Igualmente la ley 20/2006 Municipal y de régimen local de las Islas Baleares mujer competencias en materia de servicios sociales a los ayuntamientos en general y la ley 23/2006 de capitalidad al de Palma en particular.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el ejercicio de las competencias atribuidas por la ley orgánica 2/1983, de 25 de febrero, por la que se aprobó el estatuto de autonomía de las Islas Baleares, el año 1987, el parlamento aprobó la primera ley autonómica que regulaba los servicios sociales. Esta ley ha sido actualizada por la 4/2009, de Servicios Sociales de las Islas Baleares, siendo, esta, el actual marco normativo que regula los servicios sociales del Ayuntamiento.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO I.- DISPOSICIONES GENERALES.- </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Objeto del Reglamento de los centros municipales de servicios sociales </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Este Reglamento tiene por objeto regular las competencias, organización y funcionamiento de los centros municipales de servicios sociales del Ayuntamiento de Palma con la finalidad de mejorar la atención a la ciudadanía.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Organización de los servicios sociales municipales</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales municipales para poder cumplir la misión que&nbsp; tienen encomendada se organizan en: servicios centrales, centros municipales de servicios sociales y servicios de Ciudad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Integran los servicios sociales centrales la dirección política, la dirección técnica, las unidades técnicas y la unidad administrativa.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El establecimiento de las directrices y las líneas estratégicas de la Área corresponden a la dirección político-técnica, así como la coordinación de los recursos humanos, técnicos y económicos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las unidades técnicas tienen como función la gestión de programas, el apoyo a los centros municipales de servicios sociales, la gestión directa de servicios de Ciudad y la coordinación entre áreas y con otras administraciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Son funciones de la unidad administrativa dar apoyo administrativo y de mantenimiento de las infraestructuras municipales de servicios sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los centros municipales de servicios sociales constituyen el equipamiento fundamental para ofrecer los servicios sociales comunitarios, dotados de recursos humanos y materiales necesarios para el desarrollo de las prestaciones básicas del sistema público de servicios sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios de Ciudad atienden a la población del ámbito territorial del municipio en función de unas características determinadas y básicamente se identifican como servicios especializados y específicos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 3. &nbsp;&nbsp;&nbsp;&nbsp; Tipología de servicios sociales</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La tipología de servicios sociales municipales en la ciudad de Palma, siguiendo la ley 4/2009 de Servicios Sociales de las Islas Baleares, es: servicios sociales comunitarios y servicios sociales especializados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios son la puerta de entrada al sistema de servicios sociales y son la garantía de proximidad a las personas usuarias en sus ámbitos personal, familiar y social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales especializados son servicios, programas o actuaciones de Ciudad y dirigida a colectivos menos numerosos con necesidades determinadas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 4. &nbsp;&nbsp;&nbsp;&nbsp; Los servicios sociales comunitarios de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios pueden ser básicos y específicos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios básicos son servicios universales y polivalentes y se desarrollan mediante equipos interdisciplinares en los centros municipales de servicios sociales con el apoyo y las directrices de las unidades centrales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios específicos centran su intervención en colectivos vulnerables de características homogéneas facilitándoles la inserción y la normalización social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Titulares de derecho de acceso a los centros municipales de servicios sociales </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Con carácter general son titulares de derecho de acceso a los servicios sociales comunitarios los ciudadanos de Palma incluidos al artículo 5 de la ley 4/2009 de Servicios sociales de las Islas Baleares y prioritariamente aquellos ciudadanos de Palma que se encuentren en situación de necesidad social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El acceso a los centros municipales de servicios sociales se realiza según el barrio donde viva la persona y según este se le asignará un centro determinado.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas sin techo serán atendidas por la red de inclusión social si bien, los centros municipales de servicios sociales, procurarán la correcta derivación a los recursos que atienden a este colectivo.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO II.- LA ORGANIZACIÓN Y FUNCIONAMIENTO DE LOS CENTROS MUNICIPALES DE SERVICIOS SOCIALES.- </strong></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo Primero.- La organización de los servicios sociales comunitarios.- </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 6. &nbsp;&nbsp;&nbsp;&nbsp; El centro de servicios sociales</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los centros de servicios sociales, distribuidos con criterios territoriales, constituyen la puerta de entrada al sistema de atención social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Un centro de servicios sociales atiende a una agrupación de barrios ( zonas estadísticas) que se denomina sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Desde los centros de servicios sociales se ofrecen los servicios sociales comunitarios básicos y específicos. Concretándose en &nbsp;atención social individualizada a las demandas de los vecinos de Palma y realizando intervenciones comunitarias en los barrios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las funciones de los servicios sociales comunitarios básicos y específicos, desarrolladas desde los centros de servicios sociales, están sujetas a la legislación vigente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 7. &nbsp;&nbsp;&nbsp;&nbsp; Coordinación</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Desde los centros municipales de servicios sociales se promoverán acuerdos con otros servicios municipales territoriales&nbsp; para ofrecer una atención integral.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Igualmente se promoverá la coordinación con otros niveles de atención del sistema público así como con las entidades, asociaciones y grupos del territorio con la finalidad de establecer actuaciones conjuntas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 8. Organización territorial de los centros de servicios sociales de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios de Palma se organizan territorialmente en sectores y barrios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El sector es una división de la ciudad que respeta la integridad de los barrios (zonas estadísticas) y que parte de la división realizada en el año 1985 en el Primer Plan de Servicios Sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El barrio es la unidad básica sobre la cual se organiza toda la información territorial. El barrio se corresponde con el concepto de zona estadística, definida en el plan general de ordenación urbana vigente en Palma.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Actualmente Palma cuenta con nueve sectores, en cada uno de los cuales hay un centro municipal de servicios sociales. La creación de un nuevo sector se producirá por la superación de los 100.000 habitantes tal como marca la ley 4/2009 de Servicios sociales de las Islas Baleares o sin superar esta cantidad por criterios de mejora en la atención a la ciudadanía.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Por criterios organizativos y de proximidad a la población debe haber más de un punto de atención en el sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cada sector deberá contar con los siguientes perfiles profesionales: trabajador social, trabajador familiar, educador social, psicólogo y auxiliar administrativo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Para la distribución de profesionales se tendrán en cuenta criterios de población, de demanda (volumen e intensidad) y otras circunstancias.