	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;CÉDULA DE NOTIFICACIÓN DE SENTENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;En el procedimiento de referencia se ha dictado la resolucióndel tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;SENTENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;En la Ciudad de Inca, a dieciséis de julio de dos mil quince.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;La Sra. Dª. Mª VICTORIA PELUFO ENGUIX, Magistrado-Juez del Juzgado de Primera Instancia número 2 de esta Ciudad y su Partido, habiendo visto los autos del juicio ordinario con el número 1002/13 seguidos a instancia de JORDI, MARIA ROSA y MARIA CRISTINA SIVILA COSTA, representado por el Procurador de los Tribunales PEDRO PUIGDELLIVOL ALOU y dirigido por el Letrado SEBASTIAN ROMAGUERA, contra SEBASTIAN GALMES ISERN, representado por la Procuradora de los Tribunales JUANA MARIA SERRA LLULL y dirigido por la Letrada Antonia Munar Ferragut, y contra la entidad “JARDINERIA Y CONTRATAS MALLORQUINA DE SERVICIO, S.L.” , declarado en rebeldía, sobre resolución de contrato de compraventa, se procede a dictar la siguiente resolución, en base a los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;FALLO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;1.-Estimando la demanda interpuesta por el Procurador de los Tribunales PEDRO PUIGDELLIVOL, en nombre y representación de JORDI, MARIA ROSA y MARIA CRISTINA SIVILA COSTA, contra SEBASTIAN GALMES ISERN y la entidad JARDINERIAS Y CONTRATAS MALLORQUINAS S.L., DEBO DECLARAR Y DECLARO:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;1.-La resolución del contrato publico de compraventa de las fincas regístrales 9941 y 9942 suscrito ante el Notario de Palma D. Luis Pareja fecha 13 de julio de 1.999, por incumplimiento de la obligación de pago del precio pactado por la parte compradora “Jardinería y Contratas Mallorquinas de Servicio, S.L.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;2.-Se proceda a dar posesión judicial de las fincas descritas en el fundamento jurídico segundo de esta resolución, acordando el lanzamiento de los ocupantes si fuera necesario;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;3.-se expida mandamiento al registrador de la Propiedad a los efectos de restituir la titularidad registral de las fincas descritas en el fundamento jurídico segundo de esta resolución a favor de los actores,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;2.&lt;/strong&gt;-Se imponen a la entidad codemandada las costas causadas en esta instancia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;Recurso.&lt;/strong&gt; Contra esta resolución cabe interponer recurso de apelación en el plazo de veinte días a contar desde el siguiente al de su notificación. En la interposición del recurso el apelante deberá exponer las alegaciones en que se base la impugnación, además de citar la resolución apelada y los pronunciamientos que impugna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;Depósito para recurrir.&lt;/strong&gt; Conforme a la D.A. Decimoquinta de la L.O.P.J., para la admisión del recurso se deberá acreditar haber constituido, en la cuenta de depósitos y consignaciones de este órgano, un depósito de 50 euros, salvo que el recurrente sea: beneficiario de justicia gratuita, el Ministerio Fiscal, el Estado, Comunidad Autónoma, entidad local u organismo autónomo dependiente de alguno de los anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;El depósito deberá constituirlo ingresando la citada cantidad en la cuenta de este expediente indicando, en el campo "concepto" la indicación "Recurso" seguida del código "02 Civil-Apelación".Si el ingreso se hace mediante transferencia bancaria deberá incluir, tras la cuenta referida, separados por un espacio la indicación "recurso" seguida del código "02 Civil-Apelación."&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;En el caso de que deba realizar otros pagos en la misma cuenta, deberá verificar un ingreso por cada concepto, incluso si obedecen a otros recursos de la misma o distinta clase indicando, en este caso, en el campo observaciones la fecha de la resolución recurrida con el formato DD/MM/AAAA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;Así por esta mi sentencia, de la que se expedirá testimonio para su unión a los autos, la pronuncio, mando y firmo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;Y como consecuencia del ignorado paradero de JARDINERIA CONTRATAS MALLORQUINAS DE SERVICIO S.L., se extiende presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;En INCA, a diecinueve de Octubre de dos mil quince.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size:12px;"&gt;&lt;span style="font-family:times new roman,times,serif;"&gt;&lt;strong&gt;EL/LA SECRETARIO/A JUDICAL &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
