	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;D/Dª&amp;nbsp; MARIA ADELAIDA GARCIA GARCIA, Letrado de la Administración de Justicia del Juzgado de lo Social nº 002 de PALMA DE MALLORCA, HAGO SABER:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Que en el PROCEDIMIENTO ORDINARIO 0000620/2015 de este Juzgado de lo Social, seguidos a instancia de D/Dª FELIX BOTIJA CASADO contra la empresa&amp;nbsp;OLTEN ENTERPRISES SL, sobre ORDINARIO, se ha dictado la siguiente resolución, cuya parte dispositiva se adjunta:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Que estimando parcialmente la demanda interpuesta por DON &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;FÉLIX BOTIJA CASADO frente a la empresa OLTEN ENTERPRISE S.L. &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;debo condenar y condeno a la empresa a abonar a la parte &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;actora la cantidad de 4.737,38 euros en concepto de salarios &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;dejados de percibir, cantidad ésta que se incrementará en un &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;diez por ciento de interés por mora.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Notifíquese esta resolución a las partes en la forma que &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;previene la Ley, haciéndoles saber que contra la misma cabe &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;interponer Recurso de Suplicación ante la Sala de lo Social &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;del Tribunal Superior de Justicia de las Islas Baleares, &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;anunciándolo ante este Juzgado por comparecencia o por escrito &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;en el plazo de los cinco días hábiles siguientes a la &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;notificación del presente fallo, siendo indispensable que al &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;tiempo de anunciarlo acredite la parte que no ostente el&amp;nbsp;&lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;carácter de trabajador y no goce del beneficio de justicia &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;gratuita, haber consignado el importe íntegro de la condena en &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;el banco SANTANDER, en la cuenta de este Juzgado o presentar &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;aval solidario de Entidad Financiera por el mismo importe. Así &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;mismo deberá constituir otro depósito por importe de 300 € en &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;el referido banco, presentando el resguardo correspondiente a &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;éste último depósito en la Secretaria del Juzgado al tiempo de &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;interponer el Recurso y el del primer depósito al momento de &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;anunciarlo, sin cuyos requisitos no podrá ser admitido.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;De no anunciarse el recurso contra la presente, firme que &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;sea, procédase al archivo de las actuaciones, previa baja en &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;el libro correspondiente.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Así, por esta mi sentencia, definitivamente juzgada en &lt;/span&gt;&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;primera instancia lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Y para que sirva de notificación en legal forma a&amp;nbsp;OLTEN ENTERPRISES SL, en ignorado paradero, expido la presente para su inserción en el Boletín Oficial de la Provincia de les Illes Balears.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px; font-family: times new roman,times,serif"&gt;Se advierte al destinatario que las siguientes comunicaciones se harán fijando copia de la resolución o de la cédula en el tablón de anuncios de la Oficina judicial, salvo el supuesto de la comunicación de las resoluciones que deban revestir forma de auto o sentencia, o cuando se trate de emplazamiento.&lt;/span&gt;&lt;/p&gt;