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Jefe de Sector dirige el centro municipal de servicios sociales, hecho que implica la dirección y coordinación de los diferentes servicios sociales comunitarios básicos y algunos específicos del territorio del sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 9. Horario de atención&nbsp; </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El horario de atención al público de los centros municipales de servicios sociales es de 9h. a 14h. de lunes a viernes y de 16,30h. a 18.30h. los martes. Si bien se realizan intervenciones fuera de este horario.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se procurará, en la medida de lo posible, la atención a personas que tienen dificultades de acceso al horario establecido.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Siempre que el centro municipal de servicios sociales permanezca abierto habrá más de un profesional al centro.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo&nbsp; Segundo.- Estructura programática de los centros municipales de servicios sociales.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 10.&nbsp;&nbsp;&nbsp; La planificación de los servicios sociales </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los servicios sociales comunitarios diseñarán su intervención a partir de una estructura programática basada en criterios de diagnóstico social, empleando indicadores y variables previamente establecidos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El proceso de diagnóstico cubre dos dimensiones: el territorio y los sectores de población. Permite priorizar la intervención en barrios o zonas concretas y niveles de intervención sobre los diferentes sectores de población.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los documentos que recogen lo estructura programática son: Plan estratégico, Programas y Planes de sector.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Plan estratégico estará liderado por la dirección de la Área, establecerá las prioridades y los objetivos generales y será cuatrienal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los Planes de sector y Programas responderán a objetivos generales del Plan estratégico y tendrán una vigencia inferior al Plan Estratégico.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los planes de sector se evaluarán anualmente con la participación de todos los profesionales implicados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 11.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; La programación de los centros municipales de servicios sociales: el Plan de sector</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Plan de sector es el instrumento de planificación donde se describen las prioridades de intervención para cada sector de servicios sociales. Tendrá una periodicidad bienal y&nbsp; recoge como mínimo:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Identificación del territorio que comprende el sector. Principales características</span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Diagnóstico Social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Líneas de intervención</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Recurso humano</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Infraestructura</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;Presupuesto</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Evaluación</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Jefe de sector es el responsable de la elaboración del Plan de sector con la participación del equipo del centro.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo tercero.- El personal técnico de los centros municipales de servicios sociales.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 12.&nbsp;&nbsp;&nbsp; Personal suficiente y formato</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los centros municipales de servicios sociales deben tener el personal suficiente con la formación, la titulación, los conocimientos, las aptitudes y la estabilidad laboral para garantizar la calidad en la prestación de los servicios sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En cuestión de ratios profesionales los centros de servicios sociales se ajustarán a la normativa vigente en esta materia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los centros de servicios sociales contarán con los perfiles profesionales de trabajador social, psicólogo, educador social, auxiliar administrativo y trabajadora familiar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 13. Participación en la planificación</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El personal de los servicios sociales comunitarios participara en la planificación, el seguimiento de la gestión y la evaluación de los Planes de sector y del Área de Bienestar Social en general.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 14. Medidas de apoyo y protección al personal técnico</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Según la ley 4/2009 de Servicios sociales de las Islas Baleares:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La corporación municipal garantiza a los técnicos la supervisión, el apoyo técnico y la formación permanente que les permita dar una respuesta adecuada a las necesidades y las demandas de la población.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Los profesionales de servicios sociales deben tener el apoyo administrativo, los medios materiales necesarios y las condiciones laborales adecuadas para cumplir con eficacia, eficiencia y calidad su tarea profesional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. EL Ayuntamiento adoptará, en relación a su personal, medidas dirigidas a proteger la identidad y las otras circunstancias personales, si fuera necesario.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La corporación municipal garantizará medidas de prevención y atención ante&nbsp; situaciones que afecten al estado emocional, cognitivo y físico de los profesionales. También ante agresiones, tanto físicas como verbales, amenazas y otras conductas que vulneren la integridad física y emocional del profesional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Estas medidas englobarán la protección jurídica, física y emocional. Cuando la gravedad de los hechos lo requiera, el Ayuntamiento presentará la denuncia pertinente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A tal efecto se constituirá una comisión formada por un representante de la dirección política, El Jefe de servicio, la dirección técnica, el jefe de sector correspondiente y el profesional o profesionales afectados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 15. Deontología profesional</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El personal técnico de servicios sociales&nbsp; debe cumplir los deberes relativos a la deontología profesional. En los casos de presunto incumplimiento se remitirá informe exponiendo la circunstancia a la dirección técnica, quien resolverá o bien la elevará al Comité de Ética de las Islas Baleares regulado por el decreto 62/2010 para su resolución.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO III.- LA ATENCIÓN EN LOS CENTROS MUNICIPALES DE SERVICIOS SOCIALES: LA INTERVENCIÓN INDIVIDUAL-FAMILIAR Y LA INTERVENCIÓN COMUNITARIA</strong></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo primero.- La atención en los centros municipales de servicios sociales.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 16.&nbsp;&nbsp;&nbsp; Atención en los centros municipales de servicios sociales</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La atención a las necesidades de las persones-familias en situación de exclusión social debe ser realizada:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- desde una atención con una finalidad individual: a través de una intervención individual o de una intervención grupal de personas en situación similar</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">- desde una atención con una&nbsp; finalidad colectiva: a través de una intervención grupal dirigida a la comunidad o a través de una intervención comunitaria</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo segundo.- La intervención individual-familiar.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 17.&nbsp;&nbsp;&nbsp; Intervención individual y familiar </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervención individual-familiar se basa en la personalización de la atención, es decir, en la adaptación del proceso de ayuda a la situación de cada persona, partiendo más de sus capacidades que de las dificultades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En la atención individual y familiar se establece una relación entre personas que presentan una situación de dificultad social&nbsp; y el personal técnico encomendado para su atención. Está basada en la voluntad de la persona de cambiar una situación de necesidad mediante el asesoramiento, consejo técnico y movilización de recursos que se ofrece desde los centros de servicios sociales. En la mayoría de casos se trata de un proceso de cambio de una situación de necesidad a otra de mejora.