	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Notificación de la Resolución de concesión de ayuda, exp. 112/2014, el titular del cual es GRUPO ISERN, SL, al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 24 de junio de 2014 por la que se convocan subvenciones para la línea de Modernización de las explotaciones agrícolas, correspondientes al año 2014.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El apartado 9.3 de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 24 de junio de 2014 por la que se convocan subvenciones para la Modernización de las explotaciones agrícolas, correspondientes al año 2014, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento de lo dispuesto en el artículo 59 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El vicepresidente del FOGAIBA, a fecha de 14 de setiembre de 2015, firma la siguiente Resolución:&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Visto el artículo 6 del Decreto 65/2007 de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la Comunidad Autónoma de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Considerando la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 4 de diciembre de 2012, por la que se modifica la Orden de la Consejera de Agricultura y Pesca de 18 de diciembre de 2007 y se aprueba el texto refundido de la Orden de bases reguladoras de la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2007-2013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Vista la Resolución del Presidente del FOGAIBA de 24 de junio de 2014, por la que se convocan, para el ejercicio 2014, subvenciones destinadas a la modernización de las explotaciones agrícolas, y posterior resolución de incremento del crédito de día 23 de septiembre de 2014.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Considerando la propuesta de denegación de día 10 de febrero de 2015 y la posterior alegación aceptada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Considerando la solicitud de ayuda presentada por &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;GRUPO ISERN, SL con&amp;nbsp; DNI/CIF núm. B/07207830&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, y según los criterios de elegibilidad, que figuran en el informe técnico de día 3 de setiembre de 2015, sobre el cumplimiento de los requisitos exigidos en la Resolución señalada &amp;nbsp;y de la cuantificación de la inversión que no son elegibles para esta línea de ayudas, por un importe de 0,00 euros, de manera que el importe máximo elegible de la inversión es de 10.766,12 euros para las siguientes inversiones:.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dada la evaluación previa de la subvención máxima posible, de acuerdo con los criterios objetivos de evaluación establecidos en el apartado quinto de la Resolución de 24 de junio de 2014, realizada por la Sección XVI de Ayudas al Desarrollo Rural, el porcentaje de la actuación que corresponde subvencionar será del 30% para ser Entidad jurídica no prioritaria y la explotación estar en zona desfavorecida, y la ayuda máxima concedida será de 3.229,84 euros.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Dada la propuesta del Jefe del Servicio de Ayudas al Desarrollo Rural de día 4 de setiembre de 2015.&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;RESUELVO&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Conceder una subvención a favor: &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;, con CIF/NIF/DNI núm. &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, dada su solicitud de ayuda, en el marco de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 24 de junio de 2014 (expediente núm. 112/2014).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. El importe de la ayuda para la modernización de la explotación agrícola que se puede conceder es de 3.229,84 euros, cofinanciados por FEADER en un 35%, 40% MAGRAMA y 25%, CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 35.4pt"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;a) 1.130,44 Euros con cargo a la línea FEADER núm. 050405011211004 del año 2015.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 35.4pt"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;b) 2.099,40 Euros con cargo al presupuesto del año 2015, los cuales corresponden 1.291,94 euros al MAGRAMA y 807,46 euros en la CAIB.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. &amp;nbsp;Autorizar y disponer un gasto de hasta 3.229,84 euros, a favor &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt; con DNI/CIF núm. &lt;/span&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, de acuerdo con la distribución que se establece en el apartado anterior.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;El plazo y forma de justificación del cumplimiento de la finalidad de la ayuda será de acuerdo con lo establecido en los apartados 4, 10 y 11 de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 24 de junio de 2014 beneficiario se obliga a:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Realizar las inversiones o actividades auxiliadas, dentro del plazo establecido: hasta el 30 de septiembre de 2015.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&amp;nbsp;- Justificar los gastos relacionados con la inversión.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Ejercer la actividad agraria en la explotación objeto de ayuda y mantener las inversiones realizadas durante al menos cinco años contados desde la fecha de la concesión de la ayuda; así como mantener los requisitos y condiciones exigibles respecto a las condiciones de la explotación y beneficiario durante este período.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Los jóvenes agricultores que se acojan a las medidas de instalación&amp;nbsp; y modernización, &amp;nbsp;al mismo tiempo, deberán cumplir, además, el resto de obligaciones que les son impuestas para ser beneficiarios de la subvención para la instalación de jóvenes. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Cumplir las normas comunitarias aplicables a la inversión de la que se trate y las específicas que puedan señalarse en función del tipo de explotación.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad. Para acciones que supongan inversiones que superen un coste total de 50.000 euros, el beneficiario deberá colocar una placa explicativa con las características indicadas en el punto 9 del apartado 4.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Someterse a los controles que lleve a cabo la administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Notificar esta Resolución al interesado, informándole que contra ésta, que no agota la vía administrativa, se puede interponer recurso de alzada ante el Consejero de Agricultura, Medio Ambiente y Territorio, en el plazo de un mes, contado a partir del día siguiente a la fecha de recepción de la notificación de la presente resolución, de acuerdo con lo que se establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y en los artículos 114 y 115 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, modificada por la Ley 4/99, de 13 de enero.”&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
