	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;1. La Ley Orgánica 2/2006 de 3 de mayo, de educación, establece que para asegurar la calidad educativa para todo el mundo, la cohesión social y la igualdad de oportunidades, las administraciones tienen que garantizar una adecuada y equilibrada escolarización del alumnado con necesidades específicas de apoyo educativo en centros públicos y centros privados concertados, garantizándoles a la vez los recursos personales y económicos necesarios para ofrecer este apoyo. Bajo los principios de normalización, inclusión, no discriminación e igualdad efectiva en el acceso y permanencia en el sistema educativo, prevé la escolarización del alumnado con necesidades educativas especiales en unidades o centros de educación especial cuando sus necesidades no puedan ser atendidas en el marco de medidas de atención a la diversidad de los centros ordinarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;2. El Decreto 39/ 2011 de 29 de abril, por el cual se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos, establece, en el artículo 27, la creación de unidades educativas específicas en centros ordinarios, para alumnos que presentan necesidades educativas especiales de carácter grave y permanente y que no puedan ser atendidos dentro del marco ordinario de atención a la diversidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;3. El 18 de diciembre de 2014 (NRS 309/2015 de 7 de enero) el Servicio de Apoyo Educativo emite un informe y propone la autorización de una Unidad Educativa Específica en Centro Ordinario (aula UEECO) en el IES Sant Marçal de Marratxí, para poder dar una respuesta educativa adecuada al alumnado con necesidades educativas especiales de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;4. El 30 de enero de 2015 (NRS 114497/2015 de 9 de febrero) el servicio de Proyectos, Obras y Supervisión del Instituto de Infraestructuras y Servicios Educativos y Culturales (IBISEC) emitió informe favorable del aula UEECO en el IES Sant Marçal de Marratxí, dado que las instalaciones se ajustan a lo que dispone el Decreto 39/2011.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;5. El 16 de febrero de 2015 (NRS 389/2015 de 17 de febrero) el Servicio de Apoyo Educativo informó y propuso la autorización de una Unidad Educativa Específica en Centro Ordinario (aula UEECO) en el IES Arxiduc Lluis Salvador de Palma, &amp;nbsp;para poder dar una respuesta educativa adecuada al alumnado con necesidades educativas especiales de la zona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;6. El 28 de abril de 2015 la Dirección General de Educación y Cultura emitió un informe dando el visto bueno a la dotación presupuestaria para implantar las aulas UEECO en el IES Sant Marçal de Marratxí y en el IES Arxiduc Lluis Salvador de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;7. El 5 de junio de 2015, la jefa de Escolarización, Servicios Complementarios de la Enseñanza, Títulos y Convalidaciones emitió informe favorable para la implantación de una unidad UEECO en el IES Sant Marçal de Marratxí y en el IES Arxiduc Lluis Salvador de Palma, vistas las circunstancias y el número de alumnos que tienen un dictamen de escolarización y que solicitan plaza tanto en un centro específico como en un centro ordinario, concluyendo que es imprescindible incrementar el número de plazas en centros específicos tanto para la modalidad de escolarización a jornada completa como para la modalidad de escolarización combinada con centro ordinario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;8. El 8 de junio de 2015, el jefe del Departamento de Planificación y Centros informó favorablemente, &amp;nbsp;la autorización para implantar una Unidad Educativa Específica en Centro Ordinario (aula UEECO) en los centros IES Sant Marçal de Marratxí e IES Arxiduc Lluis Salvador de Palma&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;9. La Dirección General de Planificación e Infraestructuras Educativas tiene la competencia de autorizar las enseñanzas que se tienen que implantar en los centros educativos y, vistas las necesidades y la situación del alumnado, considera pertinente la implantación de estas aulas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;1. La Ley Orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE de 4 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;2. La Ley Orgánica 2/2006 de educación, de 3 de mayo (BOE de 4 de mayo), en redacción dada por la Ley orgánica 8/2013, de 9 de diciembre, para la mejora de la calidad educativa (BOE de 10 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;3. El Decreto 39/2011 de 29 de abril, por el cual se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos (BOIB nº. 78, de 28 mayo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: windowtext"&gt;4. El Estatuto de Autonomía de las Islas Baleares, aprobado por la Ley Orgánica 2/1983, de 25 de febrero (BOE de 1 de marzo), reformado por la Ley Orgánica 1/2007, de 28 de febrero (BOE de 16 de marzo) que, en el artículo 36.2, establece que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Islas Baleares la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades, de acuerdo con lo que disponen los artículos 27 y 149.1.30a de la Constitución Española.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;span style="color: windowtext"&gt;Por todo esto, y a propuesta de la Dirección General de Planificación e Infraestructuras Educativas de fecha 9 de junio de 2015 dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: center;"&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Educación, Cultura y Universidades en el plazo de un mes a contar desde el día siguiente en que se publique en el BOIB, de acuerdo con los artículos 116 y 117 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-size: 12px"&gt;&lt;span style="font-family: times new roman,times,serif"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala Contenciosa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente de la publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