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas que se encuentran en situación de necesidad pero no quieran realizar ningún tipo de cambio en su situación no pueden ser objeto de intervención por parte de los servicios sociales comunitarios, a excepción de aquellas tramitaciones de derecho subjetivo, de acuerdo con lo que establecen los instrumentos que regulan las prestaciones. En estos casos los servicios sociales comunitarios pueden sensibilizar con respecto a la necesidad de cambiar la situación y poner en conocimiento del&nbsp; servicio&nbsp; correspondiente, cuando se valore que la situación es tan grave que vulnera la integridad de la misma persona y/o de terceras personas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es un abordaje desde un equipo interprofesional y en red con otros profesionales de servicios implicados y de entidades. Se complementa con actuaciones grupales y comunitarias.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;El jefe de sector velará por la polivalencia de los profesionales que compaginan el trabajo individual con el grupal y comunitario según las ratios establecidas por la dirección.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 18.&nbsp;&nbsp;&nbsp; Intervención grupal con finalidad individual</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La atención individual se puede hacer a través de intervención individual-familiar; o se puede hacer a través de una intervención grupal con finalidad individual, dirigida a personas con características semejantes – demanda, situación y necesidades psicosociales. Ambas formas de intervenir suponen una finalidad de cambio individual&nbsp; -capacitar en habilidades, dar información en grupo, formar hábitos, favorecer la capacidad de inserción social-.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 19. Profesional de referencia </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Todas las personas que sean atendidas por los servicios sociales comunitarios tendrán asignado un profesional de referencia o responsable de caso.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En caso que se sustituya al profesional de referencia el jefe de sector velará por el establecimiento de los mecanismos adecuados en el traspaso de casos para facilitar la continuidad de los procesos de trabajo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En caso de no sustitución del profesional o mientras se sustituye, el jefe de sector valorará si el caso requiere una continuidad en la atención o bien puede estar a la espera de la demanda del usuario. En cualquier caso se traspasará al profesional que corresponda por agenda las primeras acogidas, descontándose la disponibilidad de la misma.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El profesional de referencia tiene las siguientes funciones:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Gestionar las prestaciones que la persona o la unidad de convivencia necesitan, velar por la globalidad de las intervenciones y por la coordinación entre el equipo&nbsp; de profesionales de los servicios sociales y los de otras redes de bienestar social, favorecer la toma de decisiones y agilizarlas, la custodia y responsabilidad del expediente&nbsp; físico de la persona atendida, así como el cierre del mismo y velará por la elaboración conjunta del diagnóstico, pronóstico, plan de trabajo y evaluación de todo el equipo del caso, si cabe.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Prestar información relativa a su expediente, en cualquier momento del proceso de intervención, a la persona usuaria siempre de acuerdo con la legislación de protección de datos. Así como a profesionales de servicios de otras administraciones que lo requieran en los casos con intervención conjunta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los protocolos de atención individual definen los perfiles profesionales responsables del expediente según la situación de dificultad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las demandas de cambio de profesional serán atendidas y valoradas por el jefe de sector. Si la valoración de cambio es positiva, este le asignará el primer profesional que tenga disponibilidad en primeras acogidas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales podrán pedir al jefe de sector inhibirse o retirarse de un caso cuando haya causas motivadas, como por ejemplo, enemistad manifiesta, relaciones de vínculo familiar o personal o circunstancias vitales coincidentes con la persona que impidan la adecuada distancia en la relación de ayuda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 20. Plan individual&nbsp; de inserción social</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervención individual-familiar requerirá de un plan individual-familiar de inserción social&nbsp; que tiene por objeto la individualización y personalización de la atención a partir de&nbsp;&nbsp;&nbsp; la elaboración conjunta entre personal técnico y el ciudadano del diagnóstico, el plan de trabajo y la evaluación de la intervención.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstante, no todos los casos atendidos desde los centros municipales de servicios sociales necesitan la elaboración de un plan individualizado, ya qué se resuelven con informaciones, orientaciones, derivaciones o por el carácter asistencial y de contención que requieren. Igualmente cuando se trate de&nbsp; prestaciones garantizadas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo&nbsp; 21.&nbsp; Expediente</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El expediente incluye la serie ordenada de la documentación de una persona y, si cabe, de su familia, donde consta, como mínimo, lo siguiente:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Los datos de identificación</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La historia social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La valoración</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Los acuerdos-contrato de inserción social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">El plan individual de inserción social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La evaluación</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La hoja de autorización uso datos usuarios</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La hoja de derechos y deberes</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los expedientes de servicios sociales tienen un doble soporte: el físico y el digital. Dentro del soporte físico puede haber información anexa y complementaria a la recogida en las hojas de proceso del caso, consistente en apuntes, análisis, hipótesis de trabajo e informes de otros servicios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales que tengan acceso a la documentación que consta en el expediente están sujetos al deber de mantener el secreto sobre los datos consultados. La consulta de un expediente por parte de profesionales que no realizan intervenciones al mismo, siempre será motivada. Su incumplimiento será causa de sanción.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales que intervienen tienen la obligación de mantener actualizada la información relativa a la persona usuaria o unidad de convivencia, a las intervenciones que se llevan a cabo y a los recursos movilizados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los expedientes no se dejarán al alcance de&nbsp; personas ajenas a la&nbsp; organización. Se tendrá especial cuidado en las dependencias de atención al público. Finalizada la jornada laboral los expedientes se guardarán en archivos que permanecerán cerrados bajo llave. El profesional referente será el responsable de la custodia&nbsp; del expediente&nbsp; físico, así como de establecer los mecanismos necesarios para impedir el acceso al mismo de personas no autorizadas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;Los expedientes no se pueden sacar de las dependencias municipales. En caso de traslado obligatorio se adoptarán medidas dirigidas a impedir el acceso a la información y a su manipulación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El jefe de sector podrá pedir la retirada del centro municipal de los expedientes físicos que haga cinco años o más que están cerrados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo&nbsp; 22.