&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;DOY FE Y TESTIMONIO:&lt;/strong&gt; Que con fecha de 16/02/2016 en las presentes actuaciones que se siguen en este Órgano judicial de la clase y número ha recaído&amp;nbsp; del siguiente tenor literal:&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;"&lt;strong&gt;S E N T E N C I A&amp;nbsp;&amp;nbsp; 34/2016&amp;nbsp; &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En PALMA DE MALLORCA a dieciséis de febrero de dos mil dieciséis.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;D./Dña.&amp;nbsp; ANTONI ROTGER CIFRE, MAGISTRADO-JUEZ del Juzgado de &amp;nbsp;Instrucción número ocho de los de Palma, habiendo visto y oído en Juicio Oral y Público la presente causa JUICIO SOBRE DELITOS LEVES 0000096 /2015, seguida por una&amp;nbsp; falta de LESIONES a instancia de denuncia suscrita por TESSY OKEKE contra MIKE CHIGOZIE y BRUNO ONYEKACHI OKORIE, habiendo sido parte en la misma el Ministerio Fiscal representado por Dª DOLORES RODRÍGUEZ quien ejercitó la acción pública, y &amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;ANTECEDENTES DE HECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;PRIMERO.- &lt;/strong&gt;Las presentes diligencias se incoaron en virtud de la meritada denuncia. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Practicadas las diligencias preliminares que se estimaron pertinentes, se convocó a juicio a los presuntos culpables y demás personas que previene la ley celebrándose en el día señalado con las asistencias, en la forma y con el resultado sucintamente expresado en el acta correspondiente. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;TERCERO.- &lt;/strong&gt;En el acto del Juicio Oral y en trámite de informe el Ministerio Fiscal y las partes formularon los oportunos informes de calificación de los hechos objeto del presente procedimiento, conforme resta documentado en la grabación audiovisual de dicho acto.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;HECHOS PROBADOS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;UNICO.- &lt;/strong&gt;El día 26/06/2015 los denunciados Mike Chigozie y Bruno Onyeracht Okorie agredieron a la denunciante Tessy Okeke ocasionándole lesiones que precisaron 7 días de curación, sin impedimento. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;FUNDAMENTOS DE DERECHO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt;&amp;nbsp; La declaración de la denunciante, coherente y conteste con los informes médicos con origen inmediato en los hechos, así como las contradicciones observadas en la declaración de los denunciados, entre otras el reconocimiento de Bruno de haberse acercado cuando “ella pegó a un amigo” habiendo manifestado inmediatamente antes que estaba “mirando a 10 metros” durante la discusión y la ausencia de cualquier alusión de Mike a esa bofetada que la denunciante le propinó según la declaración de su amigo y codenunciado, crean las evidencias probatorias suficientes para el dictado de un fallo condenatorio. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Los hechos probados son constitutivos de una falta de lesiones del art. 617-1º del Código Penal (versión anterior a la L.O. 1/2015), despenalizada y respecto a la que únicamente vale pronunciamiento por responsabilidad civil (D.T. 4 de la citada Ley) &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;TERCERO.- &lt;/strong&gt;Conforme al artículo 123 del Código Penal, las costas deben ser impuestas a MIKE CHIGOZIE, BRUNO ONYEKACHI OKORIE. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Vistos los artículos citados y demás de general y pertinente aplicación&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;FALLO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;QUE DEBO CONDENAR Y CONDENO&lt;/strong&gt; a MIKE CHIGOZIE, BRUNO ONYEKACHI OKORIE, como autores de una antigua y despenalizada falta de Lesiones del artículo 617-1 del Código penal a que INDEMNICEN&amp;nbsp; a Tessy Okeke la cantidad de 300 euros en concepto de responsabilidad civil; y al pago de las costas procesales causadas.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Notifíquese esta sentencia a las partes y a los ofendidos y perjudicados, aunque no se hayan mostrado parte en el procedimiento.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;La presente resolución no es firme y contra la misma cabe interponer recurso de apelación en este Juzgado para ante la Ilma. Audiencia Provincial de ILLES BALEARS en el plazo de &lt;strong&gt;CINCO DIAS&lt;/strong&gt; desde su notificación.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Así por ésta mi sentencia, lo pronuncio, mando y firmo.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Concuerda bien y fielmente con su original al que me remito y para que así conste, &lt;strong&gt;Y PARA QUE SIRVA DE NOTIFICACIÓN A BRUNO ONYEKACHI OKORIE &lt;/strong&gt;&amp;nbsp;extiendo y firmo el presente testimonio en PALMA DE MALLORCA, a nueve de Marzo de dos mil dieciséis.&lt;/span&gt;&lt;/p&gt;
