	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Notificación de la Resolución de concesión de los beneficiarios de las ayudas, exp. 38/2013, al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 07 de junio de 2.013 por la cual se convocan subvenciones para las Inversiones no Productivas, correspondientes al año 2.013.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El apartado 8.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 07 de junio de 2.013 por la cual se convocan subvenciones para las Inversiones no Productivas, correspondientes al año 2.013, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos que prevee el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas i del Procedimiento Administrativo Común.&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 59 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Común.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El importe de la ayuda concedida se abonará a los beneficiarios mediante transferencia bancaria, una vez justificado el cumplimiento de la finalidad y de la aplicación de la subvención, y con la autorización previa del director gerente del FOGAIBA.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El vicepresidente del FOGAIBA, de fecha de 22 de diciembre de 2.014, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Con fecha 21.06.2013 tuvo entrada en el Registro del FOGAIBA una solicitud de ayuda presentada por &lt;/em&gt;&lt;/span&gt;&lt;span style="font-size: 14px"&gt;&lt;em&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt; en el marco de la resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 7 de junio de 2.013, por la que se convocan subvenciones para las inversiones no productivas, correspondientes al año 2.013.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;La solicitud de ayuda de referencia es para cubrir aquellas inversiones agroambientales que no supongan un incremento de la productividad o los ingresos del agricultor/a y el ganadero/a, con la siguiente descripción:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Con fecha 27 de mayo de 2014, el solicitante &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size: 12pt"&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, presentaron un escrito en el que solicitan subrogar a favor del segundo, los derechos y deberes de la solicitud de ayuda antes mencionada, debido a un cambio de denominación jurídica de la explotación.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Se han llevado a cabo los controles administrativos de la solicitud y de la documentación aportada, y se han hecho los requerimientos, de ser necesario, para su adecuación a los requisitos establecidos en la normativa vigente.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;La valoración de la inversión por módulos se ha hecho de acuerdo a los valores aprobados por el apartado quinto de la resolución de convocatoria arriba mencionada.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;INFORMA:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. En el expediente está toda la documentación necesaria para efectuar la evaluación previa de la inversión auxiliable.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. La inversión se realiza en las Islas Baleares y que las parcelas o explotaciones se encuentran inscritas en el Registro general de explotaciones agrarias de las Islas Baleares (RGEA).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. En fecha 26/06/2013 se realizó la visita previa de comprobación de no inicio de las inversiones, por lo tanto cumple con el punto 1.d) del apartado cuarto de la citada Resolución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. De la evaluación previa del expediente núm. 38/2013, se desprende que del importe de ejecución declarado en la solicitud 3.331,25€, se haga la deducción de los gastos de las inversiones que no son elegibles para esta línea de ayudas, y que asciende en este caso, a un importe total de 0,00 €.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. El resto de las inversiones del expediente (3.331,25€) reúne todos los requisitos exigidos en la resolución de convocatoria para su elegibilidad, de acuerdo con los conceptos descritos a continuación.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. Dado el apartado quinto punto 1 de la mencionada Resolución, la ayuda máxima es del 50% de la inversión auxiliable aprobada, con los límites máximos (punto 4):&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;El importe máximo de ayuda por beneficiario será de 12.000 euros cuando las inversiones se justifiquen por facturas o bien de 6.000 euros cuando las inversiones se justifiquen por módulos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Por todo lo expuesto anteriormente, y dada el informe y propuesta de concesión del jefe de Servicio de Ayudas al Desarrollo Rural de fecha 2 de diciembre de 2.014&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;RESUELVO&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;PRIMERO.- &lt;/strong&gt;Aprobar el cambio de titular del expediente 38/2013 de la línea de ayudas de inversiones no productivas a favor de &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; Conceder una subvención a favor de &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, en el marco de la Resolución del Presidente del FOGAIBA de 7 de junio de 2.013 por la que se convocan subvenciones para las inversiones no productivas, correspondientes al año 2.013.&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;TERCERO.&lt;/strong&gt;- Autorizar y disponer el gasto señalada en &lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family: times new roman,serif"&gt;&lt;span class='lopd'&gt;(datos personales ocultos)&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;, con un importe total de MIL SEISCIENTOS SESENTA Y CINCO EUROS CON SESENTA Y TRES CENTIMOS ( 1.665,63€), con cargo a los presupuestos del FOGAIBA, que supone un 50% del importe total de la inversión elegible 3.331,25 euros, que será cofinanciado en un 35% a cargo del FEADER, en un 37% a cargo del MAGRAMA y en un 28% a cargo de la CAIB, e irá distribuido de la siguiente manera:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 35.4pt"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- 582,97 euros con cargo a la línea FEADER núm. 050405012161004&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-left: 35.4pt"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- 1.082,66 euros, de los que corresponden 616,28 euros al MAGRAMA y 466,38 euros en la CAIB.&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;CUARTO.-&lt;/strong&gt; Determinar, de acuerdo con lo establecido en los apartados 4, 9 y 10 de la Resolución del Presidente del FOGAIBA de 11 de mayo de 2.012, arriba mencionada, que será obligación del beneficiario:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Realizar y notificar las inversiones auxiliadas (que corresponden a los tipos: marges/pared y método de justificación, mediciones, y ubicaciones exactas detalladas en este informe), así como solo • licitar su pago, dentro del plazo establecido de 6 MESES, a contar desde el día siguiente de la fecha de notificación / publicación de esta resolución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la Resolución del Presidente del FOGAIBA de 11 de mayo de 2.012.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Mantener la inversión objeto de la ayuda y su destino durante al menos cinco años contados a partir de la fecha de la posible resolución de concesión de la ayuda; así como mantener los requisitos y condiciones exigibles respecto a la explotación y el beneficiario, durante dicho período.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Continuar con la actividad agraria en la explotación donde se realice la inversión solicitada durante al menos los cinco años siguientes a la fecha de la posible resolución de concesión de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Someterse a las actuaciones de comprobación y control indicadas por parte de la administración autonómica, estatal o comunitaria, Intervención General, Sindicatura de Cuentas u otros órganos de control interno o externo, así como facilitar toda la información que requieran estos organismos en relación a las ayudas concedidas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin: 0px 0px 0px 40px;"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;- Las restantes que sean de aplicación según la normativa de alto mencionada.&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;QUINTO.-&lt;/strong&gt; Notificar a los interesados la resolución de concesión mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo a los términos previstos en el artículo 60.2 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;strong&gt;SEXTO.-&lt;/strong&gt; Notificar al interesado que contra esta Resolución, que no agota la vía administrativa, se puede interponer recurso de alzada ante el Consejero de Agricultura, Medio Ambiente y Territorio, en el plazo de un mes a partir del día siguiente al de su notificación, de acuerdo con lo establecido en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 114 y 115 de la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común."&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