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Acceso a la información del expediente</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Según la ley 4/2009 de Servicios sociales de las Islas Baleares todo ciudadano puede solicitar el acceso a su expediente de servicios sociales comunitarios. En estos casos se procederá de la siguiente manera:</span></p> <p style="text-align:left;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Solicitud formal vía instancia donde haga constar los datos de identificación&nbsp; y motivo de la solicitud.</span></p> <p style="text-align:left;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Entrega al interesado con acuse de recibo del documento que aparece en el sistema informativo como “Copia del expediente”&nbsp; con sello donde indique la autenticidad de la documentación entregada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 23.&nbsp;&nbsp;&nbsp; Cierre del expediente</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es el momento en el que el equipo y la persona-familia hacen una valoración conjunta del grado de consecución de los objetivos y de los resultados alcanzados. Se hará una preevaluación del equipo, que siempre que se pueda, se consensuará con la persona/familia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La evaluación final&nbsp; incluir:</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Motivo del cierre.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Situación final del caso. Se&nbsp; especificar el servicio</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Otros.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Una vez cerrado el expediente y sin haber transcurrido más de seis meses si la persona/familia realiza una nueva demanda se le asignará el mismo profesional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 24.&nbsp;&nbsp;&nbsp; Traspaso de los expedientes entre centros</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Para la realización de un traspaso siempre se habrá cerrado previamente el expediente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Siguiendo el procedimiento establecido en el documento técnico sobre el traspaso de expedientes, el auxiliar administrativo hará el traspaso administrativo al otro centro municipal de servicios sociales. El profesional responsable del caso hará el traspaso técnico del expediente y acordará con el profesional receptor los plazos y el proceso a seguir.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Capítulo tercero.- La intervención comunitaria.-</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 25.&nbsp;&nbsp;&nbsp; Intervención comunitaria</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervención comunitaria tiene la finalidad de fomentar la búsqueda de soluciones a problemas sociales que hay a un territorio concreto. Una búsqueda que se hace desde la participación e implicación de técnicos de servicios sociales, técnicos de otros servicios, vecinos y entidades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se fundamenta en los siguientes criterios:</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Detección y diagnóstico de las necesidades o dificultades sociales existentes.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Realizar un diseño riguroso de aquello que pasa y de lo que se quiere hacer.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Participación de la población en los cambios</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4.- Participación de las entidades y corresponsabilidad comunitaria</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5.- Intervención en equipo</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6.- Abordaje en red. Trabajo con los servicios implicados.</span></p> <p style="margin-left:35.4pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">7.- Planificación evaluación continua</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La intervención comunitaria en el marco de los servicios sociales comunitarios se ordena, según el artículo 6 del decreto 48/2011 de Coordinación de los servicios sociales comunitarios básicos, desde la planificación de una zona que contemple objetivos que permitan desarrollar proyectos/actuaciones dirigidos a:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">grupos en situación de riesgo</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">apoyo a entidades</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">prevención social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">reinserción social</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">fomento de la convivencia y de la solidaridad</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">creación de redes asociativas y solidarias</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">coproducción de recursos comunitarios</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El jefe de sector velará por la polivalencia de los profesionales que compaginarán el trabajo individual con el grupal y comunitario según las ratios establecidas por la dirección.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 26.&nbsp;&nbsp;&nbsp; Intervención grupal con finalidad comunitaria</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La atención comunitaria se puede prestar desde dos formas básicas: intervenciones grupales con finalidad colectiva como por ejemplo los grupos intergeneracionales, o bien desde intervenciones comunitarias, que suponen crear red asociativa y solidaria, coproducir un servicio-actividad-recurso con una entidad, crear una plataforma de entidades de un barrio que persigue su mejora. Todo y que una misma intervención puede evolucionar en el tiempo y tener las dos vertientes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Esta intervención grupal no persigue un cambio individual de cada participante sino que provee la comunidad de un recurso que facilita la inserción social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 27. Los&nbsp; barrios prioritarios y las zonas de atención preferente.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los barrios prioritarios son aquellos en qué se da una situación de necesidad social superior al resto de barrios en determinados sectores de población. La catalogación de las necesidades se hace a través del diagnóstico social basado en&nbsp; indicadores de vulnerabilidad que ponen de manifiesto la necesidad de priorizar la intervención.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las zonas de atención preferente están reguladas por el artículo 12 del decreto 48/2011 de Coordinación de los servicios sociales comunitarios básicos y concentran mayor número de personas en situación de vulnerabilidad social. La declaración de zona de atención preferente obliga al Ayuntamiento a priorizar las actuaciones de todas las áreas municipales realizando un plan integral que incorpora acciones de vivienda, urbanismo, educación, juventud, deportes entre de otros.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 28.&nbsp;&nbsp;&nbsp; Profesional de referencia </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los proyectos y actuaciones deben tener un profesional responsable de los mismos, así como un equipo de proyecto que puede ser interprofesional.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El profesional responsable tiene las siguientes funciones:</span></p> <ol style="list-style-type:lower-alpha;"> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Canalizar las demandas de entidades y/o servicios, velar por la globalidad de las intervenciones y por la coordinación entre los profesionales del proyecto/actuación y los de otros servicios/entidades implicadas, favorecer a la toma de decisiones y agilizarlas, la custodia y responsabilidad de la carpeta de proyecto y velar por la elaboración conjunta del proyecto/actuación y la evaluación.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Prestar información relativa al desarrollo del proyecto/actuación, en cualquiera momento del proceso de intervención.</span></li> </ol> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El catálogo de prevención social indica la responsabilidad según la tipología de los proyectos/actuaciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 29.&nbsp;&nbsp;&nbsp; Proyectos y actuaciones</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los proyectos son el instrumento metodológico que permite concretar las prioridades marcadas en el Plan de Sector&nbsp; y desarrollarlas mediante actividades organizadas entorno a objetivos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las actuaciones son intervenciones más concretas y específicas que no requieren la amplitud y despliegue de un proyecto; pueden tener entidad por sí mismas o pueden estar vinculadas a un proyecto.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El documento que enmarca metodológicamente la intervención comunitaria es el catálogo de prevención social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El presupuesto de los proyectos/actuaciones deberá generar una reserva de crédito en el presupuesto anual vigente de la Regidoría de Bienestar Social del Ayuntamiento de Palma.