	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En relación con el asunto de referencia, y de acuerdo con el artículo 23 de la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se publica el Acuerdo del Pleno de la CMAIB, en sesión de 18 de diciembre de 2015,&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;"&lt;em&gt;CONSIDERANDO&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Que TIRME SA ha solicitado una modificación de la AAI consistente en el cambio en la gestión de las aguas pluviales de la Planta de Tratamiento de Escorias y del Depósito de Seguridad.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Que la documentación aportada justifica que se trata de una modificación no sustancial, en cumplimiento del art. 10.2 de la Ley 16/2002, de 1 de julio y del arte. 14 del RD 815/2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Que se ha recibido informe de la dirección insular de Gestión de Residuos del Consell de Mallorca y del servicio de Estudios y Planificación de la DG de Recursos Hídricos ambos favorables, consideran la modificación como no sustancial y proponen una serie de condicionantes .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;ACUERDA&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;informar favorablemente el otorgamiento de la modificación no sustancial de la Autorización Ambiental Integrada de COTIR de Son Reus, consistente en el cambio en la gestión de las aguas pluviales de la Planta de Tratamiento de Escorias y del Depósito de Seguridad, con las condiciones de explotación, capacidad y procesos indicados en el documento técnico que acompaña la solicitud y con sujeción a las siguientes condiciones:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Se modifica el condicionante 7.1.3 relativo al depósito de seguridad para segregar las dos balsas existentes, una como balsa de lixiviados y la otra como balsa de pluviales:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7.1.3 DS&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Lixiviados. Hay una balsa de lixiviados de 5.500 m3, debidamente impermeabilizada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Los lixiviados provienen de la cuenca del depósito (31,65 ha), las aguas de limpieza del interior de la PTE, del fondo del vaso del DS.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;De allí se pueden conducir al depósito de aguas usadas de la PIRE, el depósito de pluviales de la PIRE, el tanque de pluviales sucias de la APIRE y / o al tanque de homogeneización la APIRE; también se utilizarán al mismo DS para riego.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Pluviales. Hay una balsa de pluviales de 5.500 m3, debidamente impermeabilizada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Las aguas pluviales provenientes de las cubiertas de la PTE y los taludes sellados definitivamente del DS.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Agua potable. Conexión a la red de abastecimiento municipal. Se consumirán 4,25 m3 anuales.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Aguas sanitarias. Conexión a la red de alcantarillado municipal. Verterán 3,75 m3 año.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Se modifica el condicionante 7.3 relativo al programa de vigilancia del DS para añadir los controles requeridos en las aguas pluviales.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7.3 Programa de vigilancia del DS&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por el APIRE se seguirá el mismo seguimiento de la calidad que la PIRE.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Se modifica el condicionante 7.5 relativo al control de drenaje de pluviales y valores límite de emisión, a fin de indicar que este condicionante también es relativo al control de las aguas pluviales del DS.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7.5 Control de drenaje de pluviales y valores límite de emisión&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Las instalaciones comparten la gestión de aguas pluviales que se aprovechan en su mayor parte, pero en casos de emergencia se vierten al sistema de drenaje que llegan a cauce público.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Para controlar estos vertidos se llevará a cabo un control de calidad en el tanque de pluviales sucias, el tanque de pluviales limpias de la APIRE ya la balsa de pluviales del DS. Se establecen también los siguientes valores límite de emisión:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;La periodicidad de los controles será como mínimo mensual, y en todo caso en caso de episodios de lluvias.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;En caso de vertido se tomará una muestra al tanque de pluviales limpias y el tanque de pluviales sucias y en la balsa de pluviales.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;A efectos de notificación de las emisiones en PRTR se llevará a cabo un control real del volumen vertido a la red de drenaje y un control meteorológico que justifique la necesidad de efectuar el vertido de emergencia.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Se recuerda que en cumplimiento del artículo 82 de la Ley 7/2013, de 26 de noviembre, de régimen jurídico de instalación, acceso y ejercicio de actividades en las Illes Balears, para el inicio y ejercicio de la actividad, el titular deberá presentar una declaración responsable de inicio y ejercicio de la actividad ante la consejería competente en materia de medio ambiente, acreditativa de las obras realmente ejecutadas y, si es necesario, las variaciones entre el proyecto presentado en la sollicitud y lo realmente ejecutado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;La declaración responsable deberá acompañarse del certificado final de obra del técnico director. "&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Interposición de recursos&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
