![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Una vez finalizado el plazo de exposición pública sin que se hayan presentado &nbsp;alegaciones, ha resultado aprobada definitivamente la modificación de la Ordenanza fiscal reguladora de la tasa para la recogida, tratamiento y eliminación de residuos sólidos.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Se publica el texto íntegro de la misma, para su entrada en vigor y aplicación, en cumplimiento de lo previsto en el artículo 103, de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local, que es el siguiente:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;">"<strong>ORDENANZA FISCAL REGULADORA DE LA TASA POR LA RECOGIDA, TRATAMIENTO Y ELIMINACIÓN DE RESIDUOS SÓLIDOS. (Pleno de 26/11/2015)</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 1. Fundamento y Naturaleza</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/85 de 2 de abril, reguladora de las bases de Régimen Local; al amparo de lo previsto en los artículos 57 y 20. 4, s) del Real Decreto Legislativo 2/2004 de 5 de marzo por el que se aprueba el texto refundido de la ley Reguladora de las Haciendas Locales y de conformidad con lo se disponen los artículos 15 a 19 del citado texto refundido, y artículos 100 y siguientes de la Ley 20/2006, de 15 de diciembre municipal y de régimen local de las Islas Baleares, este Ayuntamiento establece la tasa por la prestación del servicio de recogida , tratamiento y eliminación de residuos sólidos, que se regirá por la presente Ordenanza Fiscal.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 2. Hecho imponible.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Constituye el hecho imponible de la tasa la prestación del servicio de recepción obligatoria de recogida, tratamiento y eliminación de residuos sólidos procedentes de las viviendas, locales y establecimientos donde se ejerzan actividades comerciales, profesionales, industriales y de servicios, ubicados en las zonas de prestación del servicio.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Es de carácter general y obligatorio la prestación del servicio de recogida de basuras.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. A tal efecto, se consideran basuras domiciliarias y residuos sólidos urbanos los restos y desperdicios alimentarias o detritus procedentes de la limpieza normal de locales y viviendas y se excluyen de tal concepto los residuos de tipo industrial, escombros de obras, detritus humanos, materias y materiales contaminados, corrosivos, peligrosos o los que su recogida o vertido exija la adopción de especiales medidas higiénicas, profilácticas o de seguridad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La obligación de contribuir nacerá por la simple existencia de la prestación del servicio, que por ser general y de recepción obligatoria entenderá prestado a favor de las viviendas, locales, establecimientos, negocios y otros especificados en el cuadro de tarifas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 3. Sujetos pasivos.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Son sujetos pasivos contribuyentes de la Tasa por la prestación de servicios de recepción obligatoria de recogida, tratamiento y eliminación de residuos sólidos, las personas físicas y jurídicas y las entidades a las que la normativa tributaria impone el cumplimiento de obligaciones tributarias según que dispone el artículo 35 de la Ley 58/2003 de 17 de diciembre, General Tributaria, que ocupan, utilizan o sean titulares de las viviendas, locales o negocios, sitos en plazas, calles, vías públicas o zonas de dominio público donde se presta el servicio, ya sea a título de propietario o de usufructuario, de inquilino, arrendatario, concesionario o, incluso en precario.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Tendrán la consideración de sujetos pasivos sustitutos del contribuyente y, en consecuencia estarán obligados a cumplir con las prestaciones materiales y formales de las obligaciones tributarias, los propietarios de las viviendas, locales y establecimientos, quienes podrán repercutir en su caso las cuotas satisfechas sobre los respectivos beneficiarios.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Cuando un mismo sujeto pasivo tenga distintas actividades en un mismo local la superficie computable a efectos de la tasa será la mayor de las declaradas y la tarifa a aplicar será la mayor de las actividades gravadas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Cuando en un mismo local realizan actividades distintos sujetos pasivos, tributará cada uno de ellos por la superficie computable a la actividad que realice.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 4. Responsables.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Son responsables tributarios las personas físicas o jurídicas determinadas como tal en la Ley General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. La derivación de responsabilidad requerirá que, previa audiencia del interesado, se dicte acto administrativo, en los términos previstos en la Ley General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas o jurídicas que se refieren los artículos 38.1 y 39 de la ley General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Serán responsables subsidiarios los administradores de las sociedades y los síndicos interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con el alcance que señala el artículo 40 de la ley General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 5. Cuota Tributaria.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La cuota tributaria consistirá en una cantidad fija, por unidad, que se determinará en función de la naturaleza y el uso o destino de los inmuebles en los que se desarrolla la actividad generadora del residuo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2.A efectos se aplicarán las siguientes tarifas:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Las cuotas señaladas en la tarifa tienen carácter irreducible y corresponden a una anualidad.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 6. Devengo.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La tasa se devenga y nace la obligación de contribuir desde el momento en que se inicia la prestación del servicio, que se entenderá iniciado, dada la naturaleza de recepción obligatoria, cuando esté en funcionamiento el servicio municipal de recogida de residuos sólidos urbanos en las calles, plazas, caminos o lugares donde se encuentran las viviendas o locales.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El período impositivo coincide con el año natural, devengándose el tributo del 1 de enero de cada año, siendo las cuotas irreducibles, salvo en los supuestos de altas, que se repartirá por trimestres naturales que restan hasta la finalización del año con inclusión del propio de la alta o solicitud.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. En el caso de edificaciones de nueva planta, el devengo comenzará el día de la emisión de la cédula de habitabilidad o de la expedición del certificado de final de obra.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Los cambios de titularidad en la propiedad de los inmuebles, así como las variaciones de los titulares en la actividad económica de que se trate y en el uso de los locales, producirán efecto en el ejercicio siguiente y deberán ser acreditados mediante copia de escritura, contrato de arrendamiento, etc.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 7. Régimen de declaración e ingreso.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Dentro del treinta días hábiles siguientes a la fecha en que se devengue por primera vez la tasa, el sujetos pasivos formalizarán su inscripción en la matrícula y presentarán al efecto, la declaración de alta, e ingresarán simultáneamente, la cuota que les corresponda.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Cuando se conozca, de oficio o por comunicación de los interesados ​​cualquier variación de los datos que figuran en el padrón, se efectuará las modificaciones correspondientes, que tendrán efecto a partir del ejercicio siguiente al de la fecha en que se haya realizado la declaración, o se haya producido la variación.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El cobro de las cuotas se efectuará anualmente, mediante recibo en el período que determine el Ayuntamiento, excepto en el supuesto de altas, que se hará mediante autoliquidación que presentará el sujeto pasivo.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Para la exacción de la tasa se formará y aprobará anualmente el correspondiente Padrón, comprensivo de la relación de todos los obligados al pago, en los términos establecidos en la normativa vigente.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Artículo 8. Infracciones y sanciones.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En todo lo que se refiere a la calificación de infracciones tributarias, así como de las sanciones que a las mismas correspondan en cada caso, se estará a lo dispuesto en el Título IV de la Ley 58/2003 de 17 de diciembre General Tributaria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Disposición final.</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Esta ordenanza fiscal entrará en vigor a partir del día 1 de enero de 2016, y deroga cualquier otra que existiera y esté en contradicción con esta.
