11.3. Si no se solicita expresamente lo contrario, la EBAP utilizará la vía del correo electrónico para enviar, con la firma digital, los certificados de asistencia y de aprovechamiento.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>&nbsp;&nbsp;&nbsp; </strong></span></span></p> <p style="text-align: center;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Anexo 3<br /> Instrucciones sobre las actividades formativas programadas del Plan de Formación Policial, del Plan de Formación de Seguridad, Emergencias y Bomberos, y del Plan de Formación de Voluntarios de Protección Civil para el segundo semestre del año 2016 de la Escuela Balear de Administración Pública (EBAP)</strong></span></span></p> <p style="text-align: center;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Instrucciones específicas del Plan de Formación Policial de 2016</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 1. Modalidades de inscripción a los cursos</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Las personas destinatarias del Plan de Formación Policial de 2016 pueden tramitar la solicitud por medio de dos procedimientos:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>a) </em>Mediante la matriculación por Internet. Para matricularse, se tiene que acceder a la página web &lt;http://ebap.caib.es&gt;; a continuación, se tiene que acceder a &lt;Plans de formación del EBAP 2016&gt;; a continuación, se tiene que acceder al plan específico; finalmente, se tiene que acceder a la matriculación mediante la ficha de cada curso.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>b)</em> Mediante el impreso habilitado a este efecto, en el cual tiene que hacer constar todos los datos que se piden, incluida la dirección electrónica, que es la herramienta para comunicar la admisión a los cursos. La falta de datos puede ser motivo de exclusión. Las solicitudes se tienen que presentar en el Registro General del EBAP, en el de la Consejería de Hacienda y Administraciones Públicas, o de acuerdo con cualquiera de las formas que determina la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 2. Presentación de documentación </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.1. Se tiene que rellenar la solicitud completamente, incluida la dirección de correo electrónico, que es la herramienta que se utiliza para comunicar la admisión a los cursos de formación. Se tiene que escribir el código completo del curso. No se admitirá ninguna solicitud sin los datos profesionales de la persona. En caso de no encontrarse en situación de activo, se tienen que consignar los datos de la última situación profesional. </span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.2. En el momento de rellenar la solicitud, se tiene que firmar una declaración de responsabilidad sobre la veracidad de los datos consignados incluida en el mismo trámite telemático, o en el impreso de solicitud.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.3. Los requisitos de algunos cursos se tienen que acreditar junto con la solicitud y de manera individualizada. Cuando el requisito haga referencia a la necesidad de presentar una propuesta de la prefectura, la propuesta tiene que prever una justificación sobre la idoneidad del alumno o la alumna para el curso en cuestión.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.4. En caso de presentarse la solicitud por vía telemática, esta documentación se tiene que presentar al EBAP o mediante correo electrónico.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 3. Requisitos y condiciones preferentes</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.1. Cuando el plan de formación establezca personas destinatarias preferentes para participar en la actividad formativa, el EBAP comprobará que las personas interesadas cumplen las condiciones preferentes. En caso de no haber aspirantes suficientes, la EBAP podrá hacer extensiva la actividad formativa a aspirantes que no cumplan las condiciones preferentes, pero que tenguin un perfil que se adecue al contenido del curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.2. Cuando un curso establezca un requisito excluyente para participar en la actividad formativa, no se admitirán las solicitudes de las personas interesadas que no lo cumplan.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 4. Selección</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1. Sólo se admitirán las solicitudes que cumplan los requisitos que establece la convocatoria correspondiente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. Si el número de solicitudes de una determinada actividad supera el número de plazas previsto, el EBAP hará la selección correspondiente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Los criterios de prelación de la selección son los siguientes:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1r. Pertenecer al grupo de destinatarios del plan de formación y del curso específico.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2n. La condición de funcionario de carrera en activo. </span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3r. En igualdad de condiciones, tienen preferencia las personas aspirantes que no hayan participado en otras actividades del EBAP convocadas los años 2014 y 2015.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4t. La fecha de presentación de la solicitud.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5è. El hecho de que los solicitantes no estén inmersos en la incoación de un expediente disciplinario.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">6è. El personal adscrito a una administración local que no sea promotora de formación.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.3. Hay cursos en que se tendrá que superar una prueba de selección con unos criterios de evaluación determinados previamente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.4. Si hay actividades presenciales cuyas fechas coincidan parcialmente o totalmente, las personas interesadas sólo serán admitidas en una actividad. No obstante, es posible la admisión a un curso presencial o semipresencial y a un curso en línea cuyas fechas coincidan parcialmente o totalmente y la admisión a dos cursos en línea que coincidan parcialmente o totalmente en las fechas.</span></span></p> <p style="text-align: center;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Instrucciones específicas del Plan de Formación de Voluntarios de Protección Civil de 2016</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 1. Modalidades de inscripción a los cursos</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1.1. Personas con acceso al Portal del personal</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">El personal de la Administración de la Comunidad Autónoma de las Islas Baleares destinatario del Plan de Formación de Voluntarios de Protección Civil que tengui acceso al Portal del personal tiene que tramitar la solicitud directamente desde este portal.