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los presupuestos de los proyectos que tengan una duración superior a un año deberán ser aprobados en cada ejercicio presupuestario.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los proyectos presentarán como guión mínimo:</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Identificación del proyecto&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Diagnóstico Social. Punto de partida</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Objetivo General&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4.- Objetivos Operativos</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">5.- Actividades</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">6.- Presupuesto&nbsp;</span></p> <p style="margin-left:35.45pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">7.- Evaluación del proyecto</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les proyectas/actuaciones deben disponer de una carpeta de proyecto. Esta consistirá en un dossier-expediente con toda la información relativa al desarrollo de la intervención y material de apoyo.&nbsp; Deben figurar las hojas de inscripción y autorización de menores y la de autorización del derecho de imagen si fuese necesario.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales del proyecto/actuación tienen la obligación de mantener actualizada la información relativa al desarrollo de la intervención y a los recursos movilizados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El profesional referente será el responsable de la custodia&nbsp; de la carpeta de proyecto.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO IV.- LAS PRESTACIONES de los SERVICIOS SOCIALES COMUNITARIOS</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 30.&nbsp;&nbsp;&nbsp; Prestaciones </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las prestaciones del sistema público de servicios sociales pueden ser técnicas, económicas o tecnológicas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Según el artículo 5 del decreto 56/2011 de 20 de mayo por el que se aprueba la cartera básica de servicios sociales las prestaciones del sistema de servicios sociales pueden ser garantizadas para todo el mundo o bien no garantizadas y ser otorgadas según la disponibilidad presupuestaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 31.&nbsp;&nbsp;&nbsp; Prestaciones técnicas</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tal como queda recogido en la ley 4/2009 de Servicios sociales a las Islas Baleares en el artículo 21:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Las prestaciones técnicas son los servicios y las intervenciones que llevan a cabo los equipos profesionales que se dirigen a la prevención, el diagnóstico, la valoración, la protección, la promoción de la autonomía, la atención y la inserción de las personas, las unidades de convivencia y los grupos en situación de necesidad social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Desde los servicios sociales comunitarios se pueden prestar, con carácter temporal o permanente, en el domicilio, en el entorno a la persona usuaria, de forma ambulatoria y en centros. En este último caso pueden ser de régimen diurno. Los servicios sociales comunitarios nunca prestarán servicios&nbsp; de régimen nocturno o residencial.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. La aplicación de cualquiera tipo de prestación social&nbsp; debe ir acompañada de la aplicación de prestaciones técnicas adaptadas en cada caso.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 32.&nbsp;&nbsp;&nbsp; Prestaciones económicas</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Son prestaciones económicas, siguiendo la ley 4/2009 de Servicios sociales de las Islas Baleares, las aportaciones dinerarias que tienen como finalidad atender determinadas a situaciones de necesidad en las que se encuentran las personas que no disponen de recursos económicos suficientes por hacer frente y no están en condiciones de lograr o recibir de otras fuentes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 33.&nbsp;&nbsp;&nbsp; Prestaciones tecnológicas</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tal como queda recogido a la ley 4/2009 de servicios sociales a las Islas Baleares al artículo 23:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Son prestaciones tecnológicas las que por medio de un producto atienden a las necesidades sociales de la persona y se pueden asociar con otras prestaciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tienen esta consideración las siguientes prestaciones:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) La asistencia tecnológica y la teleassistència domiciliaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Las ayudas a instrumentales adscritas a mantener o mejorar la autonomía&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; personal, o a favorecer la inserción social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c)&nbsp; Las de naturaleza semejante que se establezcan normativamente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 34.&nbsp;&nbsp;&nbsp; Cartera de servicios sociales del Ayuntamiento de Palma</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Según el artículo 24 de la ley 4/2009 de servicios sociales la cartera de servicios sociales es el instrumento que determina el conjunto de prestaciones del sistema público de servicios sociales, incluyendo todas las prestaciones técnicas, económicas y tecnológicas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El decreto 56/2011 de 20 de&nbsp; mayo aprueba la cartera básica de servicios sociales de las Islas Baleares. Tal y como se explicita al artículo 27 de la ley 4/2009 de Servicios sociales el Ayuntamiento de Palma aprobará su cartera de servicios una vez lo haya hecho el Consell de Mallorca.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO V. LOS DERECHOS Y DEBERES DE LAS PERSONAS USUARIAS de los SERVICIOS SOCIALES COMUNITARIOS. RÉGIMEN SANCIONADOR.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 35.&nbsp;&nbsp;&nbsp; Derechos de las personas usuarias </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas usuarias de los servicios sociales comunitarios gozarán de los derechos que los confiere el artículo 7 de la ley 4/2009 de servicios sociales:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Derecho a acceder al sistema de servicios sociales en condiciones de igualdad sin discriminación por razón de lugar de nacimiento, idioma, etnia, sexo, orientación sexual, estado civil, situación familiar, edad, discapacitada, religión, ideología, opinión o cualquier otra condición personal o social.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Derecho a recibir información suficiente y verídica, en términos comprensibles, sobre las prestaciones y los recursos disponibles y sobre los requisitos necesarios para acceder a los servicios, y también sobre otros recursos de protección social y sobre las competencias de las administraciones públicas en este ámbito. Para hacerlo efectivo, debe disponerse de las ayudas y de los apoyos necesarios para comprender la información que les sea dada, si tienen dificultades derivadas del desconocimiento de la lengua, si tienen alguna discapacidad o por otras razones que lo justifiquen.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Derecho a recibir la valoración de su situación y, si es procedente, la valoración de las necesidades sociales de los familiares o de las personas que tienen cuidado, en un lenguaje claro y comprensible.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Derecho a disponer de un plan individual de inserción social de acuerdo con la valoración de su situación, que deben aplicar técnicamente profesionales mediante procedimientos reconocidos y acreditados.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Derecho a estar informadas del&nbsp; proceso de intervención social y a participar en la elección de los servicios o las prestaciones entre las opciones que les presenten las administraciones, siempre que estos hechos no vayan en contra del normal desarrollo de la atención o perjudiquen a alguna de las partes que intervienen.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Derecho a recibir información previa con relación a cualquier intervención que les afecte, para que puedan dar consentimiento específico y libre, excepto en situaciones que supongan un riesgo para la integridad de las personas y por requerimiento judicial. El consentimiento&nbsp; debe ser, en todo caso, por escrito cuando la intervención implique el ingreso en un centro residencial. El consentimiento de las personas incapacitadas y de las personas menores de edad lo otorgan los padres o tutores.