	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;En relación con el asunto de referencia, y de acuerdo con el artículo 23 de la Ley 16/2002, de 1 de julio, de prevención y control integrados de la contaminación, se publica el Acuerdo del Pleno de la CMAIB, en sesión de 17 de septiembre de 2015,&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;“&lt;em&gt;CONSIDERANDO&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1.Que, GAS Y ELECTRICIDAD GENERACIONES es titular de la AAI de la CT de Alcúdia, y ha solicitado a la CMAIB la adaptación de la misma a:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;a. La Resolución por la cual se concede a la empresa GAS Y ELECTRICIDAD GENERACIÓN autorización administrativa para la clausura y sellado parcial (extremo sur) del vertedero de residuos no peligrosos de Biniatria, de 26 de junio de 2015, de la directora general de Medio Natural, Educación Ambiental y Cambio Climático.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;b.la Resolución por la cual se concede a la empresa GAS Y ELECTRICIDAD GENERACIÓN SAU autorización administrativa para la clausura y sellado del antiguo vertedero de residuos no peligrosos de Biniatria”, de 1 de julio de 2015, de la directora general de Medio Natural, Educación Ambiental y Cambio Climático.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;2.Que ambas resoluciones establecen una serie de condicionantes no incluidos en la autorización ambiental integrada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3.Que se han emitido informe técnico y jurídico de la CMAIB.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;ACUERDA&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;informar favorablemente la adaptación de la Autorización Ambiental Integrada de la CT de Alcúdia, a la Resolución por la cual se concede a la empresa GAS Y ELECTRICIDAD GENERACIÓN autorización administrativa para la clausura y sellado parcial (extremo sur) del vertedero de residuos no peligrosos de Biniatria de fecha 26 de junio de 2015 y la Resolución por la cual se concede a la empresa GAS Y ELECTRICIDAD GENERACIÓN SAU autorización administrativa para la clausura y sellado del antiguo vertedero de residuos no peligrosos de Biniatria de fecha 1 de julio de 2015, con sujeción a las siguientes condiciones:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1.Se modifica el condicionante 6.6.2 para añadir el control y mantenimiento de la vegetación a su punto 8, el cual queda redactado de la siguiente forma:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;8. La periodicidad con la qué se tiene que efectuar el control topográfico es el que se establece en la tabla siguiente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.5 Fase de clausura y post clausura – Adecuación del vertedero, para añadir los condicionantes concretos de las celdas actualmente en explotación y que fue objeto del expediente de modificación sustancial de la autorización IPPC M15/2009 consistente en la adecuación del vertedero de cenizas de Biniatria&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.6 Fase de clausura y post clausura – Prescripciones generales, donde se da cabida a todos aquellos condicionantes comunes para las tres clausuras&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;La redacción de estos puntos queda de esta forma:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.3 Fase de clausura y post clausura - Antiguo vertedero&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1. Se tendrá que garantizar la estabilidad de la masa de residuos a largo plazo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;2. Según el acuerdo del el Pleno de la Comisión de Medio ambiente de las Islas Baleares de fecha 2 de junio de 2015 que informó favorablemente el proyecto de sellado y clausura del antiguo vertedero de Biniatria:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;a.Entre el vertedero y el Parque Natural, se tienen que crear todo un conjunto de pantallas vegetales con especies autóctonas. Las especies que se elegirán para conformar estas barreras tendrán que lograr alturas adecuadas para retener estas partículas, si no, se tendrán que realizar acopes de tierra para esta finalidad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;b.Se tiene que llevar a cabo el dragado, en una extensión de 2.200 metros, del lecho del canal des Murterar. Esta actuación se tendrá que realizar entre los meses de agosto a febrero (ambos incluidos) para evitar alterar la fauna reproductora. Hay que mencionar, que este condicionante ya se recogió en el ACUERDO del Pleno de la CMAIB de 3 de mayo de 2012 en cuanto al proyecto “Adecuación del Vertedero de “Biniatria” para abocar residuos no peligrosos” (BOIB ním. 96 de 5 /07/ 2012), pero todavía no se ha ejecutado.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;c.Los depósitos de material y maquinaria estarán siempre a una distancia mínima de 10 m del terreno forestal existente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;d.el tratamiento de la vegetación será el estrictamente necesario. Se respetará la flora protegida. Los restos vegetales producidos se tendrán que eliminar en un plazo máximo de 10 días desde su generación, para evitar la proliferación de plagas y la propagación de posibles incendios.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;e.Los productos vegetales residuales podrán ser tratados de la siguiente manera:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;i.Trituración mediante maquinaria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;ii.Transporte a vertedero o fuera de la zona forestal, para crema o trituración.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;f.Todos los operarios participantes en las actividades, tanto de las obras como de la fase de explotación serán instruidos en la existencia de riesgo de incendio forestal, en las medidas de prevención a adoptar, en las actuaciones inmediatas a efectuar ante un connato de incendio y conocerán el número telefónico de comunicación en caso de incendios forestal (112).