PRIMERA INSTANCIA N. 21 de PALMA DE MALLORCA, por el presente, </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ANUNCIO:</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En el presente procedimiento seguido a instancia de la mercantil RAMBLAS 20, S.L., frente a DON JUAN CARLOS SERRANO FALLOS y la entidad MALLORQUINA DE PATRIMONIOS, S.L. se ha dictado sentencia, cuyo tenor literal es el siguiente: </span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>SENTENCIA: 00002/2014 </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">En Palma de Mallorca, a 10 de enero de 2014. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Vistos por mí, Dª CRISTINA ESCRIBANO GONZÁLEZ, Magistrado-Juez del Juzgado de Primera Instancia nº 21 de los de Palma de Mallorca, los presentes autos de <strong>Juicio Ordinario nº</strong> <strong>261/2012</strong> en materia de reclamación de cantidad, instados por RAMBLAS 20 SL, cuya representación se ejerce por el Procurador de los Tribunales, D. Luis Enríquez de navarra Muriedas , y su defensa por el Letrado, Dª Patricia Pizá Noguera, contra D. JUAN CARLOS SERRANO FALLOS, representado por el Procurador de los Tribunales, Dª Matilde Teresa Segura Seguí, y defendido por el Letrado, Dª Nieves Alfaro y como tercer interviniente, MALLORQUINA DE PATRIMONIOS SL, en situación de rebeldía procesal, ha recaído sobre los mismos la presente resolución judicial. </span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>FALLO</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>ESTIMO parcialmente la demanda </strong>formulada por el Procurador de los Tribunales, D. Luis Enríquez de Navarra Muriedas contra D. JUAN CARLOS SERRANO FALLOS, y en virtud de intervención contra MALLORQUINA DE PATRIMONIOS SL, y en consecuencia: </span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>1.</strong> <strong>debo ABSOLVER Y ABSUELVO libremente </strong>a D. JUAN CARLOS SERRANO FALLOS, de todos los pedimentos efectuados en su contra, con expresa imposición de las costas a la parte actora derivadas de la acción contra él ejercitada.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>2.</strong> <strong>debo CONDENAR Y CONDENO </strong>a PATRIMONIOS DE MALLORCA SL, a abonar a la actora la cantidad de 90.000 euros por la deuda vencida y exigible dimanante del contrato de préstamo hipotecario, más los intereses pactados de dicha cantidad desde su vencimiento y hasta la presente resolución y a partir de ésta los del art. 576 Lec, con expresa imposición de las costas derivadas de la acción contra ella ejercitada a esta demandada. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Y encontrándose dicho tercer interviniente, MALLORQUINA DE PATRIMONIOS, S.L., en paradero desconocido, se expide el presente a fin de que sirva de notificación en forma al mismo. </span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">PALMA DE MALLORCA a diecisiete de Octubre de dos mil catorce. </span></p> <p style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>LA SECRETARIA JUDICIAL,</strong></span></p> ]] 2015-01-01 210 CAIB CAIB 67 es 2014-12-09 67
