	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span style="color: black;"&gt;Habiendo transcurrido treinta (30) días hábiles de exposición al público del expediente relativo a la modificación de la Ordenanza fiscal reguladora &lt;/span&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;de la tasa de la Escuela de Música y Danza&lt;/span&gt;&lt;span style="color: black;"&gt;, cuya exposición fue publicada en el Boletín Oficial de las Islas Baleares núm. 155 de fecha 24 de octubre de 2015, y no constando presentación de reclamación en esta Entidad, una vez dado cuenta al Pleno del Consell de Formentera de fecha 29 de enero de 2016 de la aprobación definitiva, en cumplimiento de lo previsto en el artículo 17 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, se hace público que ha quedado definitivamente aprobada la modificación de la Ordenanza fiscal reguladora &lt;/span&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;de la tasa de la Escuela de Música y Danza&lt;/span&gt;&lt;span style="color: black;"&gt;, cuyo texto es el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;ORDENANZA REGULADORA DE LA TASA POR LA PRESTACIÓN DE SERVICIOS Y ACTIVIDADES EN LA ESCUELA MUNICIPAL DE MÚSICA Y DANZA DEL CONSELL INSULAR DE FORMENTERA&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 1 Fundamento y naturaleza&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución, de acuerdo con lo dispuesto en los artículos 105 y 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y en los artículos 15 a 27, y 57 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprobó el texto refundido de la Ley de haciendas locales, esta Ordenanza regula la tasa por la prestación de servicios y la realización de actividades de enseñanza en la Escuela Municipal de Música y Danza del Consell Insular de Formentera.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 2 Hecho imponible&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Constituye el hecho imponible de la tasa la prestación de servicios y la realización de actividades de enseñanza en la Escuela Municipal de Música y Danza del Consell de Formentera.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 3 Sujetos pasivos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1. Son sujetos pasivos de la tasa, en concepto de contribuyentes, las personas físicas que soliciten o se beneficien de la prestación de servicios o realización de las actividades de enseñanza que se detallan en el artículo 6 de esta Ordenanza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2. Cuando el alumnado matriculado sea menor de edad, el pago se realizará por el padre, la madre o el tutor / a.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 4 Responsables&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1. Serán responsables solidarios o subsidiarios del pago de la tasa las personas físicas y jurídicas en las que concurran las circunstancias previstas en los artículos 41, 42 y 43 de la Ley General Tributaria, 58/2003 de 17 de diciembre.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2. La responsabilidad se exigirá en todo caso en los términos y de acuerdo con el procedimiento previsto en la Ley General Tributaria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 5 Cuota tributaria&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;La cuantía de la tasa regulada en esta Ordenanza será la fijada en la tarifa para cada uno de los servicios o actividades que se ofrecen en la Escuela Municipal de Música y Danza, reconocida en el Decreto 37/1999 con el código de centro EMDR 070001 :&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1. Estudios reglados:&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;- Cuota anual de 575,76€ por cada curso académico de 1º a 4º (desde grado elemental hasta cualquier especialidad de música y danza de las especificadas en el Decreto 37/1999 impartidos en la Escuela Municipal de Música y Danza)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2. Estudios no reglados:&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;- Cuota anual de 193,91€ por cada asignatura de estudios de 1º a 6º de grado medio de Música de las especialidades de música y danza impartidas en la Escuela Municipal de Música y Danza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;- Cuota anual de 193,91€ por cada curso académico de estudios de Iniciación a la música ya danza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;- Cuota anual de 193,91€ por cada curso académico de estudios de música tradicional (castañuelas o tambor y / o flauta) impartidos en la Escuela Municipal de Música y Danza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;- Cuota anual de 193,91€ por cada curso académico del taller de banda (sin incluir instrumentos) impartidos en la Escuela Municipal de Música y Danza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Además, se debe tener en cuenta:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1.- Todo el alumnado del centro tendrá que pagar el importe de la matrícula (72,10€) en concepto de apertura de expediente, sólo el primer curso que accedan a la Escuela Municipal de Música y Danza.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2.- La actividad de la Coral Polifónica de Formentera es gratuita.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;3.- Las pruebas de acceso a la Escuela Municipal de Música y Danza son gratuitas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;4.- Para la expedición del título de Grado Elemental, las tasas las impone la Consejería mediante la publicación anual en el BOIB.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 6 Bonificaciones&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1.- Se aplicará una bonificación del 30% del importe de la tasa a las personas integrantes de las familias numerosas que tengan reconocida tal condición, que deberá ser acreditada mediante el título oficial establecido al efecto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2.- La misma bonificación se aplicará a las personas usuarias que tengan reconocida por el órgano competente una discapacidad del 33%.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;3.- Bonificación familiar del 25%, a aquellas familias que haya dos o más personas integrantes matriculadas en la Escuela Municipal de Música y Danza, el segundo o siguientes personas integrantes tendrán una bonificación del 25% de la tasa estipulada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 7 Normas de gestión&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;1. La tasa se devenga en formalizar la inscripción en el curso correspondiente y en este momento nace la obligación de pago de la misma.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;2. No obstante lo anterior, los cursos y materias se podrán pagar, a la elección de la persona interesada, de una sola vez o de manera fraccionada de acuerdo con el siguiente criterio:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left:35.45pt;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;30% del importe global al formalizar la matrícula&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left:35.45pt;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;70% restante en 8 plazos mensuales, de importe igual cada uno&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;3. En todo caso, el pago de la tasa por los servicios y actividades relacionados en el artículo 5 deberá hacerse efectivo dentro del periodo de cobro y en la forma que establezca el Consell de Formentera.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;4. En ningún caso se devolverá el importe de la cuota tributaria acreditada de acuerdo en el apartado primero de este artículo. (exceptuando un periodo de prueba de 15 días contando a partir del primer día de inicio de las clases)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Artículo 8 Infracciones y sanciones&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Para todo lo que se refiere a la calificación de infracciones tributarias, así como a las sanciones que correspondan en cada caso, se estará a lo dispuesto en la Ordenanza fiscal general y los artículos 178 y siguientes de la Ley General Tributaria y demás disposiciones que la desarrollen y complementen.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Disposición final&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;Para la entrada en vigor de esta Ordenanza, se estará a lo dispuesto en el artículo 103 en relación con el artículo 113, de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, y permanecerá vigente hasta que se modifique y / o derogue.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: rgb(34, 34, 34);"&gt;&amp;nbsp; &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px; text-align: center;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Formentera, 2 de febrero de 2016.&lt;/span&gt;&lt;/p&gt;