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Derecho a renunciar a las prestaciones y a los servicios concedidos en los términos establecidos por la legislación vigente, excepto que la renuncia afecte a los intereses de las personas menores de edad o de personas incapacitadas o presuntamente incapaces.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Derecho a la confidencialidad respeto de la información que conozcan los servicios sociales, de acuerdo con la legislación de protección de datos de carácter personal.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">y) Derecho al acceso, en cualquiera momento, a su expediente individual, de conformidad con lo establecido en la legislación vigente, y en todo el que no vulnere el derecho a la intimidad de terceras personas.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">j) Derecho a la asignación de personal profesional de referencia, en los términos establecidos reglamentariamente.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">k) Derecho a la participación tal y como regula el título IV de la ley 4/2009.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">l) Derecho a recibir servicios de calidad y a conocer los estándares establecidos a este efecto.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">m) Derecho a sugerir y a hacer reclamaciones.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">n) Derecho a la continuidad de la prestación de los servicios en las condiciones establecidas o convenidas.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">o) Derecho a ser orientadas hacia otros recursos alternativos que sean necesarios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 36.&nbsp;&nbsp;&nbsp; Deberes de las personas usuarias </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas usuarias de los servicios sociales comunitarios tendrán los deberes que les confiere el artículo 8 de la ley 4/2009 de servicios sociales:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Cumplir las normas, los requisitos, las condiciones y los procedimientos establecidos en las prestaciones y los servicios; seguir le programa de atención y las orientaciones que se hayan acordado con el personal profesional competente, y comprometerse a participar activamente en el proceso.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Facilitar información verídica sobre las circunstancias personales, familiares y económicas, siempre que su conocimiento sea necesario para valorar y atender a su situación, y también comunicar las variaciones que se produzcan.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Destinar la prestación económica a la finalidad para la cual fue concedida.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Acudir a las entrevistas a las cuales las cite el personal profesional de los servicios sociales.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Contribuir a la financiación del coste del servicio cuando se tenga capacidad económica y así se establezca normativamente.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Informar en la mayor brevedad posible sobre cualquiera cambio que se produzca en cuanto a su situación personal, familiar, social y económica, que pueda dar ocasión a modificar, suspender o extinguir la prestación.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Firmar el contrato asistencial pertinente con la entidad prestadora del servicio cuando así se requiera.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Mantener en todo momento un comportamiento adecuado y respetuoso con los profesionales así como con el resto de usuarios que coincidan en los centros y/o en las actividades en las que participan.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el momento de la obertura de un expediente las personas usuarias firmarán delante del profesional de referencia una hoja donde se recojan sus derechos y deberes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En los participantes de intervenciones grupales y comunitarias se informará de los derechos y deberes en relación a las actividades que se llevan a cabo. En los casos que la naturaleza de la actividad lo requiera, básicamente actividades grupales, los participantes firmarán&nbsp; la aceptación de los derechos y deberes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 37.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Infracciones y sanciones de las personas usuarias.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Además de la normativa vigente se establecen tres niveles de infracciones:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Son infracciones leves, de las personas usuarias o beneficiarias de prestaciones, las siguientes:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No facilitar la información sobre los cambios en la situación personal, familiar, económica y social.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No cumplir los acuerdos relacionados con el servicio o prestación concedida</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">La falta de respecto a los profesionales, a otras personas usuarias o visitantes del centro</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Son infracciones graves de las personas usuarias o beneficiarias de prestaciones las siguientes:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Falsear datos a la Administración</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No comunicar a los profesionales los cambios o las alteraciones de las circunstancias o de los requisitos que varen determinar la concesión del recurso/prestación</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Producir daños a las instalaciones del centro, otras dependencias municipales o locales donde se lleve a cabo la intervención.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No destinar la prestación a la finalidad para la cual se ha concedido.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">No cumplir de forma reiterada y continúa los acuerdos relacionados con el servicio, la prestación o el recurso concedido</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Se considerará infracción muy grave la agresión física o psicológica al personal que preste el servicio, así como las amenazas que supongan un riesgo para la integridad de los profesionales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El profesional que tenga conocimiento de una acción/omisión de las descritas anteriormente será el que inste al inicio del procedimiento sancionador que a continuación se detalla.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se establecen tres niveles de sanciones:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1.- Para las infracciones leves se advertirá verbalmente a la persona usuaria. El profesional&nbsp; y el jefe de sector convocarán una entrevista con la persona para este objeto. Se dejará constancia dentro del expediente o carpeta de proyecto de los hechos mediante una diligencia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.- Las infracciones graves supondrán el cierre temporal, de entre dos a seis meses del expediente. Ahora bien, cuando al expediente haya intervenciones dirigidas a menores con procesos positivos, como puedan ser becas de inserción en riesgo y recursos para la integración educativa, laboral y social de los menores, solo se cerrarán las referidas a los adultos con la intención de preservar dichos procesos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se creará una comisión integrada por el profesional afectado, el jefe de sector, el equipo de caso o de proyecto y dos profesionales del centro&nbsp; para determinar la duración del cierre del expediente y en el caso de intervenciones grupales y comunitarias para determinar el tipo y duración de la sanción.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El acta de la comisión servirá para informar a los usuarios y se guardará el original en el expediente/carpeta de proyecto. El jefe de sector y el profesional darán conocimiento al usuario convocante una entrevista para tal fin.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.- Las infracciones muy graves supondrán la interrupción inmediata del servicio hasta que la comisión dictamine las medidas a tomar. En la intervención individual-familiar el cierre del expediente será como mínimo de seis meses.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Para estas infracciones la comisión estará integrada&nbsp; por un representante de la dirección política, el jefe de servicio, la dirección técnica, el jefe de sector correspondiente y el profesional o profesionales afectados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La comisión tendrá en cuenta el reconocimiento de los daños causados y la voluntad de reparación de los mismos por parte del agresor.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El acta de la comisión servirá para informar a los usuarios y se guardará el original en el expediente. El jefe de sector y la dirección técnica darán conocimiento a las personas usuarias convocando una entrevista a tal fin.