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1.2. Personas sin acceso al Portal del personal</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">El personal sin acceso al Portal del personal puede tramitar la solicitud mediante dos procedimientos:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>a)</em> Mediante la matriculación por Internet. En cualquiera de las dos modalidades, la cabeza o la jefa de agrupación tiene que presentar al EBAP una lista del personal que propone para cada uno de los cursos, con la orden de prelación para ser admitido. Para tener la opción de ser admitidos, el requisito es la propuesta de la cabeza o la jefa de agrupación. </span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 3. Requisitos y condiciones preferentes</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.1. Cuando el plan de formación establezca personas destinatarias preferentes para participar en la actividad formativa, el EBAP comprobará que las personas interesadas cumplen las condiciones preferentes. En caso de no haber aspirantes suficientes, la EBAP podrá hacer extensiva la actividad formativa a aspirantes que no cumplan las condiciones preferentes, pero que tenguin un perfil que se adecue al contenido del curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.2. Cuando el curso establezca un requisito excluyente para participar en la actividad formativa, no se admitirán las solicitudes de las personas interesadas que no lo cumplan.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 4. Selección</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1. Sólo se admitirán las solicitudes que cumplan los requisitos que se establecen en la convocatoria correspondiente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.2. Si el número de solicitudes de una determinada actividad supera el número de plazas previsto, el EBAP hará la selección correspondiente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Los criterios de prelación de la selección son los siguientes:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1r. Pertenecer al grupo de destinatarios del curso específico.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2n. En igualdad de condiciones, tienen preferencia las personas aspirantes que no hayan participado en otras actividades del EBAP convocadas los años 2014 y 2015. </span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3r. La fecha de presentación de la solicitud.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4t. El hecho de que los solicitantes no estén inmersos en la incoación de un expediente disciplinario.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">5è. El personal adscrito a una administración local que no sea promotora de formación.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.3. Hay cursos en que se tendrá que superar una prueba de selección con unos criterios de evaluación determinados previamente.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.4. Si hay cursos cuyos horarios coincidan parcialmente o totalmente, las personas interesadas sólo serán admitidas en un curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.5. Modalidades de inscripción a los cursos</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1.1. Empleados con acceso al Portal del personal</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">El personal de la Administración de la Comunidad Autónoma de las Islas Baleares destinatario del Plan de Formación de Seguridad, Emergencias y Bomberos que tengui acceso al Portal del personal tiene que tramitar la solicitud directamente desde este portal.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">1.2. Empleados sin acceso al Portal del personal</span></span></p> <p style="margin:0px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">El personal que no tengui acceso al Portal del personal puede tramitar las solicitudes por medio de dos procedimientos:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>a) </em>Mediante la matriculación por Internet. Para matricularse, se tiene que acceder a la página web &lt;http://ebap.caib.es&gt;; a continuación, se tiene que acceder a &lt;Plans de formación del EBAP 2016&gt;; a continuación, se tiene que acceder al plan específico; finalmente, se tiene que acceder a la matriculación mediante la ficha de cada curso.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>b)</em> Mediante el impreso habilitado a este efecto, en el cual tiene que hacer constar todos los datos que se solicitan, incluida la dirección electrónica, que es la herramienta para comunicar la admisión a los cursos. La falta de datos puede ser motivo de exclusión. Las solicitudes se tienen que presentar en el Registro General del EBAP, en el de la Consejería de Hacienda y Administraciones Públicas, o de acuerdo con cualquiera de las formas que determina la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 2. Presentación de documentación </strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.1. Se tiene que rellenar la solicitud completamente, incluida la dirección de correo electrónico, que es la herramienta que se utiliza para comunicar la admisión a los cursos de formación. Se tiene que escribir el código completo del curso. No se admitirá ninguna solicitud sin los datos profesionales de la persona.</span></span></p> <p style="margin:0px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.2. Junto con la solicitud para cada curso, se tienen que adjuntar el documento siguiente:</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><em>— </em>Fotocopia de la cabecera de la última nómina, en la cual tiene que figurar la relación con la Administración (personal funcionario de carrera, personal funcionario interino, etc.) o, si corresponde, una fotocopia compulsada del nombramiento como funcionario.</span></span></p> <p style="margin:0px;"> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">Se exceptúan de presentar esta documentación las personas que ya la entregaron durante el año 2015 y no han cambiado de situación administrativa ni de administración de procedencia.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">2.3. Los requisitos de algunos cursos se tienen que acreditar junto con la solicitud y de manera individualizada. Cuando el requisito haga referencia a la necesidad de presentar una propuesta de prefectura, la propuesta tiene que prever una justificación sobre la idoneidad del alumno o la alumna para el curso en cuestión.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 3. Requisitos y condiciones preferentes</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.1. Cuando el plan de formación establezca personas destinatarias preferentes para participar en la actividad formativa, el EBAP tiene que comprobar que las personas interesadas cumplen las condiciones preferentes. En caso de no haber aspirantes suficientes, la EBAP podrá hacer extensiva la actividad formativa a aspirantes que no cumplan las condiciones preferentes, pero que tenguin un perfil que se adecue al contenido del curso.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">3.2. Cuando el plan de formación establezca un requisito excluyente para participar en la actividad formativa, no se admitirán las solicitudes de las personas interesadas que no lo cumplan.</span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;"><strong>Punto 4. Selección</strong></span></span></p> <p> <span style="color:#000000;"><span style="font-family: times new roman,times,serif; font-size: 12px;">4.1.