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;g.Se instalará señalización de riesgo de incendios forestales para recordar el riesgo de incendios existente en todas las instalaciones.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;h.En cuanto a la revegetación, el proyecto contempla la implantación por siembra de herbáceas no haciendo mención a la implantación de arbustos y árboles, para evitar problemas radiculares con la capa de impermeabilización. Este método será suficiente si la revegetación natural se comprueba que es viable y no compromete situaciones de procesos erosivos por falta de sostén radical de los taludes. En este caso se pueden utilizar métodos de protección de la erosión como la utilización de “microconcas” o pequeños diques hechos con ramas o piedras, para conseguir una mejor retención de suelo y agua&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;i.Para ejecutar la faja de prevención de incendios, con desbroce y poda del arbolado y, si procede tala de pies, se hará un replanteo in-situ de la actuación con el personal técnico de la Consejería de Medio ambiente y Movilidad que corresponda. El proyecto tiene que contemplar el mantenimiento de estos trabajos silvícolas hasta que la actividad del vertedero llegue a su fin.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3.el sellado del antiguo vertedero contempla tres acciones diferentes: drenaje superficial, barrera hidráulica y desvío y canalización de torrentes y vaguadas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;4.Drenaje superficial&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;a.la plataforma superior tendrá una configuración que permita la rápida evacuación de las aguas de escorrentía en dirección a las arquetas de las canalizaciones proyectadas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;b.la disposición de las diferentes canalizaciones garantizarán la correcta evacuación del agua a toda la superficie de la plataforma principal.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;c.una vez depositada la tierra vegetal se comprobará la inexistencia de zonas bajas donde se pueda producir la acumulación del agua en épocas de lluvias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;d.Todas las canalizaciones de recogida de aguas pluviales tendrán la pendiente necesaria en las diferentes zonas para la correcta circulación del agua y serán impermeables.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;e.El agua recogida por el sistema de canalizaciones será dirigida hacia el torrente y en ningún caso se realizará el vertido en el interior de los vasos del vertedero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;f.una vez instalada la tierra vegetal se tiene que realizar una hidrosembra de protección suficiente para evitar la erosión de la tierra de cobertura debido al agua y el viento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;g.la revegetación de la superficie de la plataforma y taludes estará diseñada para garantizar la estabilidad del nivel de tierra vegetal y la integración paisajística de la zona sellada. En ningún caso se realizará la siembra de especies que puedan representar un riesgo por la zona clausurada y las especies seleccionadas tendrán un bajo requerimiento hídrico.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;5.Barrera hidráulica&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;a.Los residuos generados durante la perforación de la masa de residuos se depositará dentro de los vasos en explotación del vertedero, siempre y cuando cumplan los criterios de admisión de la orden AAA/661/2013, de 18 de abril, por la cual se modifican los anejos I, II y III del Real decreto 1481/2001, de 27 de diciembre, por el cual se regula la eliminación de residuos mediante depósito a vertedero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;b.en el caso de excedente de aguas de drenaje de la barrera hidráulica, no se puede abocar en la red de drenaje superficial sin asegurar previamente la inocuidad y siempre que se dé cumplimiento a aquello dispuesto en su punto 7.9.5.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.Desvío y canalización de torrentes y vaguadas&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;a.Los tramos de canalización constituidos, el primero por un canal trapezoidal de base 1.70 metros, ángulo 60º, 323,50 metros de recorrido, pendiente 0,5%, entre PK 0+ 635 y PK 0+959, y el segundo por un canal trapezoidal de base 1.80 metros, ángulo 60º, 361.02 metros de recorrido, pendiente 0,863%, entre PK 0+959 y PK 1+320, se consideran Dominio Público Hidráulico, puesto que constituyen la restitución del tramo de cauce afectado en su día por la excavación. En consecuencia el ámbito de la actuación está afectado por Dominio Público Hidráulico, zonas de servidumbre y zonas de policía de cama pública.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;b.Todas las canalizaciones de recogidas de aguas pluviales estarán hormigonadas, tendrán morfología de media caña, la pendiente necesaria en las diferentes zonas para la correcta circulación del agua, serán impermeables y nunca quedarán por debajo de la masa de residuos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;c.El agua recogida por este sistema de canalizaciones será dirigida hacia el torrente originario y, en ningún caso, se realizará el vertido en el interior de los vasos del vertedero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;7.Se instalaran al menos 10 hitos para el control de los posibles movimientos que sufra el vaso durante el periodo de clausura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.4 Fase de clausura y post clausura - Extremo sur del vertedero&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1. El sellado del extremo sur tendrá que garantizar la impermeabilización de la masa de residuos y una durabilidad como mínimo de 30 años.