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 38.&nbsp; Presentación y trámite de demandas, sugerencias, felicitaciones y reclamaciones</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cuando una persona usuaria de los servicios sociales comunitarios quiera realizar una sugerencia, queja, felicitación o reclamación puede hacerlo directamente a través del jefe de sector o mediante el sistema general que tenga el Ayuntamiento para atender a estas situaciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Cuando se ha utilizado el canal verbal el jefe de sector o profesional en quien delegue registrará la queja, sugerencia, felicitación o reclamación en la web municipal en el apartado de quejas y sugerencias.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>TÍTULO VI. LOS DERECHOS Y DEBERES de los PROFESIONALES </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 39. &nbsp;&nbsp; Derechos de los profesionales </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales de los servicios sociales tienen, en el ejercicio de sus funciones, reconocidos todos los derechos recogidos en la legislación que sea aplicable al ámbito donde desarrollan su actividad y, en particular los siguientes:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Derecho a la dignidad. Los profesionales de los servicios sociales tienen, en el ejercicio de sus funciones, derecho a la dignidad, es decir, al reconocimiento de su valor intrínseco como personas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Su ejercicio efectivo implica ser tratadas con el máximo respeto, con corrección y comprensión, tanto por parte de los responsables del servicio y del resto de profesionales, como por parte de las personas usuarias.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Derechos laborales. Las personas que ejercen su actividad profesional en los servicios sociales tienen todos los derechos que, en el ámbito laboral o de la función pública, les reconozcan la legislación y los convenios colectivos o los acuerdos reguladores de las condiciones de empleo que sean aplicables.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c)&nbsp; Derecho a la formación. Las personas que trabajen en los servicios sociales tienen derecho a acceder a la información y orientación inicial, destinada a facilitar su adaptación a las características del servicio o centro y beneficiarse de la formación continua, necesaria para desarrollar su actividad profesional, durante toda su vida activa, participando en la propuesta de sus contenidos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El Área de Bienestar Social como administración especial deberá garantizar un mínimo anual de formación obligatoria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En coordinación con la Escuela Municipal de Formación se establecerá un plan anual de formación que dé respuesta a las necesidades detectadas en este sentido.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Derecho a la participación. Los profesionales de los servicios sociales tienen derecho a la participación en el desarrollo y propuesta de planificación de la Área de Bienestar Social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En garantía del ejercicio efectivo de este derecho los profesionales pueden:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Participar en los órganos consultivos y participativos previstos a la ley 4/2009 de Servicios sociales de las Islas Baleares&nbsp; y / o en otros que se creen.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Presentar denuncias relativas al funcionamiento de los centros y servicios, que serán consideradas por el órgano competente para iniciar, si se tercia, procedimientos de inspección.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Derecho a la calidad del servicio. Los profesionales de los servicios sociales tienen derecho a disponer de los medios necesarios para garantizar la prestación de un servicio en condiciones que respondan a los criterios de calidad exigidos por la normativa correspondiente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En garantía de su ejercicio efectivo los profesionales pueden instar al Ayuntamiento a:</span></p> <ul> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que ejerza, en conformidad con la normativa vigente, las funciones que les correspondan en materia de autorización, registro, homologación e inspección, garantía del cumplimiento de los requisitos materiales, funcionales y de personal que les sean exigibles.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que se informe adecuadamente de los requisitos materiales, funcionales y de personal aplicables al servicio.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que se ponga a su disposición manuales de buena práctica profesional que orienten sobre las pautas de actuación más adecuadas al correcto ejercicio de sus funciones, en sus relaciones con las personas usuarias y con los otros profesionales.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que promueva la mejora en la calidad de los servicios mediante la realización de evaluaciones internas y externas.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que se publiquen los resultados obtenidos en los procedimientos de inspección y evaluación, posibilitando el conocimiento del funcionamiento de los servicios sociales, su coste y el cumplimiento o incumplimiento de los requisitos materiales, funcionales y de personal correspondientes.</span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;">Que los requisitos materiales, funcionales y de personal se consideran en continuo proceso de revisión y siempre susceptibles de mejora.</span></li> </ul> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Lo dispuesto en los apartados anteriores, en ningún caso legitima la negativa al desarrollo de las funciones propias de los profesionales de los servicios sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 40.&nbsp;&nbsp;&nbsp; Obligaciones de los profesionales.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales tienen, en el ejercicio de sus funciones reconocidas todas las obligaciones recogidas en la legislación que sea aplicable al ámbito donde desarrollan su actividad y, en particular, las siguientes:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Obligaciones laborales. Los profesionales tienen todas las obligaciones que, en el ámbito laboral o de la función pública, les imponen la legislación y los convenios colectivos o acuerdos reguladores de las condiciones de empleo que sean aplicables.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Los profesionales tienen la obligación de conocer y cumplir la normativa vigente en el ámbito de los servicios sociales y la normativa municipal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Deber de comunicación. Los profesionales que ejercen su actividad en los servicios sociales tienen la obligación de poner en conocimiento de la autoridad competente cualquier situación que, según ellos, y basándose en los elementos de valoración de los cuales disponen, pudiese comportar una vulneración de derechos, en los términos previstos en la legislación vigente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Cumplimiento de las normas de convivencia. Los profesionales tienen la obligación de guardar las normas de convivencia y respeto mutuo en los servicios y centros donde desarrollan su actividad y en cualquier otro lugar relacionado con esta.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Con respecto a las personas. Los profesionales tienen la obligación de respetar todos los derechos reconocidos en este Reglamento y, en particular, el derecho a la dignidad y privacidad de todos los otros profesionales y usuarios de los servicios sociales, así como el derecho a la confidencialidad de la información personal a la cual tengan acceso por razón del ejercicio de sus funciones o por cualquier otra razón.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Igualmente, deben hacer un uso responsable de la información relativa a la persona usuaria, siendo respetuosos en la obtención de esta, justificando su necesidad y solicitando su consentimiento para utilizarla cuando sea necesario para una intervención coordinada y efectiva, en los términos previstos legalmente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tienen la obligación de mantener, en sus relaciones con otros profesionales y personas usuarias, un comportamiento no discriminatorio por razón de sexo, orientación sexual, estado civil, edad, creencia o ideología, pertenencia a una minoría étnica nacional o lingüística, nivel económico, así como por razón de discapacitada física, psíquica o sensorial, o por cualquier otra condición personal o social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Deben garantizar la integridad, confidencialidad y seguridad de las opiniones, criterios y decisiones que los usuarios tomen por si mismos o a través de su representante legal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Tienen la obligación de facilitar la participación de los usuarios en el diseño de la intervención profesional a realizar.