	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;De acuerdo con lo establecido en el artículo 59.5 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, modificada por la Ley 4/99, de 13 de enero, ya que no se ha podido localizar al interesado, mediante este anuncio se notifica a &lt;/span&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;con DNI &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;, en relación al expediente 176/2011 de la línea de ayudas&amp;nbsp; para la Modernización de las explotaciones agrícolas, correspondientes al año 2011, la siguiente Resolución de concesión de la ayuda, firmada con fecha 20 de junio de 2013 por el vicepresidente del FOGAIBA,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Visto el artículo 6 del Decreto 65/2007 de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la Comunidad Autónoma de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Considerando la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 4 de diciembre de 2012, por la que se modifica la Orden de la Consejera de Agricultura y Pesca de 18 de diciembre de 2007 y se aprueba el texto refundido de la Orden de bases reguladoras de la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2007-2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vista la Resolución del Presidente del FOGAIBA de 4 de febrero de 2011, por la que se convocan, mediante el procedimiento anticipado de gasto, para el ejercicio 2011, subvenciones destinadas a la modernización de las explotaciones agrícolas, y posterioriores resoluciones de incremento del crédito de día 20 de mayo de 2011, 22 de junio de 2012 y 1 de agosto de 2012.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver individualmente este expediente sin afectar lo dispuesto en el apartado séptimo de la Resolución del Presidente del FOGAIBA de 4 de febrero de 2011.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dada la solicitud de ayuda presentada por &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;, con DNI/CIF núm. &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, y según los criterios de elegibilidad, que figuran en el informe técnico de día 5 de junio de 2013, sobre el cumplimiento de los requisitos exigidos en la Resolución mencionada y de la cuantificación de la inversión subvencionable, al importe declarado en la solicitud se hace la deducción de las inversiones que no son elegibles para esta línea de ayudas, por un importe de 0,00 euros, con lo que el importe máximo elegible de la inversión, es de 34.160,00 euros, por las inversiones siguientes:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dada la evaluación previa de la subvención máxima posible, de acuerdo con los criterios objetivos de evaluación establecidos en el apartado quinto de la Resolución de 4 de febrero de 2011, realizada por la Sección de Ayudas al Desarrollo Rural, la Comisión Evaluadora y el Jefe de servicio de Ayudas al Desarrollo Rural, el porcentaje de la actuación que corresponde subvencionar será del 40% por ser Agricultor profesional y la explotación estar en otras zonas diferentes a zona de montaña, zona desfavorecida o zona Red Natura 2000 y la ayuda máxima concedida será de 13.664,00 euros.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dado el informe de la Comisión Evaluadora de día 20 de junio de 2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Considerando la propuesta del Jefe del Servicio de Ayudas al Desarrollo Rural de día 20 de junio de 2013,&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;RESUELVO:&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1.-Conceder una subvención a favor: &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;, con CIF/NIF/DNI núm. &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, dada su solicitud de ayuda, en el marco de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 4 de febrero de 2011 (expediente núm. 176/2011).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2.-El importe de la ayuda para la modernización de la explotación agrícola que se puede conceder es de 13.664,00 euros, cofinanciados por FEADER en un 35%, 40% AGE y 25%, CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;a) 4.782,40 Euros con cargo a la línea FEADER nº 050405011211004.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;b) 8.881,60 Euros con cargo a los presupuestos vigentes del FOGAIBA, de &amp;nbsp;los cuales corresponden 5.465,60 euros al AGE y&amp;nbsp; 3.416,00 euros en la CAIB.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3.- Autorizar y disponer un gasto de hasta 13.664,00 euros, a favor de &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;, con DNI/CIF núm. &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, de acuerdo con la distribución que se establece en el apartado anterior.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;El plazo y forma de justificación del cumplimiento de la finalidad de la ayuda será de acuerdo con lo establecido en los apartados 4, 10 y 11 de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 4 de febrero de 2011 el beneficiario se obliga a:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;-Llevar a cabo y notificar las inversiones auxiliares, y solicitar su pago, dentro del plazo establecido: 6 meses&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Justificar los gastos relacionados con la inversión.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Ejercer la actividad agraria en la explotación objeto de ayuda y mantener las inversiones realizadas durante al menos cinco años contados desde la fecha de la concesión de la ayuda; así como mantener los requisitos y condiciones exigibles respecto a las condiciones de la explotación y beneficiario durante este período.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Cumplir las normas comunitarias aplicables a la inversión de la que se trate y las específicas que puedan señalarse en función del tipo de explotación.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad. Para acciones que supongan inversiones que superen un coste total de 50.000 euros, el beneficiario deberá colocar una placa explicativa con las características indicadas en el punto 9 del apartado 4.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Someterse a los controles que lleve a cabo la administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4.- Notificar esta Resolución al interesado, informándole que contra ésta, que no agota la vía administrativa, se puede interponer recurso de alzada ante el Consejero de Agricultura, Medio Ambiente y Territorio, en el plazo de un mes, a contar a partir del día siguiente a la fecha de recepción de la notificación de la presente resolución, de acuerdo con lo establecido en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y en los artículos 114 y 115 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, modificada por la Ley 4/99, de 13 de enero.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