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;2. Los taludes estarán impermeabilizados siguiendo la siguiente solución:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Capa impermeable de Trisoplast© o similar de 7cm. En caso de optar por una manta de bentonita, el contenido con bentonita será como mínimo de 5,0 kg/m2, se encapsulará entre dos geotéxtiles , impermeabilidad inferior a 1•10-11 m/s y esté protegida contra posibles agresiones químicas que puedan desestabilizar el material.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de una lámina de PEAD de 2mm de grosor tipo Atarfil-HD o similar.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel de drenaje constituido por un geodren con características de transmisividad que garanticen la correcta evacuación de los lixiviados generados.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel filtrando anticontaminación constituido por un nivel de 15 cm de material granular con medidas comprendidas entre 20-40 mm.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Los taludes tendrán una altura máxima de 10 m separados por bermas de 4 m de anchura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3.la plataforma se impermeabilizará siguiendo la siguiente solución:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel de regularización de 15 cm.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de una capa impermeable de Trisoplast© o similar de 7cm. En caso de optar por una manta de bentonita, el contenido con bentonita será como mínimo de 5,0 kg/m2, se encapsulará entre dos geotéxtiles , impermeabilidad inferior a 1•10-11 m/s y esté protegida contra posibles agresiones químicas que puedan desestabilizar el material.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel de drenaje constituido por un geodren con características de transmisivitdad que garanticen la correcta evacuación del agua de escorrentía subsuperficial.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de capa de cobertura constituida de 60 cm de tierra y suelo edáfico.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-La plataforma tendrá una pendiente mínima de 2% en dirección a las canalizaciones perimetrales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;4.una vez instalada la tierra vegetal se tiene que realizar una hidrosembra de protección suficiente para evitar la erosión.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;5.Los anclajes de los diferentes niveles de sellado tendrán las características técnicas necesarias para asegurar su estabilidad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.el solapamiento entre los diferentes elementos de un mismo nivel se realizará de forma que se asegure su integridad y estabilidad durante todo el periodo post clausura. Se llevará a cabo un control de calidad de las soldaduras de los diferentes niveles.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;7.Todas las canalizaciones de recogida de aguas pluviales estarán hormigonadas, tendrán morfología de media caña, la pendiente necesaria para la correcta circulación del agua, serán impermeables y nunca quedarán por debajo de la masa de residuos. El agua recogida será dirigida hacia el torrente originario.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;8.la revegetación de la superficie de la plataforma y taludes estará diseñada para garantizar la estabilidad del nivel de tierra vegetal y la integración paisajística de la zona sellada. En ningún caso se realizará la siembra de especies que puedan presentar un riesgo por el paquete de sellado y estas tendrán un bajo requerimiento hídrico.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;9.Se instalaran al menos 10 hitos de control por los posibles movimientos que sufra el vaso durante el periodo puesto clausura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;10.Cada 5 años, a contar una vez transcurridos los diez primeros desde la aprobación de la clausura, se realizará la toma de 3 muestras de la manta de bentonita para la realización de los siguientes ensayos: Peso total unitario, grosor, contenido en bentonita, peso geotéxtil tejido, peso geotéxtil no tejido, porcentaje de monmorillonita, resistencia a la tracción y permeabilidad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;11. Los resultados serán comparados con los valores que tiene este material antes de su instalación al vertedero e incluidos en la memoria anual.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.5 Fase de clausura y post clausura - Adecuación del vertedero&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1. Cuando se llegue a finales de la vida útil de cada una de las celdas, se tiene que presentar la petición de clausura al órgano competente, el cual emitirá la correspondiente autorización. La petición se realizará en un periodo inferior a 90 días desde el momento que se llegue a la cota máxima autorizada de las diferentes celdas. Durante el periodo en el cual se emite la autorización de clausura por parte de la administración, se instalará un sellado temporal formado por tierras compactadas de 40 cm de altura o por una lámina de PEAD para evitar la dispersión de partículas y la minimización de los lixiviados.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;2. La Consejería competente en materia de Medio ambiente, por decisión motivada, puede autorizar la clausura de una o más celdas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3. El sellado de cada una de las celdas tendrá que garantizar la impermeabilización de la masa de residuos y una durabilidad como mínimo de 30 años. La superficie de las diferentes celdas estará impermeabilizada siguiendo la siguiente solución, la cual cumple los criterios de coeficientes de permeabilidad establecido en el Real decreto 1481/2001, para residuos no peligrosos:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel de regularización de 15 cm.