2016-05-07 579787 CAIB ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Hechos</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El 18 de diciembre de 2015, la Fundación Balear de Innovación y Tecnología presentó, ante la Vicepresidencia y Consejería de Innovación, Investigación y Turismo, la documentación justificativa de las tarifas de los nuevos servicios de banda ancha que se proponen para la ejecución de los encargos que hagan a la Fundación Balear de Innovación y Tecnología la Administración de la Comunidad Autónoma de las Illes Balears y el resto de poderes adjudicadores.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fundamentos de derecho</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El Texto refundido de la Ley de contratos del sector público, aprobado por el Real decreto legislativo 3/2011, de 14 de noviembre, y, en particular, los artículos 4.1 <em>n</em> y 24.6. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Decreto 14/2016, de 11 de marzo, por el que se aprueba el texto consolidado del Decreto sobre contratación de la Comunidad Autónoma de las Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Los Estatutos de la Fundación Balear de Innovación y Tecnología, autorizados por el Acuerdo del Consejo de Gobierno de 26 de julio de 2013 y, en particular, el artículo 4.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La Ley 12/2015, de 29 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2016.</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Propuesta de resolución</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Propongo al vicepresidente y consejero de Innovación, Investigación y Turismo que dicte una resolución en los siguientes términos:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprobar las tarifas de los nuevos servicios de banda ancha aplicables a los encargos que hagan a la Fundación Balear de Innovación y Tecnología la Administración de la Comunidad Autónoma de las Islas Baleares y el resto de poderes adjudicadores, según los siguientes puntos:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>a) </em>Las tarifas mencionadas, aprobadas por el Patronato de la Fundación el 18 de diciembre de 2015, que incluyen todos los costes directos e indirectas imputables al encargo de gestión, a las cuales habrá que añadir, si procede, el impuesto sobre el valor añadido vigente, se tienen que aplicar en función del tipo de servicio y de las unidades contratadas que se asignen a la ejecución de los encargos en las termas que se indican en el anexo de esta Resolución.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>b) </em>En los casos en que para gestionar o ejecutar mejor los encargos se exija o se haga recomendable la subcontratación de actividades a terceras personas, las tarifas que tenga que percibir la Fundación Balear de Innovación y Tecnología por razón del encargo se tienen que incrementar por un importe inherente al coste que tiene que atender la Fundación por razón de la subcontratación de la actividad o bienes y servicios.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>c) </em>Sin perjuicio de estas tarifas de aplicación general, se pueden aprobar tarifas específicas por los encargos que lo requieren por consideración a sus particularidades, por medio de otra resolución del vicepresidente y consejero de Economía y Competitividad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Notificar esta Resolución a la Fundación Balear de Innovación y Tecnología.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3.
