CAIB ![CDATA[Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se modifica la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), de 6 de noviembre de 2015, por la que se convocan, para el ejercicio 2015, subvenciones para el apoyo a la participación por primera vez en regímenes de calidad]] es 300 CAIB CAIB text/html ![CDATA[<p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Con fecha de 10 de noviembre de 2015, se publicó en el BOIB nº 165 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), de 6 de noviembre de 2015, por la que se convocan, para el ejercicio 2015, las subvenciones para fomentar la participación de agricultores en programas relativos a la calidad alimentaria.</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">En dicha convocatoria se destina un importe total de trescientos treinta y un mil setecientos cinco euros con noventa céntimos (331.705,90 €), con cargo a los presupuestos del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), distribuidos en las anualidades siguientes:</span></span></p> <ul> <li style="margin: 0px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Año 2015: 66.341,18 € </span></span></li> <li style="margin: 0px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Año 2016: 66.341,18 € </span></span></li> <li style="margin: 0px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Año 2017: 66.341,18 € </span></span></li> <li style="margin: 0px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Año 2018: 66.341,18 € </span></span></li> <li style="margin: 0px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Año 2019: 66.341,18 €</span></span></li> </ul> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Por otra parte, se ha detectado un error en el punto 1 del apartado sexto de la Resolución citada, que debe ser corregido, en el sentido que de acuerdo con lo previsto en el artículo 48.2 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, si los plazos se fijan por meses, éstos se computan a partir del día siguiente al día que tenga lugar la publicación del acto del que se trate.</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Finalmente, para evitar que esta rectificación afecte al principio de concurrencia, se estima conveniente modificar el punto 2 del apartado tercero de la Resolución y reabrir el plazo de presentación de solicitudes.</span></span></p> <p align="center"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><strong>RESOLUCIÓN</strong></span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><strong>Primero</strong></span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Se modifica el punto 1 del apartado segundo de la Resolución de 6 de noviembre de 2015 del Presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), por la que se convocan, para el ejercicio 2015, subvenciones para el apoyo a la participación por primera vez en regímenes de calidad, publicada en el BOIB nº 165, de 10 de noviembre de 2015, quedando redactado de la siguiente forma:</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">“1. Para esta convocatoria se destina un importe de trescientos treinta y un mil setecientos cinco euros con noventa céntimos (331.705,90 €), con cargo a los presupuestos del Fondo de Garantía Agraria y times new roman,times,serif;">El importe correspondiente a la anualidad 2016 proviene de remanentes incorporados del ejercicio 2015.</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Dicha cuantía podrá incrementarse con créditos que puedan destinarse a tal fin.”</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><strong>Segundo</strong></span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Modificar el punto 2 del apartado tercero de la Resolución del Presidente del FOGAIBA, de 6 de noviembre de 2015, por la que se convocan, para el ejercicio 2015, subvenciones para el apoyo a la participación por primera vez en regímenes de calidad, publicada en el BOIB nº 165, de día 10 de noviembre de 2015, quedando redactado de la siguiente forma:</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">“2. Serán perceptores finales de las ayudas previstas en la presente Resolución los agricultores/ganaderos titulares de explotaciones agrarias de las Illes Balears, siempre que cumplan los siguientes requisitos: </span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">- Que participen por primera vez y se hayan dado de alta, en un plazo no superior a veinticuatro meses anteriores al momento de presentación de la solicitud de ayuda, en un programa de calidad gestionado por las agrupaciones o Consejos Reguladores previstos en el punto 1 a) de este apartado.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">- Que estén inscritos en el Registro Interinsular Agrario de las Illes Balears (RIA). La comprobación de este requisito se realizará de oficio por parte del FOGAIBA, excepto manifestación contraria del peticionario, ya que con la presentación de la solicitud de ayuda se entiende otorgada tal autorización.</span></span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">- Que tengan la consideración de agricultor activo, de acuerdo con lo que se dispone en el Capítulo I, Título II del Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural. La comprobación de tener la consideración de agricultor activo se realizará de oficio por parte del FOGAIBA, ante la Agencia Estatal de Administración Tributaria, excepto manifestación contraria del peticionario, ya que con la presentación de la solicitud de ayuda se entiende otorgada la autorización.”</span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><strong>Tercer</strong></span></span></p> <p> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Corregir el error detectado en el punto 1 del apartado sexto de la Resolución del Presidente del FOGAIBA, de 6 de noviembre de 2015, por la que se convocan, para el ejercicio 2015, subvenciones para el apoyo a la participación por primera vez en regímenes de calidad, publicada en el BOIB nº 165, de día 10 de noviembre de 2015, en el sentido siguiente:</span></span></p> <p> <strong><span style="font-size:12px;"><span style="font-family: times new roman,times,serif;">Donde dice:</span></span></strong></p> <p style="margin-left: 40px;"> <span style="font-size:12px;"><span style="font-family: times new roman,times,serif;"><span style="color: black;">“1.