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de una barrera mineral artificial de 6 cm de grueso, con las características recogidas en el proyecto de ampliación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de un nivel de drenaje para la circulación de las aguas pluviales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de tierras seleccionadas sin compactar de 80 cm en la plataforma y 30 cm en los taludes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;-Colocación de 20 cm de tierras vegetales en toda la superficie de clausura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;4. Los taludes presentarán una pendiente inferior a 2,5H:1V, una altura no superior a 10 m y bermas de 4 m de anchura. La zona de plataforma tendrá una pendiente superior al 2% en dirección a las cunetas perimetrales. Una vez situada la capa vegetal se tiene que realizar una hidrosembra de protección suficiente contra la erosión por agua y viento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;5. Los diferentes niveles de sellado se tendrán que anclar en zonas que aseguren su estabilidad durante el periodo de post-clausura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6. A efectos de gestión y mantenimiento, las aguas pluviales se tienen que conducir superficialmente mediante canaletas. La canalización del Torrente Oeste entrada, hacia el Torrente Oeste salida se hace sepultada. En caso de que en la fase de clausura se modifique esta conducción se revisarán los controles periódicos de las instalaciones&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6.6.6 Fase de clausura y post clausura – Prescripciones generales&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;1. Se instalará un cierre perimetral de cada zona sellada, un cartel informativo en el lateral del vaso el cual quede recogido la fecha de aprobación de la clausura y el tipo de residuos depositados en el vaso.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="display: none;"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;2. Una vez finalizada la etapa de sellado de cada zona, se realizará una inspección por parte de la Consejería competente en materia de Medio ambiente para aprobar la clausura de aquella zona. Esto no disminuirá en ningún caso la responsabilidad de la entidad explotadora en cuanto a la fase de mantenimiento del vertedero durante el periodo post-clausura.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3. Una vez aprobada la clausura de cada zona del vertedero mediante Resolución de la dirección general competente del Gobierno de las Islas Baleares, se darán inicio en la fase de mantenimiento post clausura de aquella zona que, de acuerdo con lo previsto en los artículos 11 y 14.2 del Rd 1481/2001, se fija en un periodo de 30 años.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;4. Después de la clausura definitiva de cada zona del vertedero, y en conformidad con esta AAI, la entidad explotadora será responsable de su mantenimiento, de la vigilancia, análisis y control de los lixiviados del vertedero, y, si procede, de los gases generados, así como del régimen de aguas subterráneas en los alrededores del mismo, todo esto conforme a lo dispuesto en el anexo III, del Real decreto 1481/2001 de 27 de diciembre, por el que se regula la eliminación de residuos mediante depósito en vertedero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;5. Antes de la época de sequía se realizará un desbrose de la superficie ya sellada para evitar la generación de fuegos durante la época de mayor riesgo. Se eliminarán todos los individuos que aparezcan y que supongan un riesgo para los niveles de sellado. Se tendrá especial mención al eliminar las especies arbóreas y arbustivas que aparezcan sobre la superficie sellada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;6. En el supuesto de detectar movimiento que suponga un riesgo para el paquete de sellado se instalaran clinómetros y se notificará al órgano competente en materia de vertederos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;7. La realización de actividades en la zona del vertedero o en una parte durante el periodo post-clausura tendrá que estar en posesión de una autorización previa del órgano competente en materia de residuos. Estas actividades no podrán suponer un riesgo para el sellado del vertedero ni a ninguna de las instalaciones asociadas al vertedero.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;8. En el supuesto de detectar efectos negativos sobre el medio ambiente la empresa GESA notificará en el periodo máximo de una semana este hecho al órgano competente en materia de residuos y al Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;9. El encargado del vertedero tendrá un libro en el cual se recogerá toda la información referente a los análisis y medidas realizadas en el vertedero durante la etapa de post clausura. La información documental se tendrá que conservar un mínimo de 10 años.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span style="color: black;"&gt;3. Se modifica el condicionante 7.9.6 para modificar la frecuencia del control del volumen de lixiviados durante la fase de explotación y la del control del nivel freático de las aguas subterráneas durante la fase de clausura en su punto 8, el cual queda redactado de la siguiente forma:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Contra este acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Pleno de la Comisión de Medio Ambiente de las Illes Balears en el plazo de un mes a contar desde el día siguiente de haber recibido la notificación, de acuerdo con el artículo 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación del acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