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En caso que sea necesario derivar de la persona usuaria a otro u otros servicios, el profesional tendrá la obligación de hacerlo de la manera más favorable para el usuario, procurando la continuidad de la intervención.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Respeto de las instalaciones. Los profesionales tienen la obligación de respetar y utilizar correctamente los bienes muebles y las instalaciones de los centros de servicios sociales en los que prestan sus servicios y de cualquier otro lugar relacionado con sus actividades.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Comunicación de irregularidades. Los profesionales tienen la obligación de poner en conocimiento del jefe de sector o, si lo consideran necesario, de la dirección técnica las irregularidades o anomalías que se observen en el funcionamiento, la organización o las instalaciones del centro.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición adicional primera</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Aquellos servicios específicos que por su objeto y actividad no quedan completamente recogidos en este reglamento tendrán una reglamentación propia.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición adicional segunda</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Todas las denominaciones que en este reglamento aparecen en masculino se deben entender referidas también al femenino<strong>.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición final</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Este reglamento, una vez aprobado definitivamente por el Pleno de la Corporación, entrará en vigor con la publicación íntegra de su texto en el Boletín Oficial de las Islas Baleares.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición final segunda</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Todas las estadísticas incluirán sistemáticamente la variable sexo y se tendrá en cuenta a la hora de la recogida de la información como en los informes que se publiquen.</span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Derechos y deberes de las personas usuarias</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Derechos de las personas usuarias </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas usuarias de los servicios sociales comunitarios gozarán de los derechos que los confiere el artículo 7 de la ley 4/2009 de Servicios sociales:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Derecho a acceder al sistema de servicios sociales en condiciones de igualdad sin discriminación por razón de lugar de nacimiento, idioma, etnia, sexo, orientación sexual, estado civil, situación familiar, edad, discapacitada, religión, ideología, opinión o cualquier otra condición personal o social.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Derecho a recibir información suficiente y verídica, en términos comprensibles, sobre las prestaciones y los recursos disponibles y sobre los requisitos necesarios para acceder a los servicios, y también sobre otros recursos de protección social y sobre las competencias de las administraciones públicas en este ámbito. Por hacerlo efectivo, se&nbsp; disponer de las ayudas y a los apoyos necesarios para comprender la información que los sea dada si tienen dificultades derivadas del desconocimiento de la lengua, si tienen alguna discapacitada o por otras razones que lo justifiquen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Derecho a recibir la valoración de su situación y, si esadecuado, la valoración de las necesidades sociales de los familiares o de las personas que tienen cuidado, en un lenguaje claro y comprensible.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Derecho a disponer de un plan individual de inserción social de acuerdo con la valoración de su situación, que deben aplicar técnicamente profesionales mediante procedimientos reconocidos y acreditados.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Derecho a estar informadas del a proceso de intervención social y a participar en la elección de los servicios o las prestaciones entre las opciones que les presenten las administraciones, siempre que estos hechos no vayan en contra del normal desarrollo de la atención o perjudiquen a alguna de las partes que intervienen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Derecho a recibir información previa con relación a cualquiera intervención que los afecte, para que puedan dar consentimiento específico y libre, excepto en situaciones que supongan un riesgo para la integridad de las personas y por requerimiento judicial. El consentimiento&nbsp; será en todo caso par escrito cuando la intervención implique a ingreso en un centro residencial. El consentimiento de las personas incapacitadas y de las personas menores de edad lo otorgan los padres o tutores.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Derecho a renunciar a las prestaciones y a los servicios concedidos en los términos establecidos por la legislación vigente, excepto que la renuncia afecte a los intereses de las personas menores de edad o de personas incapacitadas o presuntamente incapaces.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Derecho a la confidencialidad respeto de la información que conozcan los servicios sociales, de acuerdo con la legislación de protección de datos de carácter personal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">y) Derecho al acceso, en cualquiera momento, a su expediente individual, de conformidad con lo establecido en la legislación vigente, y en todo el que no vulnere el derecho a la intimidad de terceras personas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">j) Derecho a la asignación de personal profesional de referencia, en los términos establecidos reglamentariamente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">k) Derecho a la participación tal y como regula el título IV de la ley 4/2009.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">l) Derecho a recibir servicios de calidad y a conocer los estándares establecidos a este efecto.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">m) Derecho a sugerir y a hacer reclamaciones.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">n) Derecho a la continuidad de la prestación de los servicios en las condiciones establecidas o convenidas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">o) Derecho a ser orientadas hacia otros recursos alternativos que sean necesarios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Deberes de las personas usuarias </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Las personas usuarias de los servicios sociales comunitarios tendrán los deberes que los confiere el artículo 8 de la ley 4/2009 de servicios sociales:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a) Cumplir las normas, los requisitos, las condiciones y los procedimientos establecidos en las prestaciones y los servicios; seguir le programa de atención y las orientaciones que se hayan acordado con el personal profesional competente, y comprometerse a participar activamente en el proceso.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b) Facilitar información verídica sobre las circunstancias personales, familiares y económicas, siempre que su conocimiento sea necesario para valorar y atender a su situación, y también comunicar las variaciones que se produzcan.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">c) Destinar la prestación económica a la finalidad para la cual fue concedida.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">d) Acudir a las entrevistas a las cuales las cite el personal profesional de los servicios sociales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">e) Contribuir a la financiación del coste del servicio cuando se tenga capacidad económica y así se establezca normativamente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">f) Informar a la mayor brevedad posible sobre cualquiera cambio que se produzca en cuanto a su situación personal, familiar, social y económica, que pueda dar ocasión a modificar, suspender o extinguir la prestación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">g) Firmar el contrato asistencial pertinente con la entidad prestadora del servicio cuando así se requiera.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">h) Mantener en todo momento un comportamiento adecuado y respetuoso con los profesionales así como con el resto de usuarios que coincidan en los centros y/o en las actividades en las que participan.</span></p> <p> &nbsp;&nbsp;&nbsp;&nbsp;</p> <p style="text-align: center;"> <strong>ANEXO I.
