IG-462/2015-980/2015 ]] ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">La&nbsp; regidora titular del&nbsp; Área&nbsp; de Función Pública y Gobierno Interior&nbsp; y&nbsp; el&nbsp; regidor titular del Área Delegada de Seguridad Ciudadana , de acuerdo con las competencias atribuidas mediante&nbsp; Decretos &nbsp;de Alcaldía núm. 8436, de &nbsp;13.05.2013 (BOIB nº 70, de 18.05.2013) y nº. 954, de 27.01.2014 (BOIB nº 21, de 11.02.2014)&nbsp; han dictado los acuerdos de iniciación de los expedients sancionadores que figuran en el anexo&nbsp; de este edicto. Intentada su&nbsp; notificación,&nbsp; no se ha podido realizar .En consecuencia se pública este aviso, de acuerdo con los artículos 59.5 y 61 de la Ley 30/92, de 26 de Noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común (BOE nº 285, de 27-11-1992), modificada por la Ley 4/1999, de 13 de Enero (BOE nº 12, de 14-01-1999). Los expedientes se tramitarán de acuerdo con el Reglamento Municipal de Régimen Jurídico del Procedimiento General Sancionador (BOIB núm. 21 de 15.02.03) y supletoriamente con el Reglamento de la Comunidad Autónoma (Decreto 14/94, de 10 de Febrero (BOCAIB nº 21 de 17.02.94).Los interesados tienen&nbsp; derecho de promover recusación en cualquier momento de la tramitación por los motivos indicados en el art. 28 de la Ley 30/1992, de 26 de Noviembre (BOE núm. 285 de 27-11-92) y&nbsp; a formular, en el plazo de QUINCE DÍAS HÁBILES, contados a partir del día siguiente al de la publicación de este edicto, las alegaciones que estimen convenientes a sus derechos, aportando las pruebas concretas de que intenten valerse, sin perjuicio de los derechos reconocidos en el artículo 35 de la mencionada Ley 30/1992. El expediente estará&nbsp; a su disposición en el Negociado arriba indicado. De acuerdo con lo dispuesto en los artículos 13.2, en relación con los artículos 18 y 19 del RD 1398/1993 (BOE 189, de 9/8/93), si no efectúan alegaciones en el plazo indicado, este acuerdo de iniciación de expediente podrá considerarse propuesta de resolución. En este caso se propone la sanción que figura en el anexo. En caso de&nbsp; reconocer su responsabilidad el expediente podrá resolverse con la imposición de la sanción correspondiente.&nbsp; El pago voluntario en cualquier momento anterior a la resolución podrá suponer igualmente la finalización del procedimiento, sin perjuicio de interponer los recursos pertinentes. De acuerdo con el artículo 25 del mencionado Reglamento municipal, el plazo máximo para resolver y notificar el procedimiento es de 6 meses desde su iniciación, un año en caso de materia de competencia normativa de la CAIB. En los casos en que el procedimiento se haya paralizado por causas imputables al interesado o por la suspensión del procedimiento a que se refieren los art. 7 y 17 del mencionado Reglamento, se interrumpe el cómputo del plazo para resolver y notificar la resolución.
